I asked if after the 5 months they would deny my unemployment claim. The HR guy said no. But, when I asked him if it was in the agreement, he said it wasn't.

Since I know the owner very well and truly do not trust the guy, I know I am going to have to get an attorney.

By signing it I was not able to collect unemployment

A visit to an attorney will cost you minimal compared to what it could cost you if you sign the wrong thing. Be safe.

I think - FWIW - the HR guy is right. You are being fired. If later you file for unemployment, the company CAN’T deny a thing.

Take the money. Start looking for a job tomorrow. And Good luck and God Bless.

Be careful with the attorney. He could end up with the money, you get a bad deal and nothing to show for it. Have you done a good thourough search for this on the net? I’ll bet there are a lot of people who have faced this.

I'll be happy to take your case at only $25 per hour. While I'm not really an attorney, I did stay at a Holiday Inn Express last night.

So, here's my first hour of advice to you, file for unemployment..........

Um, based on what you have posted so far, they are prepared to fire you or cause, and if so, would preclude you from getting unemployment.

They can to pay out your vacation nor salary earned to date.

Between the month salary owned and the vacation, they owe you close to 2 months compensation. Are they giving you 5 months on top of the vacation and earnings to date?

And, do they have a cause for firing you? Performance is not specific enough. If they have cause, take the offer and move on...
