Can DUI affect next job application

Hello all, Friday I was "downsized" from my position in Sales for an automotive supplier. I have a few leads that I feel I am well qualified for. My concern is a ercent drinking and driving conviction. Was a first time offense but still an offense. It was pleaded down to a four point ticket. What is your opinion of having a drinking convicion on your record when applying for medium level Managment positions?

It depends on the position. Most companies (like mine) only check for felony type convictions. If you are in Sales and will drive a company vehicle or have to be covered by the companies insurance to drive your own vehicle in pursuit of business then you have a problem. On the other hand the Government is hiring...

as someone who hires, if i found out and it seemed you were still in denial about your drinking, i wouldnt hire. if you were up front and talked about how you had stopped drinking, got sober, been to AA or something like that, it would be a plus.

in case you dont know, if you have a DUI, you, be definition, have “a drinking problem”. if you dont know that, then you got some work to do.

just guessing but its probably not the first time you got shmasted and drove. ever think about the fact that you might have killed someone?

Let them know at the end of the job interview when they ask ‘do you have any other questions’. Go prepared with what to say. Tell them you made a mistake you will never ever repeat and that you are willing to live with its consequences. If you are lucky you can sway a mind or two.

No, she put herself into that position. She committed an action. She didn’t “have something happen to her.”

I see we still have some conservatives left on FR. Good call on this one.

It sounds like you have a non-criminal violation or lowest level misdemeanor (4 point ticket, the kind you’d get for speeding or running a stop light) on your record. I am not a lawyer but I don’t think you have to disclose what you were arrested for or even that you were arrested—only what you have been convicted for.

Answer the question honestly, but give as little information as you can get by with. If the application only asks for "convictions", I would only list what you plead down to. Some applications say to exclude traffic violations, if so, I wouldn't put anything down. Also some say go back a certain amount of time 5 or 7 years, if you are out of that window don't put anything. FYI, most employers are willing to listen and a conviction doesn't automatically exclude you as long as the rest of your work record is spotless. If they don't bring it up, I wouldn't either.

I know from personal experience, back in my wild and crazy college days, I plead no contest to a battery and a destruction of property charge to some college hi-jink that got out of hand and involved a good amount of alcohol. Three years latter I was up for a job that required a federal security clearance. I figured I didn't stand a chance, but was honest on the form, they asked a few general questions about the charges in an interview, then gave me my clearance.

No company will hire you for a job driving a company vehicle with a DUI.

That's not always true. My brother has had two DUIs, one in '96 and again in '02. The last one cost him his job driving a cement mixer and landed him in jail for a month. He regained his CDL and today drives one of those monster-huge dump trucks in a moly mine in Colorado.

Apparently, his qualifications and experience trumped his DUI convictions.

This being said, I believe he was the exception to the rule and I remind him regularly how damn lucky he was to land that job and he'd better not screw it up!

You say it was pleaded down to a four-point ticket. That is most likely the offense that will show on your driving record. But you should check it out.

My employer does background checks and one of the items they look into is the applicant's driving record.

If the driving record shows DUI when the company places him on insurance the insurance company will notify the company of the record. That is why you need to be up front about things like this- if the company is willing to deal with the issue they will not want to find out about it from the insurance company after hiring.

Not necessarily. Probably depends on the time frame that passes between the DUI and the job though. There are people with some types of security clearance that have a DUI on their record.

If it was a DUI conviction, it is not a crime, it is a violation. MV records are not public records. If an employer wants your driving record, they will ask for you to sign a release. Court records are public records and no release is needed.

If the position requires you drive company vehicles, then yes, you will have a problem. On the other hand, companies cannot ask you anything that doesn’t pertain directly to your ability to fill out the job, and can only ask if you have ever been convicted of a felony.

Where I work they do, and at every company I’m aware of in the same industry (insurance) - and my employer runs a background check on every candidate they’re seriously considering, which at minimum includes a search of public records.

Maybe at one time, but not anymore. As I mentioned in my post, I was given a "secret" clearance with two recent misdemeanor convictions. It may be different with the "higher" clearances. I was told the requirements to get a security clearance were really loosened during the Clinton administration and there is not much that automatically disqualifies you anymore as long as you are honest on your SF-76.

Something to remember is, it's not the arrest, it's the disposition of the conviction that matters. You have the court papers that spell out the final finding of the court, correct? Now get a copy of your driving record and see where it now stands. You may not have any drama to worry about.
