Anna Nicole Smith has died according to ABC News

Anna Nicole Smith collapsed in her hotel room at the Hard Rock Cafe and Casino in Hollywood, Fla., and was rushed to a hospital on Thursday. A Hollywood, Fla., fire department spokesman told MSNBC TV that the actress was unresponsive when the rescue unit arrived on the scene.

Sources confirmed to Access Hollywood that Smith was transported to Memorial Regional Hospital shortly after 2 p.m. EST on Thursday. Access Hollywood also is reporting that Smith was intubated at the scene.

Officials told the Miami Herald, "it does not look good."

Three weeks ago, I would have been unable to pick ANS out of a line up and had limited knowledge about land controlled by Native Americans.
This thread has been very entertaining and informative.
The first night that ANS died, a detective was on discussing this and he said that the Seminole Nation PD would be the lead investigative agency.
That was news to me. He worried that those on the force might not have the experience to investigate this mess.
Since then, it has been explained that the Seminole Nation has their own laws and the investigators will have to follow tribal policy, first.
They answer to the tribal elders and the Bureau of Indian Affairs.
If the Seminole Nation PD feels a crime has occurred, they can call in the FBI.
They are also not subject to the FOIA.
My impression from the talking heads is that if the Seminole Nation feels that everything that happened in that hotel room ( which is their land ) was on the up and up-the investigation ends.

Let me see if I can explain this...

Why the ball is Birkhead's field now (This why Opri & Birkhead were all smiles as they came out of the Bahamian Court house earlier in the week.)

First off there is a gag order in place for the Bahamian court proceeding's related to this case. They cannot say much about it.

Opri came out and said that there is a international law that protects children rights. She said that both the Bahamas & the US have signed on to honor this international law. She also said that she expects that a DNA test will be ordered and completed within 30 days.

This got me thinking... so I started some searches to find out exactly what Opri was referring to.

I did a search on Bahamian Child Custody Cases...

The first thing that popped up was this book that was written in 2000

Article 8
Preservation of identity
The State has an obligation to protect, and if necessary, re- establish basic aspects of the child’s identity. This includes name, nationality and family ties.

1. States Parties undertake to respect the right of the child to preserve his or her identity, including nationality, name and family relations as recognised by law without unlawful interference.
2. Where a child is illegally deprived of some or all of the elements of his or her identity, States Parties shall provide appropriate assistance and protection, with a view to speedily re-establishing his or her identity.


Article 9
Separation from parents
The child has a right to live with his or her parents unless this is deemed to be incompatible with the child’s best interests. The child also has the right to maintain contact with both parents if separated from one or both.

1. States Parties shall ensure that a child shall not be separated from his or her parents against their will, except when competent authorities subject to judicial review determine, in accordance with applicable law and procedures, that such separation is necessary for the best interests of the child. Such determination may be necessary in a particular case such as one involving abuse or neglect of the child by the parents, or one where the parents are living separately and a decision must be made as to the child’s place of residence.
2. In any proceedings pursuant to paragraph 1 of the present article, all interested parties shall be given an opportunity to participate in the proceedings and make their views known.
3. States Parties shall respect the right of the child who is separated from one or both parents to maintain personal relations and direct contact with both parents on a regular basis, except if it is contrary to the child’s best interests. 4. Where such separation results from any action initiated by a State Party, such as the detention, imprisonment, exile, deportation or death (including death arising from any cause while the person is in the custody of the State) of one or both parents or of the child, that State Party shall, upon request, provide the parents, the child or, if appropriate, another member of the family with the essential information concerning the whereabouts of the absent member(s) of the family unless the provision of the information would be detrimental to the well-being of the child. States Parties shall further ensure that the submission of such a request shall of itself entail no adverse consequences for the person(s) concerned.

Article 10
Family reunification
Children and their parents have the right to leave any country and to enter their own for purposes of reunion or the maintenance of the child-parent relationship.

1. In accordance with the obligation of States Parties under article 9, paragraph 1, applications by a child or his or her parents to enter or leave a State Party for the purpose of family reunification shall be dealt with by States Parties in a positive, humane and expeditious manner. States Parties shall further ensure that the submission of such a request shall entail no adverse consequences for the applicants and for the members of their family.
2. A child whose parents reside in different States shall have the right to maintain on a regular basis, save in exceptional circumstances personal relations and direct contacts with both parents. Towards that end and in accordance with the obligation of States Parties under article 9, paragraph 1, States Parties shall respect the right of the child and his or her parents to leave any country, including their own, and to enter their own country. The right to leave any country shall be subject only to such restrictions as are prescribed by law and which are necessary to protect the national security, public order (order public), public health or morals or the rights and freedoms of others and are consistent with the other rights recognised in the present Convention.



I believe that Opri presented this to the Bahamian Judge this week and that is why he delayed everything for another 2 weeks while he is able to go over the articles of the Convention on the Rights of the Child International Agreement.



Chances are... a custody case like this has not happened in the Bahamas since they signed on to the Convention on the Rights of the Child International Agreement. I think it came into effect in 2000 or the late 1990's.

In the end there is a very good chance that Birkhead will come out of this with his child in his arms and with full custody of her. I have a feeling that Virgie's lawyers were not aware of this yet before they got on TV saying that Virgie would be the one to get custody of the baby because that is how Bahamian law does it. That may be the case between two unmarried Bahamians parents - that the child would go to the grandmother before the child would go to the father - But these new International Laws come into factor because Dannielynn is not a Bahamian and her parents are not Bahamian.

Stern wants to turn the Horizon home into a mini Graceland. There is no doubt in my mind that if Stern ended up with the Horizon home that he would dig up both Anna & Daniel and bury them on the Horizon property.

No kidding! He's probably having the plans drawn up for the mausoleum as we type! LOL!

The situation you described was not the usual, far from normal. The state apparently felt parents were unfit, though dad made at least some attempt to find the child and mother. Maybe if he had contacted police immediately, private detectives, etc., something like that--the court would have had record of his searching for child and wanting relationship.

Anyway, this situation with Birkhead is completely different. If he is the real father, the child belongs to him, and she should live with him.

As I said before, unless some bizarre situations exist, this has been the way the world has functioned since the beginning of time. Children belong to their parents.

Not the taxpayers, as far as the jet - but the police escort, yes.

Seidlin had two jets on standby all during the circus, to take ANS's body immediately to The Bahamas, if rulings went that way. Then, they were used for transporting HKS to The Bahamas "to take care of the baby" at least one night during the proceedings, but I do think that was stopped after once or twice.

The jets are private planes belonging to friends of Siedlin's who volunteered them to spare the taxpayers the expense. One of them is owned by someone in a major sport in Miami and the other, I don't know.

Milstein and Perper were ordered by Seidlin to accompany the body, I know that.

The story is on here somewhere. LB held her, fed her, burped her and then she spit up on him! Many speculated if they could/would use the spit up for DNA testing or whether HKS made LB leave his dirty shirt behind!

If bizarre situations exist, I guess the courts deal with them as best as possible (and maybe not the best...).

But in normal situations, a parent has the legal (and moral) right to a child over a grandparent or anyone else...again, in normal situations.

Yes....the GAL is making sure he gets face time. And Dr. Pepper....lol....CTV has a reporter there. He just interviewed the lump head. Said the good Dr. was just hanging out on the sidewalk in front of his office! ROFLMAO!! WHAT? Just waiting for the media to notice....I think I'm getting hysterical!

Anyhoo, Anna is going to be thawed out this afternoon. When she reaches room temp., the make-up people will come in and prepare her for viewing. The casket is coming this afternoon. Dr. Pepper will accompany the casket to the airport....5-5:30am tomorrow. I guess he's going to the Bahamas, also.

Is judge cry-baby also going??
