A 400-pound Staten Island dad of six, suffering for asthma, died Thursday after a cop put him in a chokehold and other officers appeared to slam his head against the sidewalk, according to a video of the incident published on The Daily News website.
I cant breathe! I cant breathe! Eric Garner, 43, is heard screaming after at least five NYPD officers took him down in front of a Tompkinsville beauty supply store when he resisted an arrest.
Within moments Garner stopped struggling and appeared to be unconscious as police called paramedics to the scene.
The Staten Island resident was sitting in front of Bay Beauty on Bay St. and Victory Blvd. just before 5 p.m. when two plainclothes cops began questioning him about selling untaxed cigarettes, the Daily News reported. he started yelling at the cops that he was innocent.
A guy, who shot the video below, tried to intervene, telling the cops his friend had just broken up a fight between three men and had not been selling cigarettes. But when backup uniformed officers arrived, the cops moved in to cuff Garner, the video shows.
Dont touch me, please, he said. When Garner refused orders to put his hands behind his back, one of the plainclothes cops got behind him and put him in a chokehold, the footage shows.
Three uniformed officers joined in on the arrest, knocking him to the ground. He screamed, I cant breathe, I cant breathe! Get off of me, get off of me! several times before he went silent.
In a statement on Friday, NYC Council Speaker Melissa Mark-Viverito called for a full, transparent and thorough investigation into the incident which led to the death of Eric Garner. New Yorkers expect and deserve to be safe and those protections must include those who are in the custody of NYPD.
Mayor Bill de Blasio said in a statement, On behalf of all New Yorkers, I extend my deepest condolences to the family of Mr. Garner, who died yesterday afternoon while being placed in police custody. We have a responsibility to keep every New Yorker safe, and that includes when individuals are in custody of the NYPD. That is a responsibility that Police Commissioner Bratton and I take very seriously. We are harnessing all resources available to the City to ensure a full and thorough investigation of the circumstances of this tragic incident. The NYPDs Internal Affairs Bureau is working closely with the Office of the Richmond County District Attorney, which is leading this investigation.
The mayor will have a press availability at City Hall this afternoon, before he takes off for vacation in Italy.

I think it’s inordinately clear, wideawake blamed the death of the victim on the victim right from the beginning.
Look at the date and comments made at post#2 by wideawake.
This individual has a clear pattern of backing and supporting law enforcement regardless of facts, tactics or what occurred.
When everything seemed to fail, with video and heavy handed tactics looking real bad, the victims background in brought in to discredit them. Even if it has zip to do with a certain incident/event...The media/government does this all the time...Every day. They are experts at it.
I have to say that a lot of the commentary on this thread is deeply irrational.
If you actually watch the heavily edited video (and it was heavily edited by someone with an anti-police agenda, and probably leaves out footage complimentary to the police and detrimental to the crook), it is remarkable how professionally Garner was treated.
The entire sequence from the beginning of the takedown, to Garner experiencing distress, to alerting EMS took about 15 seconds.
A careful analysis of the available video also shows that there was no "choke hold" but a headlock.
There were no heavy handed tactics.
That's kind of the point.
All the "analysis" of this video has been uninformed, emotional, and flawed from the beginning.
And, again, it's not Garner's "fault" that he is dead.
There is no one to blame, because his death was a matter of statistical regression.

Again, no one killed Eric Garner.
Eric Garner died of a heart attack, a heart attack which could have happened at literally any moment.
But I do think that if you're being arrested, the time to protest your arrest is at your arraignment.
Fighting the police will not help you evade arrest, it will multiply the charges against you, and it will make you more liable to be convicted.
Do you disagree? If you were ever arrested on what you believe are bogus grounds, do you think you could talk or fight your way out of it?

Section 203-11 of the NYPD Patrol Guide is clear:
Members of the New York City Police Department will not use choke holds. A choke hold shall include, but is not limited to, any pressure to the throat or windpipe, which may prevent or hinder breathing or reduce intake of air.

Why do you jump to the belief this was a heart attack? What part of a chokehold for an unarmed man selling untaxed cigarettes is jusified?
I agree with your points some of the time, but on this, your head is firmly up where the sun doesn’t shine.
How about just talking to him til his adrenaline from breaking up a fight dissipates? Or is that asking too much of the thugs’ valuable time? Or maybe even just tell him to come talk to them after he had calmed down? Why is it that your ilk thinks every bit of thuggish behavior is somehow justified no matter the outcome? I used to have a whole heap of respect for your opinions but you just blew that clean over into the next county.

However wideawake your explanation is flawed as you seem to view absolute compliance with and arresting officer is required by all.

Does that not to apply to the officers administering the law enforcement duties. You seem to believe it applies only to the SUSPECTED law breaker... at least from the law books and legal definitions as determined by you. SCOTUS would argue that with you, as it is pretty much a one on one chance until the suspect is CONVICTED.
If they would have sprayed him with bear spray he would be compliant, alive, and facing court instead of dead.
Bear Spray will/has stopped POLAR BEARS of 1200 lbs why would it not stop a 400 lbs suspect?
He would have choked, maybe vomited mucus, gasp for air, but a couple of cups of water would wash it away.
Bears live with no help in washing it off, and leave all the time. The main thing is they do not want to be sprayed again so calm down and leave.
People are incapacitated but alive and after 30 minutes of water washing (or so). They are then very compliant.
But alive.
