You'd think a forensic pathologist who demands the big bucks would know the risks with meds, too.

I should say Perp can't vouch for the accuracy of 105 temperature if the information was provided by 'health care professionals' who treat fever with an ice bath, don't realize 105 temp is dangerous in adults and requires hospitalization, use a mirror to see if someone is breathing, refer to IV saline solution as 'water' and who don't call 911 immediately upon recognizing the critical condition of someone they're supposed to be 'watching'. . . the list goes on.

No confidence vote for ANY of these characters.

There's to be another court hearing Friday in the continuing saga over the late star-crossed celebrity Anna Nicole Smith.

It's in the Bahamas and it's a tussle over who gets custody of Smith's baby daughter, Dannielynn.

Several people claim to be the father. Lawyers for one of them, ex-boyfriend, Larry Birkhead, are asking for a DNA test. Birkhead, who says he's been putting a nursery together in California, plans to be there.

Another contender, Smith's latest companion Howard K. Stern, probably won't be. He remains in seclusion with the baby at Smith's seaside villa in the Bahamas.

Smith's estranged mother, Virgie Arthur, also wants custody.

Depending on how an inheritance case pans out, the baby could one day be worth millions.

Commentary: UPDATE: Resolving the legal mess Anna Nicole left behind

Today is being heralded as a day of reckoning in the late Anna Nicole Smith’s baby-Daddy drama. But, as was the case with everything in her life, today’s proceedings will be characterized far more by surreal fanfare than legal resolve.

In fact, the only moment of reckoning for parties to the Dannielynn-paternity and Horizons-ownership matters will probably come when they have to fight their way through rabid media scrums to enter and leave the Supreme Court. Because I suspect the legal jousting and posturing (amongst judges, lawyers and litigants) that have prolonged these matters thus far will conspire to extend them further still. And this, notwithstanding the fact that the paternity and ownership, respectively, could easily have been resolved months before Anna Nicole died if judges in The Bahamas had the temperament to exercise their authority more judiciously and decisively.

For example, when Larry Birkhead’s attorney’s filed papers in the Bahamian court months ago seeking enforcement of an order from a California court for Anna Nicole to provide DNA saliva samples from herself and Dannielynn to establish paternity, presiding Judge Stephen Isaacs should have ordered her to comply forthwith. And let me hasten to clarify that he should have done so not to genuflect to the California court; but rather to honour the letter and spirit of Bahamian law.

After all, Chapter 130 on the Status of Children provides, in part, that:

“Where circumstances exist that give rise to presumptions of paternity in respect of more than one father, no presumption shall be made as to paternity.”

This means that even though Howard K. Stern is presumed to be Dannielynn’s father - because he is allegedly designated as such on her birth certificate and cohabited with Anna Nicole for a statutorily-required period of time before her birth - that presumption was rendered moot by Birkhead’s application concerning this child’s paternity. And, even Stern’s lawyers would have to concede that Birkhead’s lawyers have presented enough circumstantial evidence in court to sustain a rebuttable case against Stern’s claim of paternity.

Therefore, Judge Isaacs had the authority (and duty) to order “blood tests” (or more advanced DNA tests) to determine paternity. And had he done so, he would have furthered the best interest of the child by resolving her paternity long before Anna Nicole died.

As it stands, the judge is enabling, albeit unwittingly, Stern’s (and Anna Nicole’s now posthumous) scheme to perpetrate a fraud not only on our honourable Court - by using it to shield his mercenary reasons for claiming paternity, but also against Birkhead (assuming he is the biological father) – by denying him the experience of sharing in the most precious moments of his daughter’s life. Therefore, I entreat Judge Isaacs to seize this opportunity to redeem Bahamian jurisprudence by ordering DNA tests today to finally establish paternity, without further ado.

(Then, of course, he can hear the more interesting matter concerning who gets custody of Dannielynn. And, notwithstanding cultural biases and legal precedents that favor mothers and grandmothers in custody cases, I submit that, under these circumstances, if Birkhead is determined to be the father, it would be in the best interest of the child to award him, not Anna Nicole’s estranged mother, Vergie Arthur, legal custody.)

Meanwhile, I am loath to bore you with too much commentary on the even more farcical Horizons dispute - between a squatting Stern and American real estate mogul G. Ben Thompson - over who is the legal and beneficial owner of this Bahamian property. Therefore I shall suffice to note that this case should also have been resolved months ago, and with even greater dispatch than the paternity case. In fact, but for the alleged machinations of a seemingly star-struck and love-lorn Bahamian minister of immigration (see Related Articles below), it would (and should) never have become a legal matter at all.

For the record, this dispute arises from the fact Anna Nicole took possession of Horizons to secure her permanent residency, but failed to honor contract terms to establish ownership. But her residency should never have been granted until she presented legal documents to prove that she had invested in real estate as required by law. And, under those circumstances, she would have been forced to resolve this matter to maintain her fugitive refuge from that California court order. Alas, once residency was granted, she had neither the incentive to honor her contractual obligations nor the compulsion to comply with the order. And so she squatted.

Nevertheless, since Mr Thompson is the purported title holder (and no other ownership interest has been registered that supersedes his), the Judge presiding over this case should have granted his application to evict freeloading Stern and Anna Nicole long before she died. Therefore, it would amount to an egregious perversion of justice if she fails to issue a decisive ruling on this matter today – given that the parties are bound to have all documents necessary to support their respective claims available for consideration.

Accordingly, I hope the Honorable Justices of the Supreme Court of The Bahamas make us proud by doing the right (and just) thing, despite the fanfare.

NOTE: I imagine a few enquiring minds would like to know what has or will become of Anna Nicole’s alleged Last Will and Testament, which Stern presented in evidence in the Florida court to assert his authority - as executor - to have her buried in Nassau. Well, here’s a hint: Whatever its validity and provisions, it will never be probated in The Bahamas...

However, the more juicy gossip pertains to the pending inquest into the death of Anna Nicole’s son in Nassau and the investigation into her own death in Florida. Because, in both cases, the umbrella of suspicion appears to be hovering over the head of Howard K. Stern - due to his alleged role in procuring and administering the cocktail of drugs the cause their respective deaths. Clearly, he’s got “some splainin” to do.

Bahamas police discuss Smith case with Florida investigators

FORT LAUDERDALE, USA (UPI): Police investigating the death of Anna Nicole Smith have met with prosecutors in the Florida state attorney general's office, it was reported Thursday. A Bahamas police representative also met with the Florida investigators .

While officials confirmed the meeting with Seminole tribal police investigators, they would not comment about the nature of the discussions, the Miami Herald said.

Seminole Police Captain Robert McDaniel warned against drawing conclusions about the meetings, since there is no evidence of foul play in the case.

Smith died February 8, when she was found unresponsive in her room at the Seminole Hard Rock Cafe and Casino. The Broward County, Fla., medical examiner is expected to announce a cause of death soon.

"Those (homicide prosecutors) are the people -- that if you were doing a death investigation and needed to speak with someone from the State Attorney's office -- you would go to," said McDaniel. "We have never had any indication of foul play. There is nothing that we have uncovered that would lead us in that direction."

A representative of the Royal Bahamas Police Force also met with the Seminole investigators regarding Smith's death, authorities said. Because Smith was an official resident of the Bahamas when she died, Bahamian authorities said they are interested in the case.

The bonding thing won't go too far. Babies spend months in the hospital sometimes. My granddaughter couldn't be handled by her mother for more than a few minutes for three months.

Ya, there's plenty of that kind of evidence. And what about all those adopted children? Yur right. The bonding thing will come up against evidence such as all this and more. If they bring up the bonding, which is pretty much all they've got, how will that "mitigate" (pretty impressive word, eh?) against the aggravating evidence of the drugs in the house, the drugging the mother while pregnant with the child, the baby being underfed, etc. Do they really wanna go there?

Once the judge "directs" the blood test and HKS doesn't do it, then what do you think will happen? I heard, I think it was Pinder (altho this isn't his case as we know) say that there is some recourse there. I can't believe that wouldn't be contempt of court! Then WTH is the court there for!?

Someone last night said that if Birkhead/Opri comes in and asks for a cheek swab and not a blood test that perhaps the judge would go along even tho that is not there method of doing dna tests in the Bahamas. But, hey Bahamas, there's a less invasive way. A cheek swap. Just do it.

But i think HKS will have people outside of Horizons screaming at him if he doesn't do this.

Police investigating the death of model Anna Nicole Smith have announced that initial autopsy results are inconclusive and no illegal drugs were found in her hotel room.

Former playmate Ms Smith died in her Floridian hotel room last month aged 39. The blonde bombshell, born Vickie Lynn Hogan, was once called the "next Marilyn Monroe" for her voluptuous figure and styling herself on the troubled actress for the cover of Playboy magazine.

"We found no illegal drugs, only prescription medicines," Seminole police officer Charlie Tiger told the press.

The statement comes just one day after authorities revealed that investigators were not treating the death as murder.

A spokesperson for the Broward County state attorney's office, Ron Ishoy, said: "We are continuing to help law enforcement agencies and the medical examiner as they try and figure out the nature of this death. This is not a homicide investigation."

Ms Smith rose to notoriety after her marriage to billionaire J. Howard Marshall in 1994 when she was 26 and the oil giant was aged 89. Mr Marshall died just over one year later, prompting Ms Smith's lengthy legal battle for a portion of his fortune.

Since her death a court battle regarding the paternity of her five-month-old baby daughter Dannielynn has ensued. A court in the Bahamas is today expected to hear the contenders for custody of the child which includes Ms Smith's mother and ex-boyfriend Larry Birkhead.

In fact, it does not. That is the tactic that the Stern team has used to smear everybody else, but it's not true. (Very clintonian to accuse everyone else of what you, yourself are doing.) Sorry, that's just flat out spin.

Too bad Rale blew it by saying it was a "knee" injury he suffered playing football in high school. He shoulda said it was a "head" injury and then maybe they'd have some kind of a defense in criminal court.

And he's hoping the Bahama courts will give him the baby because of his POSSESSION of the baby right now.

That's ridiculous! Maybe the judge can "direct" it but force him to come back to court later and explain why he didn't do as directed.
