WYOMISSING, Pa.- A Pennsylvania woman whose fall into a mall fountain while texting went viral on YouTube said Thursday she's considering suing.
"I didn't get an apology, what I got was, 'At least nobody knows it was you.' But I knew it was me," Cathy Cruz Marrero, 49, said Thursday on ABC's "Good Morning America."
Marrero's attorney, James Polyak, said he wants to know the identities of the security personnel at the Berkshire Mall in Wyomissing responsible for making the video public, as nearly 2 million people have watched his client stumble obliviously into the fountain.
"I was like, 'I'm hoping nobody saw me. So let me just walk away,'" Marrero said, adding a word of advice to the digitally obsessed: "Do not text and walk. The fountain could have been empty. ... I could have walked into a bus, you know. ... I could have got hit by a car. It can happen anywhere ... anywhere."
Marrero has her own legal problems, having been charged with theft by deception and receiving stolen property in October 2009. Her next court date is April 21, where she likely will be sentenced to six months of house arrest and electronic monitoring for allegedly using a co-worker's credit cards to purchase jewelry worth thousands of dollars without authorization, ABC said.
Marrero also has four convictions for retail theft in the late 1990s and was convicted of a hit-and-run in 2009.
“I don’t think he has the brains or intelligent to win a lawsuit of any kind.”
Unfortunately, the mere threat of a lawsuit is often enough to provoke an out of court settlement.

I guess she didn’t know that. Her lawyer should be disbarred for taking the case and wasting the courts time and resources.

Not if I owned the mall. I am pretty sure most any freeper could go to the court room and beat her and her lawyer like a drum with not a lot of out of pocket expense.

“I could have got hit by a car...” That’s true if you also text while walking in the street.

Just found the video, she lifted her leg to get over the wall. She walked, not fell, in to the fountain.
Gravity is a cunning and patient foe, honey. Get used to it.
Lessee.... no one knows it's you, and you are embarrassed and want no one to know it's you, THEREFORE, you go on ABC news and talk about your experience, giving your name, age, and exact location.
And then you sue because your privacy was compromised.

how about the mall owners sue her for disturbing the fountain.
If she would have just shut up, no one would have known she fell into the fountain. She CAME forward and admitted it, and is now wanting sympathy. Sorry, ain’t getting any from me.

I was pissing into a urinal at the grocery store. Out of the corner of my eye I saw movement to my right. When I looked over,it was a woman texting.
I said, lady, you are in the wrong bathroom. She said sorry, but just kept on texting.

Multiple convictions for retail theft and credit-card fraud? You know, I wouldn’t be entirely surprised if part of that hearing went like this...
“Ms. Marrero, what were you doing in the mall in the first place? I thought we ordered you to stay out of there.”
