DOJ Says Pa. State Police Discriminated Against Women Who Flunked Physical Fitness Tests

The Obama administration is suing the Pennsylvania State Police for requiring both men and women applying for entry-level trooper jobs to pass the same physical fitness tests.

Because more men than women pass the tests, their use is discriminatory and violates Title VII of the Civil Rights Act of 1964, the Justice Department says.

From 2003-2008, approximately 94 percent of male applicants passed the test, while only 71 percent of female applicants passed.

DOJ concluded that the 2003 and the 2009 tests were "not job-related" and "not consistent with business necessity..." But the Pennsylvania State Police website makes it clear that the job of a State Trooper can be physically demanding.

"Essential job functions" of Pennsylvania State Troopers include:

-- Arresting people, "forcibly if necessary";

-- Subduing resisting suspects;

-- Pursuing fleeing suspects and performing rescue operations "which may involve quickly entering and exiting law enforcement vehicles; lifting, carrying and dragging heavy objects; climbing over and pulling up oneself over obstacles; jumping down from elevated surfaces; climbing through openings; jumping over obstacles, ditches and streams; crawling in confined areas; balancing on uneven or narrow surfaces and using body force to gain entrance through barriers."

Several years ago, the Justice Department took legal action against the Corpus Christi, Texas police department on similar grounds.

That case, finally settled in May 2013, required Corpus Christi police to replace the physical fitness tests it had been using for applicants; and distribute $700,000 in back pay to eligible female applicants who took and failed the challenged physical abilities test between 2005 and 2011.

As much as I comment on some "bad cop" threads, I DO want the police to be able to catch the bad guys. I guess Holder doesn't think that is the main purpose for police; he thinks it is an employment agency.

Ask any cop, a female cop is much more likely to pull her gun. Too often, the women don’t have the strength to subdue the bad guys.

They can reference the women in Corpus Christi who split the $700K pot for NOT being cops to enhance their pitch for the Fluke Vote.

I was thinking the same thing. Holder has been watching too many cop shows on TV where a little female cop wrestles a huge guy to the ground after a chase and handcuffs him peaceably.

Right. He should watch the several scenes from "Southland" where female cops were overpowered and beaten, one almost to death. That's probably a little more realistic than the TJ Hooker type scenes where Heather Locklear takes down some 250 pound, muscular thug.

That was also my first thought. If a woman can’t pass a test that 71% of women have successfully completed, the woman is either not motivated to prepare for the test or is physically incapable.

I was thinking that Holder was watching too many cop shows where the bad guy loses and wants to even he odds.

My sister was a cop and was pretty good at using her PR24 nightstick. That and the blackjack.
The only time she drew her gun was when she was shot at.

Seems to me the requirements for the job are fair and non-discriminatory. That is, if there is a situation it is going to require a certain level of physical ability to deal with it. Suspects aren't going to say "Gee, it's a woman trying to apprehend me, I'll only fight 3/4 as hard as if it were a man..." Or carrying that unconscious person out of harms way doesn't magically become easier just because the trooper is a woman.

In other words it takes a certain level of physical ability to perform the job safely, period. Therefore the physical fitness requirement should be the same no-matter who is applying.

Guess what, men and women are different. In general there are differences in size and physical strength between men and women. That's not a gender bias, it is a well documented and studied trait of our species. (our species is not alone in this either, it is quite common) No amount of liberal hand-wringing and wishing we were all truly equal in some unicorn dotted landscape will change that basic fact.

Apparently the physical requirements are not particularly stressing as what, 94% of men who apply pass the test? Ok, it is likely that only people reasonably fit even apply, but that is still an extremely high pass rate. Apparently 71% of women who apply pass too. That is also a great pass rate. It tells me that passing the test is not impossible for women, and in fact nearly 3 out of 4 women who try it do pass.

Watch a bunch of overweight, out of shape women rushing to apply at police departments, not really wanting the job but wanting to get in on the discrimination lawsuit payout.

Watch virtually any video of male and female cops working together to subdue a bad guy. The males jump right on top of the guy ready to fight. The females flitter around the edges grabbing at feet, trying to look involved. Any male cop with a female partner is on his own in a fight. She can call for backup but the female physical power just is not there and gets people hurt and killed. But hey, its the test that brings the problems.

So the PA State Police use equal standards? I remember when radical feminists were screaming for equality. Now of course we have moved far beyond equality in many areas to preferential treatment regardless of the outcome.

For Holder’s department to take on this problem given all of the Constitutional infractions this clown is involved in seems to me that he’s rearranging the deck furniture on the Titanic.

Any objective measurement with a minimum passing score is discriminatory by definition. They discriminate against those who can't pass. Because they are objectively measuring physical attributes regardless of sex they are not discriminating against women, just those not strong enough to do the job.

In my state there used to be a requirement for state police that they must be a minimum of 6' tall. This was waived for women and is in fact a clear case of discrimination.
