No birth certificate among passport documents

Passport documents for Stanley Ann Dunham Soetoro recently released by the State Department did not include any birth-certificate documentation for Barack Obama, despite a memorandum in the file claiming he was born in Honolulu.

The released documents indicate Dunham's husband, Lolo Soetoro, petitioned the Immigration and Naturalization Service of the State Department in 1967 to obtain a waiver to return to the United States to rejoin his wife and her infant son, Barack Obama Jr.

A WND timeline drawn from the State Department's July 29 Freedom of Information Act release of passport documents indicates Lolo Soetoro returned to Indonesia July 20, 1966, after completing his studies at the University of Hawaii. Soetoro was required to complete a mandatory two-year residence requirement in Indonesia before he could be granted a visa to return to the U.S.

In an apparent attempt to establish the nationality of Barack Obama Jr., a person named Mix submitted a poorly typed and difficult-to-decipher memo to the file, dated Sept. 14, 1967, without identifying any official position he or she may have held with State Department at that time.

Legally, you are an “infant” until you are 18. The term is used synonymously with unemancipated minor. So when we say “an infant can void a contract entered into during the period of infancy” we are not talking about a 9 month old who signed a contract. We’re talking about folks under 18.

That, and an allegedly American born can submit a “Statement of No Record” and a DS10A signed by an older blood relative in lieu of an actual birth certificate.

He would be required to present a BC to obtain a passport.

I think though the rules were a little different back then for children under a certain age.

No, and no. The English word 'infant' has always been synonymous with 'baby'. This is at least true of American usage over the course of our history.

The word 'child' may have once been used as you suggest, but not the word, 'infant'.

Yes, but his BMI has changed. He was chubby as a child, and he's guant as an adult, so his ears would look different -- the proportion is different.

Saw this while searching various stories on the internet. Claim by CNN is it is his birth certificate. ?

I’m sure nothing is that simple or we wouldn’t have the continuing stories, but what about this?

I had to show my BC to get my CO driver’s license after living in another state for three years. That was after getting my learner’s permit, first driver’s license and subsequent renewals in CO for forty years. You would think CO could trust their own database that went back forty years.

Primary Evidence of U.S. Citizenship (One of the following):
Previously issued, undamaged U.S. Passport
Certified birth certificate issued by the city, county or state*
Consular Report of Birth Abroad or Certification of Birth
Naturalization Certificate
Certificate of Citizenship

*A certified birth certificate has a registrar’s raised, embossed, impressed or multicolored seal, registrar’s signature, and the date the certificate was filed with the registrar’s office, which must be within 1 year of your birth. Please note, some short (abstract) versions of birth certificates may not be acceptable for passport purposes.

NOTE: If you do not have primary evidence of U.S. citizenship or your U.S. birth certificate does not meet the requirements, please see Secondary Evidence of U.S. Citizenship.

That is the same old phony Certificate of Live Birth (not a BC) that the WH and some blog put out a long time ago. Been debunked by several document experts.

BUT a passport can be issued without a birth certificate.

Oh really?
I am curious as to what the circumstances are for the issuance of a passport w/out a birth certificate. Especially in regards to if these "special circumstances" might apply to an under 18 yr old child/person?
In particular to the person under discussion here - Barry/Barrack/Baraq Hussein Soetoro/Obama or what ever name is appropriate?

Any elaboration as to how this might be accomplished?

Sandra Ramsey Lines, a Certified Document Examiner, formerly with the FBI, affirmed that the COLB (that CNN is misrepresenting as a Birth Certificate) could not be authenticated a fake or genuine.

Scanned documents can’t be, only original documents can and since Obama will not produce even the sheet of paper scanned onto his own website, it is impossible to authenticate anything. She did however say from an examination of the image there appears to be photo-shopping and other attempts at distortion going on.

She signed an affidavit for Alan Keyes cases and Major Cook’s case and I believe otherse. Her affidavit can be read at:

Still in use today - the legal definition of infant is different than how we use it in common English

infancy n. although the popular use of the word means the early years of age up to seven, in law, it is under-age or minority. Historically this meant under 21 years, but statutes adopted in almost all states end minority and infancy at 18. An “infant” cannot file a lawsuit without a “guardian ad litem” (one purpose guardian) acting for him/her, in most states cannot marry without parental permission, and cannot enter into a contract that is enforceable during his/her minority. She is one of them and that statement says a lot even if she can't say with certainty what the source document, if any, is.
