Bottled-water purchase leads to night in jail for UVa student

When a half-dozen men and a woman in street clothes closed in on University of Virginia student Elizabeth Daly, 20, she and two roommates panicked.

That led to Daly spending a night and an afternoon in the Albemarle-Charlottesville Regional Jail. Her initial offense? Walking to her car with bottled water, cookie dough and ice cream just purchased from the Harris Teeter in the Barracks Road Shopping Center for a sorority benefit fundraiser.

A group of state Alcoholic Beverage Control agents clad in plainclothes approached her, suspecting the blue carton of LaCroix sparkling water to be a 12-pack of beer. Police say one of the agents jumped on the hood of her car. She says one drew a gun. Unsure of who they were, Daly tried to flee the darkened parking lot. "They were showing unidentifiable badges after they approached us, but we became frightened, as they were not in anything close to a uniform," she recalled Thursday in a written account of the April 11 incident.

"I couldn't put my windows down unless I started my car, and when I started my car they began yelling to not move the car, not to start the car. They began trying to break the windows. My roommates and I were ... terrified," Daly stated.

Charlottesville Commonwealth's Attorney Dave Chapman read Daly's account and said it was factually consistent.

Prosecutors say she apologized profusely when she realized who the agents were. But that wasn't good enough for ABC agents, who charged her with three felonies. Prosecutors withdrew those charges Thursday in Charlottesville General District Court, but Daly still can't understand why she sat in jail.

There’s a bigger problem here that needs to be addressed. We have no way of knowing which are the crooks and which are the government.

We can’t tell by the documentation because documentation can be faked easily. And everybody who has poo-poohed Obama’s forged identification papers this whole time is saying it doesn’t matter.

And we can’t tell by the behavior because the government acts like crooks. Even if we knew they were government agents, that doesn’t mean they are not either a perverted rogue or instructed by a perverted rogue regime.

This woman had just heard stories of people who had been victimized, and I’m sure she was instructed not to just trust anybody and everybody. When - oh, when - will the society figure out that when the government can’t be distinguished from thugs, nobody will ever be safe? This is foundational for civilization, and yet everybody in the freaking world is acting like people are crazy for saying documentation matters, and credible behavior matters. This thug regime has provably forged all Obama’s documentation, and his regime’s behavior is that of a crook - as evidenced by all the scandals (that nobody is actually doing anything about).

I’ll bet the bullies with badges felt like real men, attacking those girls who bought water and ice cream. The girls were fortunate that the bullies weren’t wearing their black ninja outfits or they would have been shot for sure.

Oh...and no one will get fired over this egregious harassment of innocent citizens. If anything, they’ll be put on paid leave so the taxpayers will provide a paid vacation for their trouble.

The local ABC board cops are barely one level above the mallcops and when you add the “us against them” semi-mil training brainwashing their put through, this is what can occur. Even though my state tax will take the hit, I hope she can retire on the proceeds of the civil suit.

While realizing a lot can be ‘lost in translation’, if this story is for the most part, correct and true, then this is a VERY Disturbing Article.
For beer? Drawn Guns? Jumping on her vehicle?
May be bravado etc, but six or seven ‘thugs’ in CIVVIES, jump on my vehicle and draw down on me, I may not get them all but a good portion of them will be hurting.

How we must address the problem is to first believe that nothing this government does or says can be trusted when it is in control by a plethora of administration O'bots that are completely willing to lie apologetically and commit acts that are in direct conflict with our constitution.

This trend (LEO over-reaction) is going to continue and then someone is going to blow away one of these idiots away and then it will go to trial and a jury is going to find the defendant Not Guilty and then its katie-bar-the-door for ALL Citizens dealing with overzealous LEOs.

The pendulum can swing only so far to one side...

It’s easy to talk like that when it’s “the government” or “the regime” but when it’s your local cop what do you do? Because that’s where the regime is going to bring this all down to, unless we chop the regime out at its roots. Our “leaders” need to be told loudly and clearly that at a time of extraordinary need, just doing the same old, same old is not enough - is dereliction of duty. It is time for extraordinary courage. Unless somebody stands up and makes the bold move, this regime will take over everything, including the local cops.

Believe it that I am fastidiously aware of the foundational attitude and actions of local law enforcement with regard to this. I am most vigilant in judging how/why/when and where they execute their duties and I respond accordingly with voting and donations.

Fortunately, I live in a very conservative county and law enforcement here is like minded as are most county employees.

In Houston there have been a number of violent 3 am home invasions where the thugs dressed up in windbreakers with somewhat realistic “FBI” and “DEA” on the back, plus phony badges.

I’m guessing Union thugs.

I don’t know about VA but here in PA which is also an ABC Commonwealth meaning the Commonwealth controls the sale of alcohol via “state stores”, the Liquor Control Board (LCB) workers are all unionized and I would guess that includes the “agents” who aren’t really the police but are given police powers when it comes to the sale and consumption of alcohol.

From what I understand, beer and wine can be sold in some grocery and convenience stores in VA and there are now a very limited number of grocery stores here in PA that can sell beer but here in PA most beer is sold by specially licensed “distributorships” but they can only legally sell beer by the case. All liquor and wine is sold only through LCB stores in PA where you are waited on by unionized Commonwealth workers with all the charm and attention to customer satisfaction that you would expect to find at PennDot when you go to get your driver’s license renewed.

For the past couple of years here in PA there has been legislation proposed to completely privatize the LCB stores and you should hear the commercials that their union has been running – the scare tactics, among them that without the highly trained LCB workers, little children will see their parents die because of drunk drivers – I’m not kidding.

If cops are going to go under cover or wear a mask, they had better expect that they will be perceived as criminals by the public. And if perceived as a criminal, they should expect lethal force from armed citizens in these type of situations. There is no need for LEOs to go under cover with the purpose of enforcing laws regarding small purchases of alcohol; a uniformed officer is all that is required for these situations. Under cover operations should be reserved for investigating crime syndicates and the like.
I can only conclude that this police force goes under cover because they want to intimidate the public and they don’t mind when things get out of hand.

We’re getting close to the point where citizens will not be able to tell the difference between the government sector criminals and the private sector criminals. If the private sector thugs are going to copy the Feds with 3am SWAT raids, the Feds will have to expect a gun fight every time they launch a raid on a private citizen.
A lot of wars start this way; an unexpected event acts as a catalyst for further violence between two distrusting groups- the government and the people in this case.

I actually am IN the liquor biz here in Ma.

I had one kid that worked for me,who WAS over 21,buy a case of beer from the store.He was heading for his car with his girlfriend,who was only 20,and a local cop who happened to be in the parking lot saw them and would not let him put that beer in his car because SHE wasn't of age!So the local,small town cops have their fare share of Barney Fifes,too!

And if we were to challenge the cops,then all we'd get for our troubles is a cruiser parked outside the store 24/7...harassing ALL our customers!

And a few months before that,one of my cashiers caught a kid from a local college with a phony ID and called the cops.She knew the license was fake because she ALSO saw the girl's college ID card,and she had gone to the same college before and knew that the first numbers on the college ID card were the student's birth date...which DIDN'T match the date on the license!

She ran out of the store to a waiting car and took off,and when a cruiser FINALLY showed up,the cop didn't even want to get out of his car to look at the security tape! But these same cops have no reservations about running sting operations where they dress kids up to look older and try to trick stores into selling to them!

And they pull the same stunts with sting operations with CIGARETTES!
