Fountain-falling texter: 'I'll sue'

WYOMISSING, Pa.- A Pennsylvania woman whose fall into a mall fountain while texting went viral on YouTube said Thursday she's considering suing.

"I didn't get an apology, what I got was, 'At least nobody knows it was you.' But I knew it was me," Cathy Cruz Marrero, 49, said Thursday on ABC's "Good Morning America."

Marrero's attorney, James Polyak, said he wants to know the identities of the security personnel at the Berkshire Mall in Wyomissing responsible for making the video public, as nearly 2 million people have watched his client stumble obliviously into the fountain.

"I was like, 'I'm hoping nobody saw me. So let me just walk away,'" Marrero said, adding a word of advice to the digitally obsessed: "Do not text and walk. … The fountain could have been empty. ... I could have walked into a bus, you know. ... I could have got hit by a car. It can happen anywhere ... anywhere."

Marrero has her own legal problems, having been charged with theft by deception and receiving stolen property in October 2009. Her next court date is April 21, where she likely will be sentenced to six months of house arrest and electronic monitoring for allegedly using a co-worker's credit cards to purchase jewelry worth thousands of dollars without authorization, ABC said.

Marrero also has four convictions for retail theft in the late 1990s and was convicted of a hit-and-run in 2009.

2. I wouldn't have called you, either.

has the brains or intelligent to win a lawsuit of any kind.

My daughter had a friend show up on 'People of Walmart'. Her friend wasn't happy about it, but didn't try and sue anyone!

Take your own damn feelings into consideration, poor boob. You want to sue because someone put the video of you walking into the fountain because you failed to take normal precautions? But I saw the videos. There is no one in the world except you and perhaps your unfortunate family who could identify you from the videos. You brought it on yourself by identifying yourself. Once that happened and you were arrested for your theft, you made yourself even more newsworthy. Are you going to sue the state for releasing to the public the details surrounding your arrest? Are you going to sue the newspapers for putting together your talk of suing the mall with your arrest for theft? In all of the many different layers of this lasagna of a drama, there is one ingredient without which none of this would have happened at all: you. Well, there's another ingredient that both situations have in common: you believe that you shouldn't have to live under the reasonable constraints and exercise the same personal responsibility as everyone else.

Thanks for bringing that to our attention. Her glasses are identical to mine. And I was once so busy talking to colleagues that I walked right into an equally attentive woman going the other direction. At least it wasn't caught on security video.

She's right! Fountains can appear right in the path of innocent pedestrians at any moment! One second you're enjoying the crisp fresh air of a mountain trail, and BAM! A fountain pops up right in front of you! Or you're getting up from your living room sofa to answer nature's call, and POW! A fountain suddenly appears in your hallway!
