The Durham cab driver who has surfaced as an alibi witness in the Duke lacrosse rape case today was found not guilty of a 3-year-old shoplifting charge.
Moezeldin Elmostafa is expected to provide an alibi for Reade Seligmann, one of three Duke lacrosse players indicted in the rape case, because he gave Seligmann a ride after the party that led to the rape allegations.
After authorities learned of Elmostafa's potential role in the rape case, they found an unserved warrant naming him in a 2003 shoplifting case at a Hechts department store at Northgate Mall in Durham. A security officer for the store testified today in district court that he saw a woman steal handbags from the store and then jump into Elmostafas cab, which sped away.
The security officer testified that the cab pulled away even before the woman had closed to the door. A store surveillance tape, played in court, appeared to show that the door closed first.
Defense lawyers in the lacrosse rape case have said that Elmostafa was charged because he is a favorable witness to the defense. Loflin put one of the lacrosse investigators on the witness stand this morning and produced typed notes from the lacrosse case that show District Attorney Mike Nifong wanted to be informed when Elmostafa was arrested.
Assistant District Attorney Ashley Cannon told the judge the shoplifting case has nothing to do with the rape case.

This time "The Man" is going after the clean cut establishment kids rather than the counter-culture hippies rioting on Sunset Blvd.
Takes me back.
Stephens Stills was my favorite way back when. Still is. His music is timeless.
You can bet a lot of money that if it showed the presence of anything at all that could be used against the LAX players, we'd have heard about it long ago.
I e-mailed Neff the pubmed link on finding GHB in hair samples. He replied that he had not been able to find that info and thanked me for the link.
The actual report will make interesting reading.
The Neff article also suggests when Gottlieb put together his tissue of lies!!
Never, never were truer words spoken, LB. It is terrifying.
Though your brother's bound and gagged
And they've chained him to a chair
Won't you please come to Chicago
Just to sing
In a land that's known as freedom
How can such a thing be fair
Won't you please come to Chicago
For the help that we can bring
We can change the world
Re-arrange the world
It's dying to get better.......................
Ironic isn't it, now that many from the "counter culture" are "the man"... Look who is still the enemy...
Bob Dylan wrote a song about Hurricane Carter; the last few stanzas run :
Rubin Carter was falsely tried.
The crime was murder "one," guess who testified?
Bello and Bradley and they both baldly lied
And the newspapers, they all went along for the ride.
How can the life of such a man
Be in the palm of some fool's hand?
To see him obviously framed
Couldn't help but make me feel ashamed to live in a land
Where justice is a game.
Now all the criminals in their coats and their ties
Are free to drink martinis and watch the sun rise
While Rubin sits like Buddha in a ten-foot cell
An innocent man in a living hell.
That's the story of the Hurricane,
But it won't be over till they clear his name
And give him back the time he's done.
Put in a prison cell, but one time he could-a been
The champion of the world.

You'd be shocked . My son has every classic rock song he can find on his IPOD. I think he's up to 3800 songs. CSN&Y was the group that initially got him hooked. I've been reliving the 60's and 70's for the past two years musically speaking. The classic rock stations are very popular here in North Jersey. Who would have thunk it?
The Rap Crap (as I call it) lyrics didn't resonate with 90% of the generation. They seem to find the old stuff new again!
ok, need to keep trying sorry...
These reporters are idiots to continue to base stories on leaks from Nifong. How many times does he have to fool them before they quit being suckers. Notice how Osborne couch what he said since all he had about the tox was Nifong's verbal descripiton.
;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;;
Very True. Nifong has misled all along and the reporters are still eager to accept his lies. From the $400.00 left laying on the floor, the choke holds, the condoms, the affidavits, .. I don't have all afternoon or I would continue.

I was going to try and be funny by quoting from Ten Years After's "I'd love to change the world" and insert pictures, guess I am too old and cranky to figure it out, but my idea was change dikes to Mikes and...
Everywhere is
Freaks (insert Kimmy) and hairies (Gottlieb)
Mikes (well,duh) and fairies (Jakki)
Tell me where is sanity...
Ahh, a work of stark simplicity, and it perfectly symbolizes the case - an attempt to frame nothing. It's indescribably beautiful!
LOL! Each son had a speechless moment when they learned I knew every word of Suite Judy Blue Eyes and it was required sing along whenever it was on the radio.
"Quick, turn it or she will sing loud."
Everyone feels sorry for our kids because we "forced" them to listen to our music. Their collections include Alan Parsons, Styx, Heart, The Who, Kansas etc. Poor kids don't even know any rap songs, I am such a failure! By the way they are 15, 13 and 11
Fresh from their sharp performance on Greta Van Susteren's Fox News Channel show, Christiane Regelbrugge and Emily Wygod, the two spokespersons for Duke Students for an Ethical Durham, were profiled in yesterday's Duke Chronicle. On Van Susteren's show, the duo predicted a snowball effect of other Duke student groups coming to Students for an Ethical Durham to help out in the voter registration drive, which seeks to register 2000 Duke students in time for the November election.
