Cab driver in lacrosse case acquitted (DukeLax cabbie escapes Nifongery)

The Durham cab driver who has surfaced as an alibi witness in the Duke lacrosse rape case today was found not guilty of a 3-year-old shoplifting charge.

Moezeldin Elmostafa is expected to provide an alibi for Reade Seligmann, one of three Duke lacrosse players indicted in the rape case, because he gave Seligmann a ride after the party that led to the rape allegations.

After authorities learned of Elmostafa's potential role in the rape case, they found an unserved warrant naming him in a 2003 shoplifting case at a Hecht’s department store at Northgate Mall in Durham. A security officer for the store testified today in district court that he saw a woman steal handbags from the store and then jump into Elmostafa’s cab, which sped away.

The security officer testified that the cab pulled away even before the woman had closed to the door. A store surveillance tape, played in court, appeared to show that the door closed first.

Defense lawyers in the lacrosse rape case have said that Elmostafa was charged because he is a favorable witness to the defense. Loflin put one of the lacrosse investigators on the witness stand this morning and produced typed notes from the lacrosse case that show District Attorney Mike Nifong wanted to be informed when Elmostafa was arrested.

Assistant District Attorney Ashley Cannon told the judge the shoplifting case has nothing to do with the rape case.

Elmo found not guilty

The cabbie who provides a neat alibi for one of the three accused in the Duke lacrosse case was found not guilty of aiding and abetting a larceny. The cabbie, affectionately known as Elmo here in the blogosphere, was accused of assisting a habitual shoplifter make off with $250 worth of handbags -- three years ago.
The warrant wasn't served until Elmo surfaced as a witness (and innocent bystander) in the lacrosse mess. That, even though he continued to drive for the same cab company -- of which he was part-owner -- and even continued to drive the same cab. Durham authorities claimed they were foiled by misspellings of Elmo's name.

We're supposed to put three innocent young men through the cost and trauma of a trial because "there isn't alot of gray" in Nifong's world? Come on.

If there's "no gray" in Nifong's world, then where are the charges against Kim (lying to the police at a minimum, kidnapping, rape by force and robbery at the extreme) and the AV... she's a prostitute according to the written statement of her "driver" Jarriel... and she's been driving with a suspended license according to daddy

But I guess I would have to agree that one doesn't see a lot of gray when one's head is stuck up inside one's behind...

I just read that column. I didn't understand a word of it. I'm serious--I have no idea what the point was suppossed to be.

Before I read the date on it I thought I knew what it meant. Now I think it means she is a _____.

I have heard yes and no on that, and pretty definite no's on keeping a blood sample.

Good post, Condor. Stevenson is a perfect example of the wishful thinking mentality driving this case, and the willingness to smear an innocent, disinterested bystander because serendipity puts his testimony squarely in the defense's corner.

The Elmo case really demonstrates the DPD's complete disregard for the truth. What makes no legal sense is that the DPD and the DA's office had access to that video tape, yet they get up on the stand and lie their asses off anyway. They had to know they were going to lose this case, so that leaves pure harrassment as the obvious motive for going forward with the case.

The tox report isn't directly exculpatory, no matter what the results are, but it might impeach other statements Mangum has made with regard to her condition that night, what she did before going to the lax appointment, etc.. I agree it's completely relevant and should be turned over. My only point was that, from a legal standpoint, if the tox report is attached to another case, such as a possible probation violation, there is a technical argument that it's not discoverable in the Duke case because it isn't evidence collected by the cops or the DA for that case. It appears that may have been the argument that was made and, ever how it came about, Nifong lost on that point. What would be significant about it is if a judge ruled on that point, which may have happened and it just wasn't announced. The defense had raised the issue of a tox report and requested it in open court. Nifong was coy in his answer. The defense obviously pursued that point and Nifong either caved, which doesn't seem likely since he's clearly as stubborn as a rock, or the court directed him to turn it over, regardless of whether or not Nifong felt it was evidence gathered in another case. If so, that says something positive about the judge, and we haven't seen much of anything positive come from the judges so far.

And where is the NAACP to defend the innocent cabbie from police misconduct?

And where is the NAACP to defend the cook from police brutality and racial bigotry?

Oh, they're somewhere, make no mistake. They're busy shaking whitey down here, there and everywhere. When they're not doing that, they're rehearsing their lines for their biggest shakedown to come, reparations. They also spend a lot of their time hustling lawmakers for special protection laws that make the shakedowns easier and more lucrative.

"Three young, white, rich, arrogant preppies whose participation in helmet sports led to unremitting hubris, disregard for social inferiors, retrograde attitudes towards gays, and overall anti-social behavoir, were not convicted today because the prosecution was unable to overcome skepticism about the evidence planted
by the expensive lawyers of the defense team. . ."

The NAACP is hurting minorities here and they don't even know it. Next time some black woman cries rape is she going to be believed? Next time some poor black kid gets railroaded by "the system" is anyone going to listen?

Where's Darryl Hunt? He was imprisoned in NC for 19 years, wrongly convicted of rape and murder, in part due (I think) to DA abuse; and freed by DNA testing.

He now heads a group to help free others; and he spoke at Duke University to the incoming law class in 2004.

If anyone ought to be in Durham right now, it's him.

The more the leftist Fifth Column factions prevail in these cases, the more traction they get in gaining positions of power. Those successes multiply exponentially as the cycle of dumbing-down and weakening of Americans escalates while the left's use of the courts as a bludgeon also escalates.

It would be nice if Darryl and others freed by the Innocence Project work would speak up on this case. But if Darryl and the rest of them want to stay home I can't say blame them. They have been through enough in their lives already. Now if I was the people running the Innocence Project I would try to involve myself with these Duke kids in anyway possible. When their case is all done, they could be very powerful allies to have.

The NAACP doesn't care about hurting "their own" people anymore than they do anybody else. The NAACP is a group of mostly blacks who use other blacks to advance their own money-grabbing agenda. The NAACP is guilty of black-on-black crime just as sure as if they were running loose through the 'hood robbing and pillaging like we saw in New Orleans.
