A defense fund was set up privately (with legal private contributions) and the moniker "Official" was added at the webpage to differentiate it from any others that may or may not have been scams. IIRC, the fund has never been tapped and the money will be or is being reimbursed to the donors.

This coincidentally becomes an issue within a week of a $20 billion fund being extorted without any legal authority from BP, one of Obama's biggest corporate sugar daddies. Sorry, I've got no outrage for the one but plenty for the other.
