That’s ridiculous. They’re just looking for a scapegoat.

Unless he was capable of staying awake 24/7 and watching every move she made, there is no way he could have prevented her from killing the child if she was really determined to.

All it would take is a couple minutes. She could have done it when he was in the shower or mowing the lawn or just using the bathroom.

What do they expect of him? Omniscience?

Before everyone goes crazy in defense of this man, no one here has the information on what the situation REALLY was.
It is possible that the woman had just been released or was going into a psychiatric facility and the father agreed to monitor his wife continuosly unti they could get the woman treatment, or until they were sure her medication was working.

In the Yates case, the family was NOT supportive of her continuing to get treatment and was anti -medication. Many times, the family will not cooperate with the best intentioned medical treatment.

I think there is WAY more to this story.

FORT WORTH -- State District Judge Wayne Salvant sentenced a Mansfield man to 10 years in prison on Thursday for leaving his 1-year-old son alone with his mentally ill wife, who drowned the boy because she believed that he was the Antichrist. .....

On Jan. 29, a Tarrant County jury took less than 30 minutes to convict Maxon of abandoning his son, Alex, and placing him in imminent danger of death or serious injury. Despite warnings from mental health professionals, Maxon left his wife, Valeria Maxon, alone with the infant for about 11/2 hours on June 30, 2006.

Clearly concerned about the speed of the jury's verdict, Maxon's attorney, Jack Strickland, asked Salvant to assess Maxon's punishment. He had previously asked the jury to decide the sentence....

The judge said he was disturbed that Maxon still doesn't believe that he is responsible for his son's death. "You said over and over that you didn't do anything wrong," Salvant said. "I want you to understand that you did. I hope that someday you realize the seriousness of your case and what your actions caused."

Wow. Just dayum. Do the courts even begin to realize how much of normal human female behavior is indistinguishable from crazy? How on Earth are all men expected to be capable of policing women?

Some background I found:

“...psychologists testified that they believe that Michael
Maxon exacerbated his wife’s mental condition. Police found a tape in the
house in which Michael Maxon repeatedly chants negative statements. He told
police he played it for his wife as “therapy” when she was extremely depressed.

“It’s all so deliciously tragic,” Maxon says over and over in a singsong
voice. “It’s all my fault. I really screwed up. I’m the mother; no one
understands me. If I’m miserable, the whole world has to be miserable.
Nobody understands. Our son is riding the short bus. It’s all my fault.”

It appears that Mr. Maxon elected to NOT have the jury sentence him, and instead asked for the judge to do it, probably because the tape reveals that he played a part in exacerbating his wife’s mental deterioration.

Were the facts known, it might be seen that the judge was more lenient in sentencing than 12 angry jurors would have been.
(oh...and the judge is a Republican, Marine, and appointed by Bush...)

Two issues. The husband didn't kill the baby, and probably believed there was no imminent threat. And, when are people held responsible for not reading another person's mind?

Is there any precedent for this type of law? A case dealing with the issue decided before say 1920.

No point in speculating about this case. The deed was done and it will happen with increasing frequency during the many centuries to come.
