Day 22 (Week #5) Zimmerman Trial – Witness Discussion Thread

Today, July 10th, is DAY #22 (of 5th week) State of Florida V. George Zimmerman case.

Yesterday began with a boom as defense expert witness, world renowned Dr Vincent Di Maio took to the stand to validate the forensic evidence supporting George Zimmerman’s version of the encounter with Trayvon Martin. However, the day ended with an even bigger THUNDERCLAP in an epic 10pm showdown as Don West took on both the State prosecutors and trial Judge Nelson after the jury was released. Ending with Judge Nelson, turning her back and walking out of court. Unreal. A great analysis of the events from yesterday is available HERE.

The late night argument, not by the State, but by Judge Nelson herself, regarding phone evidence authentication, is so weak and insufferably devoid of legal analysis it is absurd on its face. Then again, this is the same judge who said a few days ago, flippantly in open court, that evidence should be “shredded” (Dr. Bao notes) after use. D’oh

Essentially Nelson argued that the phone records (texts and pics from Trayvon) cannot be authenticated to have originated by the specific personage of Trayvon Martin (despite two security codes) because anyone could have sent them. Whiskey*Tango*Foxtrot !!

How can an email be used in a sex offender case? How can phone records be used in RICO cases? How can GPS evidence be used in Insurance Cases? How are photographs taken by perps used against them? Think about it.

You can’t argue that evidence cannot be admitted because someone else might have made the actual phone call; Someone else might have physically sent the email; Someone else actually accessed the website; Someone else might have been the driver of the car; Or, someone else could possibly have been behind the viewing lens of the camera etc.

No, that argument does not mean you can arbitrarily exclude evidence. And this was the basis for her argument (watch the video).

Sure, that’s an argument which can be presented to the jury by the other side, as a counter point to create doubt with the jury, but it can’t be a reasonable consideration for total evidence exclusion. Then again, this is Judge Nelson – who in multiple prior cases has a high historical propensity of being overruled by the 5th District Court of Appeals.

It should be noted the NAACP Annual National Convention starts in Orlando on Friday; Additionally, preparations are being made in/around Miami-Dade for a Wednesday defense wrapped up with a community/LEO preparation meeting yesterday.

The judge has no clue how asinine she sounds by stating his right to silence, then pounding him about whether he will testify. As though GZ’s right to silence does not extend to indicating whether he will testify at this point in the proceedings.

I wanted to give some of these players the benefit of the doubt...like someone said earlier they have been handed a crap sandwich...but it’s possible that this judge especially has a seared conscience. G-d help George.

I’ve never heard of this type of thing before. Could this corrupt judge be trying to get Zimmerman to do something that she could declare as being in contempt of court. Or perhaps trying to get Zimmerman to ignore his brilliant defense team and say he wants to testify? Very strange—I wish I was watching a live stream of this now.

"I know a guy who was a "witness" at a grand jury summons. I (attorney) showed up with him and the detective didn't like that very much. It was uneventful (a good thing), but they were professional when I was there."

There was no Republican Party functioning in our county so we only had a Democrat primary. My husband said he wasn't voting in another Democrat primary, so he ran for Republican Chairman and we started a party. Within four years, we had elected four Republicans to major offices. This Democrat district judge hated us for messing up her county, so she appointed a grand jury of people related to her or people working for a relative. She got a special prosecutor and his printed instructions were to look for Republican office holders committing a crime.

A friend of mine went to that grand jury and told the truth which was she knew nothing of any wrong doing by Republicans. The individual grand jurors could speak at any time and they said they didn't believe her, that she was lying. Within a week, she got another summons and the same thing happened - they called her a liar.

We decided if they called her again, to take the fifth. They did call her and she did take the fifth. The judge was furious and so was her grand jury but they had to dismiss her and they stopped calling her.

I knew they were looking for me and if they had found me, I also would have taken the fifth. There is no point in saying anything if they are just going to call you a liar and not believe you.

That whole experience and all those trials the Republicans had to go through, taught me that judges are just people and that's it. They will act for their own good and they don't care jack about the truth.

Zimmerman was obviously upset after that tirade by the judge nasty cakes.

Imagine if those TV cameras and lights were on you, and the media is waiting hoping for 1 moment of smiling, sneering, or sweating.

He is quite a gentleman, in control of his emotions.

I just canNOT believe this judge. WTH is going on ?!?! I came home for lunch and turn the tv on to see her basically yelling at West.

The corruption in this case is so blatant.

The judge isn’t trying to force GZ to testify. She is trying to force the defense to show their hand (strategy). This is insanity!

I’ve never heard a judge badger a defendant into whether he was testifying or not before the defense ended the their case. What’s her issue? Why does she need to know so bad?
