I think it would be horrible to keep Dannielynn in limbo until she is old enough to read all the horrible things for her self.

Birkhead free to travel with Anna Nicole’s baby

NASSAU (Reuters) - The custody fight over the baby daughter of late Playboy Playmate and tabloid star Anna Nicole Smith appeared to draw closer to an end on Wednesday after another court hearing in the Bahamas.
A source close to the hearing, which was held behind closed-doors, said Larry Birkhead, a Los Angeles photographer and former boyfriend of Anna Nicole, won approval to travel to the United States with 7-month-old Dannielynn.
Court-ordered DNA tests earlier this month proved Birkhead to be the father of the baby, who could one day be worth a fortune if Smith’s estate wins a decades-long battle to inherit from her late oil tycoon husband J. Howard Marshall.
Despite the tests, Birkhead has been locked in a custody battle with Smith’s mother, Virgie Arthur.
Smith’s death from an accidental drug overdose on February 8 in Florida sparked a media frenzy, as well as a fight over her remains and then over rights to the guardianship of Dannielynn.
The only condition set by the court, in exchange for granting Birkhead freedom to travel with Dannielynn, was that he return to Nassau with the baby for another formal custody hearing on June 8, the source said.
Birkhead declined to comment on the specifics of Wednesday’s 30-minute hearing, due to limitations imposed by Bahamian court rules
He told reporters outside the court that he hoped to be leaving with Dannielynn soon, however.
“I guess all I can say really is that it was a good day for me in court,” he said.

Birkhead, Dannielynn: Homeward Bound

After more than two months spent battling for custody in the Bahamas, Larry Birkhead is finally heading home. And he’s bringing his daughter with him.
In a typically closed-door hearing in Nassau Wednesday, a Bahamian judge gave the go-ahead for Birkhead to take Dannielynn out of the island nation as early as this weekend, but reportedly stopped short of granting him full custody of his child with the late Anna Nicole Smith.
The move comes despite various legal roadblocks set up by the child’s grandmother, Virgie Arthur, who is seeking some type of custody our guaranteed visitation rights for the seven-month-old girl.
Per Bahamian law, none of the parties involved in the matter was allowed to speak on what transpired inside the courtroom. However, upon leaving the hearing, Birkhead hinted that he was not long for the island.
“I can’t say much, but a smile’s worth a thousand words...right,” the photographer said.
The beaming papa got a little more specific with Access Hollywood, which asked whether he planned on remaining in the country through the weekend.
“No, I won’t be here,” he replied. “Take that any way you want.”
Before Birkhead and his daughter will be allowed to hightail it back to the States, the child’s birth certificate must be modified to reflect the change in her official paternity status. The document currently lists Howard K. Stern as the father, and Birkhead will be required to make sure an amended certificate is filed at the Bahamian General Registry Office.
Once the revision is made, a process that should go smoothly thanks to Stern’s newfound show of support in all things Birkhead, the 34-year-old Kentucky native will then be able to request a passport for the youngster.
The entire paperwork process is expected to take no more than a day and, per Access, a passport in the name “Dannielynn Birkhead” is expected to be processed by Thursday morning.
While Birkhead has previously touted the swank new nursery installed at his townhouse in Burbank, California, Star claims the father-daughter duo may instead be bound for Louisville, Kentucky, to board with Birkhead’s immediate family. (There have also been reports that one of Birkhead’s family members is ailing, and that is his motive for heading back to his old stomping grounds.)
Although Birkhead has been given the okay to book a flight out of the island nation, he must make it a return ticket. He reportedly had to agree to return to Nassau on June for what should be the formal resolution of the girl’s custody.
At that hearing, Arthur will be able to make her final appeal for partial custody of the child.
Arthur, who refused to speak to reporters before and after today’s proceedings, is seeking sole guardianship in the event that Birkhead died while Dannielynn is still a minor, as well as clearly delineated visitation rights for the girl, according to TMZ.
Wednesday’s hearing caps an action-packed week in Birkhead-related matters. On Monday, a judge in Los Angeles formally signed off on an order releasing Debra Opri as Birkhead’s attorney in the paternity case, which was originally filed in California weeks after Dannielynn’s Sept. 7 birth.
There was no formal reason given for Opri and Birkhead’s split—some reports blamed a disagreement over strategy—but both parties said the parting was amicable. (We’re reserving judgment until we see whether Birkhead makes good on Opri’s $600,000 bill.)
“It was simply time for me to go,” Opri said after the hearing. “I’m proud of this case. People don’t realize how many lives were touched by this case.”

I don’t think she’s trying to get full custody which is implied. I think she’s trying to get the guardianship which is different than custody and no offense but often times I wonder how sober O’Quinn is. I will say this and I’ve said this earlier...I truly believe that Virgie’s lawyers are railroading her and using her fears to push this. Virgie was ecstatic when Larry was found to be Dannielynn’s father and after she made her speech it was her lawyer Debra Rose that began talking about guardianship and such. As for her trying to get Larry not to be able to leave..I think she shouldn’t be so worried about him not coming back but she can appeal it all she want just like she did with Anna’s burial. Her trying to get him to stay doesn’t make me dislike her any more or less but I think it’s not a very good idea and I woudln’t be doing it. But this may be her last shot. I think Virgie is caught between her lawyers and wanting to do what’s best for Anna and Daniel. I truly believe she is dealing with some serious guilt and IYAM (I had to google that..LOL)...I think she really truly believes that Larry will end up dead. I just find that such an odd request to make.
Speaking of the court system it would personally drive me nuts. Especially being in Virgie and Larry’s predicament. In a foreign country and all. Ohhh and on perez’ site some viewer of the VIEW said that Alec Baldwin taped a segment and he was trying to say how much he loved his daughter and would wake her up by getting in bed with her and stroking her hair. Total freak out moment!!!!

Dannielynn to Leave the Bahamas?

Larry Birkhead was back in court today to discuss travel plans for Dannielynn so they can visit the States.
ANNA NICOLE SMITH’s baby daughter, DANNIELYNN, could leave the Bahamas as early as this week.
Her biological father, LARRY BIRKHEAD, along with Anna’s partner, HOWARD K. STERN, and Anna’s estranged mother, VIRGIE ARTHUR, met in a Bahamian courtroom today so that Larry could present Dannielynn’s travel plans.
ET caught up with Larry as he was leaving the courtroom, and he told us that it was a happy day in court for him. He reported that Dannielynn smiles at him, he feeds her all the time, and that she is now starting to recognize him.
Howard also talked to us outside the court, telling us that Larry and Dannielynn are bonding and doing well and that Larry is doing a great job.
Larry could be on the move soon, because of an illness in his family.
“As soon as he finds out if he can take Dannielynn home, he is going to leave and go to Kentucky to be with his family,” OK! magazine’s Society Editor JENNIFER BIRN tells ET. “His father just got out of the hospital. He was really sick, and now that he’s been released, Larry wants to spend time with his family.”
In a new interview for this week’s issue, on newsstands Thursday, Larry opens up about his former flame’s drug use.
“Larry spoke to Anna about the drugs she was taking,” Jennifer reveals. “She insisted she wasn’t an addict, [and that] she needed all the drugs she was taking.”
He also talks about his relationship with Anna’s late son, DANIEL. He tells OK! that near the end of his life, Daniel was living in the fast lane.
“He might have started hanging out with the wrong group of kids when he went to college,” Larry tells the magazine. “He was 20 when he went to college so I think it was too much too quick.”
Larry also says he’d like to get married someday, but adds, “It’s going to be difficult. I don’t want to compare people to the mother of my child.”

Birkhead Free to Leave with Baby

Larry Birkhead can leave the Bahamas with Dannielynn, at least for now.
A judge has just cleared the path for Birkhead to go to United States with one string — he must return with Dannielynn for the full custody hearing in June.
Sources tell TMZ that Virgie Arthur objected to the ruling and could appeal. But that appeal may be too late. We’re told Birkhead wants out in the next few days.
And there’s this — Arthur’s lawyer protested there were leaks in the case, and pulled out several TMZ stories that he said were posted “minutes” after the various hearings ended.

Maybe Larry already found one at the numerous Toys R Us he has visited. I *hope* so! Otherwise, I might have to make a suggestion for him.
At this point, it seems like the ONLY shred of Anna that HKS can ‘hold onto’ is his “Named Executor” status in the will. Certainly his ability to stay in the Horizons house is based on that role, as well as his ability to gain ownership of the other house Anna purchased in the Bahamas. Knowing that, I have to wonder if HKS’s decision NOT to fight for custody of DL doesn’t have something to do with Larry making a deal with him. I will be anxious to see how the Will is probated in CA. Maybe Larry agreed to let HKS probate the 2001 Will (substituting Dannielynn for Daniel), which would allow HKS to hang onto his Executor status. I still hope the Will will be thrown out, but maybe Larry (as Dannielynn’s father and guardian) can testify in Probate Court that he has no problem with the Will as long as Dannielynn’s name is substituted for Daniel’s name??? That seems a little far-fetched, but I don’t know very much about Probate proceedings.
Another thing that made me think Larry could have agreed to a deal allowing HKS to remain as Executor, is HKS’s comment that he has offered to let Larry and Dannielynn live in Anna’s Studio City home. In exchange for that, maybe Larry will ‘let’ HKS live in Anna’s other Bahamian house IF and WHEN HKS is evicted from Horizons!
Just a thought...although it’s just as likely that Larry may have ‘agreed’ to certain things with HKS while he was trying to get DL in the Bahamas, but he (Larry) has no intention to honor those agreements once he gets DL safely to the U.S.!

IMO this would single her out as different should Larry marry and have more children. She needs to be raised in a similar manner as Athena (Chirstina Onasis' daughter).. in a family where she is treated like everyone else in the family and not as someone special. If she has to trot off to grannies house for holidays that singles her out....
There is actually a lot of similarities in Athena Rossuel (Onasis) and Dannielynn... both were very young when a drugie, messed up, mom died suddenly and both had fathers wanting custody of them before the parent died and if I remember right the Onassis attorneys gave Therry a lot of grief over that child.
I think he did make a deal and that’s leading to what’s been going on with Virgie. I think when this is all over with we’re going to be quite surprised at what lengths Larry went to get his child. I’m still a Birkie but I’m also a realist. This is an old TMZ story. This is why I root for Larry and Dannielynn.

Anna Nicole and Larry BirkheadConvinced that he is the real father of Anna Nicole’s newborn daughter, a desperate Larry Birkhead has created an Internet tribute to the child. The words “Dannielynn, born September 7, ‘I Can Only Imagine...’ love Daddy” grace the front page of LarryBirkhead.net while the song “I Can Only Imagine” by MercyMe plays in background. The popular Christian song, which describes what one would experience upon meeting Jesus in heaven, asks the question “What it will be like when I walk by your side?”
We can only guess that Larry is referring to the fact that Anna Nicole Smith and her daughter are residents of the Bahamas and living with a man claiming to be the child’s real father. A source close to Birkhead will only tell TMZ “the lyrics say it all.”
Birkhead filed court papers in Los Angeles recently to challenge the paternity of the little girl.
TMZ recently obtained a copy of the official birth certificate for Dannielynn. On the document Howard K. Stern is listed as the father.
I wonder if Larry has a “theme” for DL’s nursery? Guys don’t think that way though.
He’s an Attorney, been on Los Angeles news stations doing legal reports for years before he got his national gigs... never heard anything about him being gay.
