Appeal expected on DNA in Anna Nicole baby case
NASSAU (Reuters) - Anna Nicole Smith's longtime lawyer and companion is appealing a judge's directive for a DNA swab test on the former Playboy Playmate's 6-month old daughter, the subject of a custody battle in the Bahamas, legal sources said on Wednesday.
But Court TV reported the mouth swab test had already been done and would be sent to a laboratory in Ohio.
The legal sources, who asked not to be identified, said lawyers for Howard K. Stern were drawing up papers to block Judge Stephen Isaacs' directive on Tuesday that a swab be taken from Dannielynn Hope Marshall Stern.
"It was hoped the appeal would be heard today but, the situation being what it is here in the Bahamas, it's unlikely it will be heard until next week," a source said. "I gather they are shooting for Monday."
The paternity lawsuit was brought in the Bahamas by Larry Birkhead, an ex-boyfriend of the billionaire's widow whose sudden death in Florida on February 8 touched off a custody battle for her daughter.
Birkhead, a Los Angeles photographer, said he is the father of the baby who is heir apparent to Smith's estate, which could be worth hundreds of millions of dollars if it wins a fight to inherit from Smith's late oil tycoon husband, J. Howard Marshall.
Stern, is listed as Dannielynn's father on her Bahamian birth certificate. Other men have also said they may be the child's biological father.

TMZ.com reports Howard K. Stern might have to start spending Anna Nicole Smith's money a lot sooner than he thought.
TMZ has learned that a corporation started by Anna Nicole Smith and handled by Stern -- owes more than $30,000 in back taxes and has been officially suspended by the California Franchise Tax Board from doing business.
According to records from the California Secretary of State, Hot Smoochie Lips Inc. hasn't filed a tax return with the State of California since its inception in 2002, and owes $28,945 in corporate taxes! Howard K. Stern is listed as the company's "registered agent." Smith was listed as the president. But that's not all ...
The Los Angeles County Tax Collector claims that Hot Smoochie Lips Inc. never forked over $8,920.54 in property taxes they owe on a Studio City home where Anna used to live.
On March 1, 2007, Hot Smoochie Lips, Inc. was put into suspended status by the FTB, which means they can't make any legal, financial or business transactions. It is unclear if any of Smiths other belongings, including cars, boats and other property are actually registered to Hot Smoochie Lips, Inc.
Howard K. Stern was named as executor of Anna's estate, which means that he may ultimately be the person responsible for cutting a check for Smith's debts.

Boy, I sure hope that Barth is his defense lawyer for the murder trial. She is so stupid!

In her own words, Anna talks about her pain at the death of her young son in an e-mail dated October 8, 2006.
"I just wish I could be going thru good times now," she writes. "I miss him. I want to die!"
Could this be one of the clues that police are looking for on Anna's personal computer, possibly revealing that the former Playboy centerfold was suicidal?
However, many have suspected foul play. Law enforcement sources tell ET that Anna's death seems suspicious, but they do not have enough evidence to convene a grand jury or to pursue criminal charges.
They tell us HOWARD K. STERN has cooperated with authorities and has given them permission to look at a computer which they are examining for suspicious keywords and phrases.
