Former Nannies For Smiths Baby Consider Lawsuit

Two former nannies who reportedly worked in the Eastern Road home where the late American celebrity Anna Nicole Smith lived are considering suing a popular Internet site for publishing an un-filed affidavit bearing their names.
Nadine Alexie, 37, and Quethlie Alexis, 33, said they fear for their lives because misinformation was printed in the affidavit and was circulated on the worldwide web.
The womens attorney said although no suit has been filed against TMZ.Com, nothing is impossible at this point.
The former nannies were at Comfort Suites Resort on Paradise Island Wednesday to give “Controversy TV” an interview on what they claimed transpired in the home during their employment there.
The women told reporters they agreed to grant the interview so that the truth may be told and justice could prevail.
They also expressed interest in the health of Dannielynn, Ms. Smiths seven-month old daughter.
The women are also scheduled to appear as witnesses in the coroners inquest into Daniels death.
The local media were allowed to sit in on the interview, but all foreign reporters were asked to leave.
Ms. Alexis claimed she was hired on September 4 and was employed at Ms. Smiths residence up until November 29. Mrs. Alexie claimed she was hired from September 17 and was there until December 14.
Ms. Alexis claimed Ms. Smith terminated her over a broken part in the washing machine, and Mrs. Alexie claimed Howard Stern, Ms. Smiths companion, terminated her after she made inquiries to a medical doctor about the prescription drugs Ms. Smith was taking.
During the interview Wednesday, both women expressed relief that photographer Larry Birkhead had been named Dannielynns father as they claimed that the safety of the baby girl was in jeopardy.
The women said they were not surprised that Mr. Birkhead was the father because Ms. Smith had told them that the father was her boyfriend in the United States and not Mr. Stern.
Ms. Alexis said she was often concerned about the babys health because Ms. Smith instructed her to underfeed the baby so that she could grow up to be a slim, sexy movie star.
“I used to hide food for the baby because Anna wanted us to give the baby only one and a half once of milk and the doctor instructed us to give her more food. So when Anna made the bottle with soy milk I would throw it out and make a proper bottle,” Ms. Alexis said.
The former nannies also claimed that Dannielynn suffered from colic, but was given an overdose of medication to keep her from crying.
“When I arrived at the house one day Dannielynn was sleeping and this was from 10am to around 2pm so I became very concerned because she did not wake up for a feeding,” Mrs. Alexie said.
She said she was worried because she knew this was a result of Dannielynn being given too much medication.
The women also alleged that Ms. Smiths relationship with Mr. Stern was not how in appeared in front of cameras.
They said Ms. Smith blamed Mr. Stern for her sons death.
The women said they believe Mr. Birkhead will protect the babys best interest, but they said they hope that the childs maternal grandmother, Virgie Arthur, is allowed to play a role in the childs life.

Lawyer Says Paternity May End House Battle

Larry Birkheads confirmation as the father of Anna Nicole Smiths infant daughter Dannielynn paves the way for an end to the legal standoff centred on the Eastern Road mansion called Horizons, according to the lawyer for one claimant to the houses title.
Godfrey Pro Pinder told the Journal that his client, Ms. Smiths ex-lover G. Ben Thompson, would “work with” Mr. Birkhead.
He has been locked in a dispute with lawyers for Howard K. Stern, Ms. Smiths live-in lawyer, over who owns the residence where Ms. Smith and Mr. Stern lived with Dannielynn until Ms. Smiths sudden death in February.
Mr. Stern and Dannielynn still live at Horizons.
Mr. Thompson claims he owns the home, since Ms. Smith never fulfilled the terms under which he supposedly turned it over to her, and Mr. Stern and lawyers for Ms. Smiths estate support Ms. Smiths claim the house was a gift.
Mr. Pinder said that the substantiation of Mr. Birkheads paternity claim adds a new dimension to the wrangling over the house.
“I believe that he (Mr. Birkhead) would also get temporary custody. If he gets temporary custody then he should replace Howard K. Stern in the house. You dont need to have two fathers in the house,” Mr. Pinder said.
“We shall invite Howard out of the house, and leave Larry in. Well work with Larry. Larry knows who the owner is; hell eventually probably do the right thing and turn it back over to us.”
However, insiders in the housing case say that is a difficult call to make.
The property is the subject of an injunction. Supreme Court Senior Justice Anita Allen has ordered that nothing further be done with regard to the property until further notice.
And the Journal understands that the estate of the late Playboy pinup must be probated before the property can be dealt with definitively. Ms. Smiths will may have to be probated in California, and then resealed in The Bahamas a process that is likely to take months, if not longer.
Mr. Birkhead was confirmed as the childs father on Tuesday when DNA expert Dr. Michael Baird disclosed in the Bahamas Supreme Court that the DNA tests showed Mr. Birkhead was 99.9999 percent likely to be Dannielynns father.
The determination of paternity is the first milestone in the custody proceedings. Next up, the court will hear a claim from Ms. Smiths mother Virgie Arthur on Friday. Mrs. Arthur intends to press her claim for guardianship and custody of Dannielynn, although her lawyer Deborah Rose may have indicated some wiggle room on Tuesday.
“We are scheduled to be back before the court on Friday [to argue Mrs. Arthurs claim for custody and guardianship], but as we said, were looking forward to working with Larry and hopefully we can come to a position thats in Dannielynns best interests,” Ms. Rose said.
Sources close to the case say that while it is possible that Messrs. Stern and Birkhead may have made an arrangement with regard to both custody of the child and the disposition of the Horizons residence, it is unlikely that such a deal has been struck with Mrs. Arthur.

Heh, well this makes sense. Sounds like Howard is choosing the lesser of two evils. It makes sense that he will go with ambiguous evidence, like, how can they prove he spiked Daniel's drink, when it seems obvious from witnesses' (and Wecht's) report that Daniel may have been indulging in self-medication.
The strategy would be- if he escaped any responsibility in Daniel's death, then he doesn't have to worry about any possible inquest into Anna's death. It serves to solidify his rep as an innocent guy.
Exactly! I have a feeling Moe is getting his book ‘information’ from HKS. Therefore, Moe is NOT giving HKS money bc they are such good friends, he is just giving HKS his part of the proceeds from the advance.
This way HKS gets ‘his’ story out there without having to deal with the backlash and criticism he would get for writing his own book! I wonder how quick Big Moe’s (and HKS’s) book will hit the newsstands!

Local DNA Doctor Talks About Anna Nicole Case

The local DNA doctor who determined the father of Anna Nicole Smith’s baby is talking about the case Thursday night.
Dr. Michael Baird runs the DNA Diagnostics Center in Fairfield. Now that he’s back from the Bahamas and the gag order’s lifted, he can share his experience with the rest of us.
“All around me is media craziness, the paparazzi, in Nassau, tourists off the cruise ships with their cell phones and their cameras it’s pretty nuts,” says Dr. Michael Baird. “You go to the courthouse down in the Bahamas, which is a closed courtroom and very civil and quiet in the courtroom and everything’s addressed logically. Then you go outside and it’s crazy.”
Baird has been doing DNA testing around the world 25 years and he says this is probably the biggest paternity case ever.
He took cheek swabs from Dannielynn, Anna Nicole Smith’s daughter, at a pediatrician’s office in the Bahamas.
“I had my four swabs to do the collection I went over and collected two from each side. She was cuddly. She was drooly. Looked like a typical six-and-a-half-month-old baby to me,” says Baird.
He then took samples from Larry Birkhead’s cheek. The coroner had already taken a sample from Anna Nicole’s body.
“I’m trying to treat this like any other case but clearly it’s far beyond any other case. A, normally I don’t do the collection. B, I don’t transport them from one point to another,” says Baird.
Baird brought the samples from the three back to the DNA Diagnostics Center lab in Fairfield where the cells were broken down and analyzed. Baird says he knew Larry Birkhead was the father two weeks before the rest of us found out.
“I think that was what was most surprising to people in the media. How can you keep this secret. Well, there were only three of us who knew and we took our responsibility seriously,” says Baird.
Baird says the results are 99.99999 percent accurate. “That means Larry Birkhead is 11 million, 515 thousand, 619 times more likely to be the biological father than [...] your camera man,” says Baird.
Howard K. Stern still has custody of Dannielynn, but that’s expected to change any day now. Baird says he’ll continue to follow the Anna Nicole saga but not as closely since he’s no longer directly part of it.

LawFuel - An assistant professor of law at George Mason University believes the Anna Nicole Smith’s baby Danielynn may not be a half-billion dollar baby at all and - indeed - may be worth very little indeed.
Reported in the National Ledger, Horace Cooper wrote: “Anna Nicole Smiths legal claims on J. Howard Marshalls estate were always tenuous. And once the courts act, they will likely extinguish the claim altogether. That means Dannielynn is more likely to be saddled with legal bills and other debt from litigation associated with her mothers estate than shes likely to inherit any portion of Marshalls estate.”

“Custody for a grandparent? I’ve never heard of (that) when there is a fit parent that’s totally capable. I mean it’s like if that is what her attorneys are saying is her position then maybe my parents need to come for custody too. It just doesn’t make sense.”
Surely LB understands this is just strategy. She’s got to ask for more than she expects to get and keep up the request for custody just in case HKS decides at any given moment to do a reversal and fight LB on custody, which he WILL do should Virgie and Larry agree to more than what HKS wants Vergie to have. It’s what Anna would have wanted, blah, blah, blah. At some point, however, IMO the COURT is going to have to determine what, if any, standing HKS has/no longer has so that LB and VA can work out visitation without threats from HKS.
