During a No Refusal night like New Year's Eve, if the driver refuses a breath or blood test, the officer will head to the jail, where a judge is waiting to sign a search warrant to force a blood draw.
"At the jail, it's going to be Grand Central Station," said Connie Williams, owner of the Central Texas Phlebotomy Institute. "The judges are going to be busy tonight. They're going to be on call and ready to sign [the warrants]."
Williams has worked inside the jail on busy nights like New Year's Eve. She said two tubes of blood will be drawn and submitted as soon as possible to ensure the blood alcohol level is accurate.
"If they're cooperative it's going to be an easy draw. They're going to get booked immediately after that," she said.
Williams said many times, the person is combative and uncooperative, especially if they're intoxicated.
"If they're not cooperative, they will get wheeled in in what is referred to as 'the chair' in restraints, and everything is videotaped. Usually, it still takes two to four officers to hold that person into position," said Williams.
The pain of a driving while intoxicated charge doesn't stop there.
"A DWI is extremely expensive in Texas," said criminal defense attorney Jerry Smith.
Smith handles dozens of DWIs every year. He said in total, the offense could cost you up to $20,000 and probably not less than $10,000. If you're convicted, it will never come off your record.

That seems a bit harsh.
Maybe just suspend the cop for a couple days rather than sending him to jail.

Sending him to jail will prevent him from shooting unarmed black children. Or choking them.
It is safer for everyone that way.

In Canada, a refusal to provide a breath sample yields the same penalty as a conviction for impaired driving, a simple, painless solution, from the government’s POV. Insurance companies also treat it the same way, though it is very painful as both offenses bump rates up quite a bit.
DUI has been made into a political crime, plain and simple. Same with hate crime laws.

It's now right up there with smoking. So much for trusting people with personal freedoms. If people aren't taught personal responsibility, then they will be incapable of self moderation. Vicious circle.
I can't help but think back to "It's a Wonderful Life", and how Bert the cop was portrayed. Sure, it was fiction back then, but today? Complete fantasy in a DUI situation.
We live in an analog world, where there are degrees of impairment. But in the eyes of our masters, it's digital. A single drink with dinner is something we all have to worry about now, according to the material that accompanied my latest driver's license renewal...
Violations of the 4th and 5th Amendments should be more expensive.

Why...I am a wealthy white man who teaches at Harvard. My superior intellect allows me to uniquely understand the oppressed people who mow my grass and do my dry cleaning much better than you people who live and work with them as equals and friends and colleagues.
You can 100% avoid it by not driving drunk/drugged and you can sleep it off at a friend’s house or have a non-drinking friend/taxi cab driver drop you off at home.
It beats being arrested for a DUI. This is one crime every one can avoid. I never drink and will never have a DUI record in my lifetime.
If you don’t know how impaired you might be - don’t drink! It takes a very few glasses of wine or a few cans of beer to mess up your judgment.
You can easily injure or kill someone. The police are doing their job in keeping drunk drivers off the streets.
