When New Mexico police stopped a local driver for committing a minor moving violation, they decided to check whether he was carrying drugs in his anus.
So they procured a warrant, drove him to two different hospitals, forced him to endure eight medical procedures including an invasive colonoscopy and stuck him with the bill.
No drugs were found.
According to medical records, police reports and a federal lawsuit obtained by KOB-TV, police held Eckert until they were able to procure a warrant from a judge to search the mans anal cavity. They then drove him to a nearby hospital and instructed doctors to examine his anus.
Doctors at Members Memorial Hospital refused to cooperate, however, telling officers that the search would be unethical.
Deming Police then took Eckert to Gila Regional Medical Center in Silver City. This time, Eckert wasnt so lucky.
Medical officials stuck their fingers inside Eckerts rectum, but found no drugs. An enema was next. When that didnt produce the drugs, they gave Eckert two more. He was forced to defecate in front of the medical officials and police, but still, no drugs were found.
Eckert was then prepped for another operation. Doctors knocked him out and gave him a colonoscopy an invasive medical procedure that involves sticking a tube up the patients rectum, anus, colon and intestine.
Before the ordeal was over, Eckert had suffered through eight medical procedures. He objected to each and every one.
Adding insult to injury, the hospital stuck Eckert with the bill, and has threatened to take him to court to pay it.
Adding further insult to injury, the warrant had expired by the time doctors performed the procedures, and the warrant only ever covered procedures in Luna County. Gila Regional is in Grant County.
Eckert has filed suit against the individual police officers who tormented him, the police department and the hospital.
The thought that they could do this to a man in our country is terrifying, said Shannon Kennedy, Eckerts attorney, in a statement to KOB-TV. This is something out of a science fiction film. Anal probing by government officials and public employees?
The local news channel reached out to the Deming Police Chief Brandon Gigante, who referred questions about the incident to an attorney. However, he did maintain that his officers always follow proper protocol.
Who in the world would want more info? It’s teetering on TMI already. We don’t need need pics or video
Maybe the guy criticized Obama or something.
If he mouthed off to them, why’d they go after the other end?
LOL! People were questioning where the fact that he was x-rayed before the enemas and probes came from. It’s in the original story.
Cops and Police Depts. do not have immunity like judges and prosecutors....so they will be sued and lose big time...the Silver City hospital will pay even more
Also...seems like this man was an Anglo...and the Deming Chief and PD are Hispanic...I suspect that there was some La Raza/Mestizo/Hispanic Racism involved here
Is this part of their training? Could there be any other reason for someone to contract their buttock muscles?
In my locality we had a guy smuggle a loaded syringe into the county jail. The cap on the needle became dislodged prior to him being able to recover it. Much pain ensued, along with extensive damage to his rectum.
Just google “Drug busts on I40” and you will see why so many people get pulled over on I40. It’s a lucrative fertile field for farming drug runners.
I’ve driven through New Mexico on I40 several times and usually get pulled over and ticketed for something. Speeding, my brother wasn’t wearing his seat belt, and changing lanes without signalling. Every time it was by a State Trooper and they requested to search the car .... well they didn’t really request, just stated they wanted to. I always say: “I do not agree to a car search, however if you insist on conducting a search unauthorized by me I’ll just peacefully stand over yonder until you’re done.
The worst one happened 3 days after Oklahoma City bombing. Kept me on the side of the road for quite some time until he could get authorization. It ended up being “Well, the law allows us to search the immediate vicinity of the driver, so he ended up searching, sniffing my driver side. Then ticketed my brother (the passenger lol).
They didn't, they just used an alternate approach.
In all likelihood the only people who will suffer consequences from this are the taxpayers of Deming and Gila County, which owns the hospital. Maybe the doctors will lose their licenses, but I doubt it.
One of the two cops involved was promoted to captain after he conspired to rape his victim.
Actually, no.
Actually, HELL NO!
that war on drugs is getting pretty intrusive.
he’ll get a buttload of money, taxpayers will get the bill.
police will still retire at 55 with a fat pension.
rinse,wash,repeat.
“when he did, officers noted that he appeared to be clenching his butt cheeks”
Dealing with modern cops is enough to make anyone clench a little.
“And just how pray tell is a citizens medical record given out on an FOI by the media.”
Probably the plaintiff included the medical records in his filing, and thus they became public records.
Yes, the Hospital has the deepest pockets I can see. Deming is a small town.
“they have your name and address, and now they have probable cause to search your home”
Meh, I don’t live in a jurisdiction where this is done, and if it happened, I wouldn’t be living there any more. Good luck with the cops getting cops in another jurisdiction to do their dirty work for them to get a forced colonoscopy on me. I wouldn’t be too worried.
You sound like someone who has never snuck out of a hospital under the cops’ noses before :)
“hell get a buttload of money”
He better find a safer place to store it than there, in case the cops come checking again.
In a just world, the jackboots would take a long drop on a short rope - and their estate left with the bill for the rope.
This is about an individual who just pulled out of a Walmart parking lot.
