What we probably disagree on is what constitutes a war.

We certainly disagree on that. But that's less germane.

I was trying to reconcile this:

I’m glad they’re dead. I’d bet that in the past they had gloated over other succesful robberies...well sometimes you win, sometimes you lose. And their short lives ended on the floor of a basement, choking in blood after trying and failing to victimize an old man. Their existence was so short and meaningless that they might as well never have lived. Good.

With this:

Hey troll.. newbie... read the story.... he gut shot the first kid then went up and shot him in the face then he hid the body . Then he waited for the girl shot her up and then put the gun in her mouth and blew her brains out.

Then...if that’s not enough he goes to bed with the corpses downstairs....because he’s so considerate he didn’t want to bother the cops on a holiday!!!

And you call this a “mistake”!! With your standards I spose John Wayne Gacy made an error in judgement..HA

Not only that this guy wasn’t a cop he was a lame ass federal employee security guard....easiest job on the planet. Now Barney Fife decides to play Rambo and he’s gonna get his ass handed to him in prison....Oh,,,get me a violin. Hell skip the prison rape ...I hope someone just gives him the Damer treatment and bashes his cowardly head in.

Is this the first question you’ve avoided or do you make a practice of it?

Care to explain why you used the loaded phrase of “high power rifle” when that is a known gun grabber phrase often used by the media to describe all rifles no matter what their caliber?

Or you could check my join date again.

If they are still breathing they are a threat. Look at all the drugs out there that render these “so called non-threats”.

How is an innocent supposed to distinguish between? If your life is in threat fight takes over.

Really??? So then why doesn't the law state that someone engaging in self defense is permitted to shoot until the other person stops breathing???

There is no problem in wanting a repeat druggie burglar and home invasion robber dead.

There is a problem with wanting the same criminal alive at the risk of the death or injury of a homeowner victim in his own home.

That is not self defense. That is murder.

That the jury will decide.

In this case his words may help him more than hurt him. It sounds from the way he describes what happened that he didn't consider what he was doing to be a crime. Lack of intent to commit a criminal action could lead to a findng of not guilty by reason of insanity.

Yes, I agree that this (along with the fact that he waited until after the holiday to report the incident) certainly opens the door for a psych evaluation.

Is there a law that states how many times you can shoot a perp who breaks into your home?

I doubt that there is legislative language but I can assure you that it is a prosecutor's issue and he or she can nail your aXX to the wall for murder if you shoot to kill after the threat is negated.

I can distinctly remember the instructions given to me by an NRA instructor, who was himself a retired LEO. He said you keep shooting until the threatening person falls to the ground and then you stop. You definitely stop at that point. Any further and you can be charged with murder. And I think Mr. Smith will be charged with murder.

Hang on a minute. "High Power" is simply a category of rifle used in competition - usually military calibers such as the .30-06, .308 and yes, even the .223. The designation is to differentiate those events from the smallbore (rimfire) rifle competition events.

It has nothing to do with the actual muzzle energy or velocity of the cartridge, so ironically the media's use of that phrase is more often correct than when they trot out the "assault" nonsense.

But to place a kill shot under chin through the head to a young 100 pound girl....

She was an adult. Who made a choice to go into an occupied home and then to go down to where the owner was in his basement.

Do you think she just wanted to give him a kiss?

Say "hey, sorry we are taking your stuff but we need to buy more dope. No hard feelings right?"

Or do you think that maybe just maybe this sweet young thang was going to do something rather unpleasant to the old fellow?

People who break into a dwelling deserve to die. By their actions they show that they are quite comfortable with hurting the people who live there.

It’s as possible as him being a psychopathic killer that lured two unsuspecting thieves/drug addicts into his home for some hot Ed Gein action...

Given his supposed history, I’m betting my original scenario is a lot more plausible...

Let the punishment fit the crime.
If you subscribe to Biblical pronciples remember the thief in the night could be struck and killed most likely based on the idea you couldn’t tell if he was armed no could you see well enough to be sure of your blow.

shooting s thief(burglar) who is down and no longer a threat in a well-lit situation is different.Execution or coup-de-grace shots are not part of normal self-defense training,nor is bragging about it afterwards.

THe two burglars were in the wrong and if the old man was threatened then he had the right to defend himself,but not perform an execution.That act made him as bad as them.Well,that and not calling the police and probably entertaining some thought of hiding the bodies.The old man KNEW he went too far.

I think Sfictional herrif Taylor of Mayberry and plenty of real peace officers would be very concerned with anyone advocating killing two people and hiding the act.No jackboots needed.

You have a warped idea of freedom.Freedom doesn’t mean killing and hiding evidence with impunity anymore than it means robbing someone’s home with impunity.

The moment the old man fired in the head,execution style ,of the injured and presumably no longer able to resist burglars,he lost any sympathy from normal people.

American society has not condoned the death sentence for burglary as far as I am aware,especially without trial.Granted ,too often scumbags who enter to steal and do kill the resident are usually not punished as they ought to be.

I’m not seeing any good guys in this story,sorry.
