Tom Petty Demands Michele Bachmann Stop Playing His Song

The management for rock and roll star Tom Petty didn't waste any time after Bachmann's campaign launch yesterday to send a cease-and-desist letter, demanding that she never use his song "American Girl" at campaign events again. These requests are not uncommon for Republican candidates, and it's one of the things that genuinely sucks for them. They can never use the easygoing, overplayed songs that they enjoy on FM radio, and they learn that their favorite artists despise them. Democrats' problem, on the other hand, is that they have to feign gratitude to all the musicians who write bad songs for them, kind of like accepting the annual box of dirt-flavored hard taffy that grandmother gives you on birthdays.

How the hell do you know that she didn’t pay the label for right to use that song? If the article said specifically that she used the song without paying for it, then I understand your point. But my presumption is that the campaign followed the rules and obtained fair use license for it.

Petty has a lot of talent and I enjoyed his role as Dam Master in the Postman. Unfortunately he also did this to Dubya when Dubya tried to use “I Won't Back Down.”

Does Petty own full rights to his own music?

If not, I'm not sure what his complaint would be, since he agreed to give up ownership rights.

Of course, the MSM will point out that Bachman doesn't have Petty's support to use her own campaign music every chance they get, so it probably is best to just drop it for Michelle.

I suspect Petty actually wants Bachmann to play that classic song as much as possible. He just wants to get paid for it.

In the eighties, I often found myself amazed at how many of my fellow musicians were very left-leaning. Not all, certainly, but a lot were. Go figure. With regard to Mrs. Bachmann, there are conservative musicians out there. The first that comes to mind would be Vince Furnier - Alice Cooper. He’s a registered Republican, last I heard. There are others, too. Just as Jon Voight isn’t the only good guy in Hollywood, there are musical folks out there. A better idea, though, might be for her to find a few musicians and just write her own theme song. Then there aren’t any rights issues. Yes, it’s more difficult, but at least it avoids this sort of silliness. Just a thought. ;)

I recall that he spoke about Hynde and said when she was asked about him playing that song, she asked ‘who’s Rush’. So when did a lawsuit take place?

Your point is exactly what pisses me off about this.

If Michele Bachmann bought the right to use the song, in the legally agreed to manner and for the legally agreed to rate, then Tom Petty has no business calling her out for it.

He doesn’t own the song!

And his singling her out is discrimination.

Apparently Petty only wants ‘American Girl’ to be associated with a brutal, psychopathic, serial killer who prefers to eat human liver...Silence of the Lambs. Yeah that's it Tom only approve the usage for demented projects/causes.

Truthfully, I can’t blame Petty for this. It’s his stuff, and having it used in a political campaign must be like a parent seeing their small child dressed up in a stupid costume doing stupid things on national TV.

If she wanted his music that badly, she could have hired some other musician to do a cover of it under “fair use”. It’s done all the time.

I stopped by wikipedia to see if I could easily figure out whether he retained publishing, didn’t find that.

But I did note this, from a category entitled “Usage In Recent Media:”
“The song has been featured in several Hollywood films, most notably FM (1978), Fast Times at Ridgemont High (1982), The Silence of the Lambs (1991) and Chasing Liberty (2004). Its use in The Silence of the Lambs made the list of Top 11 Uses of Classic Rock in Cinema at UGO.

It was featured in the TV series Scrubs, in a scene of an episode titled “My Own American Girl”, which was first aired on October 2, 2003. It was also featured in The Sopranos, in season 6 episode “Join the Club”.

The song was recently featured on the “NBC” comedy, “Parks and Recreation”, at the end of Season 3’s “Harvest Festival” episode.

The song was frequently played during Hillary Clinton rallies or town hall meetings during the 2008 Democratic Primaries.

The Strokes have admitted to taking the riff for their 2001 single, “Last Nite”, from this song. In a 2006 interview with Rolling Stone magazine, Tom Petty said “The Strokes took “American Girl”, and I saw an interview with them where they actually admitted it. That made me laugh out loud. I was like, ‘OK, good for you.’ It doesn’t bother me”.[6] This was brought up because of plagiarism accusations on the Red Hot Chili Peppers for similarities between their “Dani California” and Petty’s “Mary Jane’s Last Dance”. Petty has stated that he does not care about any similarities and The Strokes have actually played as an opening act for Tom Petty in summer of 2006.”

I thought, hmm. Just depends on who is using it, I guess. It’s apparently okay to, umm, ‘purloin/borrow/adapt’ portions of his work if it amuses him. Not my intent to malign him, as I own some of his work, and think well of it. But apparently the okay exists solely for those on the left.
