Anna Nicole’s lawyer to back Birkhead
A Bahamian lawyer for Anna Nicole Smith’s estate says he will support giving full custody of the Playboy Playmate’s baby daughter to the girl’s father, Larry Birkhead.
Lawyer Wayne Munroe said Smith’s companion and the executor of her will, Howard Stern, instructed him to resist any custody claim made by Smith’s mother, Virgie Arthur, who was estranged from her daughter at the time the reality TV star collapsed and died in February in Florida.
The new legal strategy makes allies of Birkhead and Stern, who feuded over paternity until a DNA test revealed that Birkhead is the father of the girl, Dannielynn.
“It has the effect of making my enemy my friend in this case,” Munroe told The Associated Press.
During a hearing on Friday a judge is expected to discuss who will raise seven-month-old Dannielynn.
Stern, who has been caring for the baby since Smith’s death, said he will not try to stop Birkhead from taking the baby to California.
Arthur has not abandoned her quest for custody. Her lawyer indicated that she might seek joint custody of the girl she initially wanted to take home to Texas.
Arthur, who met Dannielynn for the first time after Smith’s death, would have difficulty winning even partial custody because of her estrangement from her daughter, according to Joshua Forman, a family law lawyer in New York.
Still, Birkhead may want to reach a visitation agreement with Arthur to discourage her from pursuing further legal action in US or Bahamian courts, said William Hilton, a California-based lawyer who specialises in international custody disputes.
“If I were the dad here, I would probably negotiate with the grandparent and get some contact time,” Hilton said from his office in Santa Clara, California.
“It seems to me they’re in a position where the grandparent, Stern and the natural father could all get together and work out an arrangement. I suspect if they did that ... that might satisfy the Bahamian court.”
Birkhead, a 34-year-old photographer, visited Dannielynn several hours after the announcement of the DNA test results, feeding her apple sauce with some coaching from Stern, Entertainment Tonight reported.
The two men have discussed a possible transition period during which each would spend time with the baby, according to Stern’s lawyers.
Birkhead said he did not want another legal fight.
“We might go from one fight to another, but I’m hoping that’s not the case because, you know, there’s only one dad, and I have no problem with anyone that has good intentions being allowed to visit the baby and see the baby and be a part of the baby’s life,” he told NBC’s Today show from the Bahamas.
Munroe, the lawyer for Smith’s estate in the Bahamas, said the proof of Birkhead’s paternity should end the custody dispute.
“My understanding of the law is that parents have control over their children,” said Munroe, who also represents Smith’s interests in continuing litigation over ownership of the oceanfront home where she lived with Stern.
Separately, a judge held a status hearing in the inquest into the death of Smith’s 20-year-old son, Daniel, but adjourned the session without taking any action.
Another hearing was scheduled for the coming Tuesday in the Bahamian Coroner’s Court.
The inquest has been stalled by an appeal from Stern to submit a questionnaire to potential jurors.
Dannielynn Hope Marshall Stern was born in Nassau on September 7, only three days before Daniel died at his mother’s hospital bedside from a lethal combination of drugs.
Smith died in Florida on February 8, at the age of 39, also from a deadly mix of prescription drugs.
The baby could potentially inherit millions from the estate of Smith’s late husband, J Howard Marshall II.
The former model had been fighting the Texas oil tycoon’s family over his estimated $US500 million ($A606 million) fortune since his death in 1995, and that battle remains unresolved.
It remains unclear how much, if any, of the Marshall estate Dannielynn could obtain and whether her guardian would have any access to the money.

I have studied the court cases and have even read the entire Supreme Court Decisions (I have a law background and my sister is a State Supreme Court Justice and I have discussed this with her).
There is no doubt that Marshall did intend to provide for ANS in a trust WHILE HE WAS ALIVE. This is true and he did order it done ...however... Pierce was controlling Marshall’s attorneys and they were shown to be crooked dogs and they even joked about fooling the old man.
Had Marshall’s attorneys done what he wanted we wouldn’t be having this discussion because ANS would have no argument. But that didn’t happen and Pierce WAS sneaky and did try to keep his dad from squandering his millions on ANS! He even wrote checks that bounced for jewelry at one point!
The point is that the Supreme Court did determine that the 9th District erred when it said that the Texas Probate Court was the proper venue. Because the ISSUE was not the will or probate...it was that the promise of a gift that Pierce deprived ANS from was OUTSIDE of the will and probate and should have taken place while Marshall was alive. There was proof that Pierce did derail the attempts to get this done at every turn.
The video that has surfaced recently is decidely unhelpful for ANS’s argument but there is still evidence, ample evidence, that Marshall’s intention was to provide for her in a trust while alive. Pierce was busted at working diligently to STOP his father’s attorneys from doing what they were told to do...that is totally unethical in every way.
Now...some think that Pierce’s ends justified his means but it was the OLD MAN’s money and if he wanted to blow it on expensive ho’s isn’t that his business? Isn’t it his money?
Now, Pierce had cleverly tricked Pops into putting all of his assets and cash into trusts so he completely controlled his father’s money in his last years. Was that his father’s true wishes? Clearly, Pierce and his control of his father’s attorneys made it possible for him to completely manipulate and control the situation and...
THAT will be punished by the courts in a punitive award.

Someone and I can't find it yet - said maybe Anna had Multiple Peronality Disorder.....MPD.
That was my 2nd thought after viewing the mommie dearest video and thinking about Anna's childlike voice in the clown video.
(first thought was, like you, that she was drugged in both videos).
But she had a look of total hatred in her eyes and in her mouth/teeth - the snarl. Unlike anything seen in any of her other videos or appearances that I've seen of her all these weeks on this story (I didn't follow her life before this).
If anybody else remembers the comment about possible MPD for Anna - please let me know - still looking for it.

The "nice" Stern is a direct attempt to influence his image in the minds of the inquest jurors....nothing else.
Did ANS take drugs during pregnancy?

Moe - I have never once seen Methadone in the house during the 5 mos since Daniel died.
Moe - that was a staged picture. I've never once seen methadone in that house.
Moe - I've seen her take prescription drugs - she just had a c section.. I know she had a doctor that came over and prescribed meds - a Bahamian doctor.

Moe - I never saw anything wierd - never saw any abuse of prescription drugs. Whatever was prescribed to her she would take.

I think ANS had serious issues and possibly personality disorders that she self medicated with prescription drugs.
She was known to be “mean” and to go from being sweet and whispering baby talk to those in her good graces to being h@#$ on wheels when crossed.
This is one of the reasons that her drug addiction and drinking was not confronted. ANS jonesing for drugs was the EVIL Anna and the hate and snarling you saw on video was directed at whoever was between her and her needles and pills.
