That's a tough question. First, let me say that I think this guy's lawsuit is nonsense. Assuming that Barry was born in the US, and there's really no legitimate proof that he wasn't, then I think he's natural born. That's been the consensus in this country for a long time, and even if that consensus is different than the framers intended (I'm not certain it's not), it's now too late in the day to change things.

Second, I'm not sure that it sets a good precedent for the Supreme Court to be getting involved in elections like this. I think it was probably a mistake to have taken the Bush/Gore case, and it would be a mistake to take this one. We have a political process and, if necessary, this issue can be resolved through the political process. Along those lines, I think a decision like that would really undermine people's faith not only in the Supreme Court, but also in the political process as a whole, particularly considering Obama's fairly comfortable victory. I don't think that's healthy for the nation.

Third, dinging Obama would get us Biden. I'm not sure that's much of an improvement.

On the other hand, I really don't like Obama, so maybe....

..and just to add to what you said, the Constitution even has a provision for a case that a candidate is found ineligible, the 20th Amendment.

If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.

There was the consideration during the amendment processes that we may have a case where a person was 'elected' but failed to qualify. In other words, something like what may be happening here wasn't out of the realm of possibility.

No, that's exactly what they are doing. That is the practical effect of what's happening, and all the semantics in the world won't change that.

I mean this absolutely seriously and with a straight face: pray for aliens to kidnap him. It's more likely.

What in the world you are talking about? If the SCOTUS did not grant cert, then it is going to be along with the rest of the thrown out cases on Monday. Of course, we don’t know for sure whether or not the PDF is going to be updated or not.

As a former Commissioned Officer I would advise that any suit should best be brought by an Officer who is no longer on active duty and subject to the UCMJ, but WHO IS subject to recall. Someone on active duty, even exercising their Constitutional Rights, would be subject to reprisals. Someone who is no longer on active duty, but subject to recall, would not be as vulnerable, yet should have “standing” to bring suit.

What you quoted almost gives it structure. Sounds like the time for discovery about him being eligible or not is between the time the electors vote and the inauguration.

Of course, even after the inauguration, if he is proved to be ineligible, he’s outa there in a NY minute.

When you go to the Supreme Court Docket page, you have to type in a docket number. How do you find out a docket number if you don’t know it already?

It’s not a law, but a legal precedent interpreting “natural born citizen”.... and to be honest I’ve been reading so much on this the past few days I don’t recall the source, probably Defronio’s website. But it’s not clear-cut, the idea is that the Court could take this case and that is something they would need to define.

I talked to the SCOTUS clerk. It went to conference, a decision was made, and no information concerning that decision will be released until Monday.

I’m not saying he’s eligble or he’s not. Except in one post, I haven’t passed on the merits of the case.

I’m saying that the Supreme Court will not weigh in on this issue because of the absurdly huge ramifications involved, particularly when there is a political resolution to the problem, if one even exists.

Ron Polarik has not shown up for TV interviews because he admits himself that isn't his name. Someone using the pseudonym Polarik showed up on interviews. Polarik says he signed affidavits, so, where are they? Are we putting too much faith in someone of whom, we don't even know his real name and admits he is providing a false name?

He’s met the standard. You have not.

I'm not making charges, I'm asking for evidence. I am not asking to 'meet a standard', I am asking that a person handing me what that person claims to be proof, meet the standard of proving he is an expert. If he is exactly who he is, credential wise, then he will have to, at a point, take this before a court and prove his expertise at that time. Why not now. We are asking the same of Bambi.

If you think asking these questions is libel, click abuse and have me banned.
