Gag order sought in lacrosse case (NAACP Wants Gag Order)

DURHAM -- A lawyer with the state NAACP said the civil rights organization intends to seek a gag order in the Duke lacrosse case, and a journalist who participated in a forum with him on Wednesday said media coverage of the alleged rape may deprive the alleged victim of her legal rights to a fair trial.

Al McSurely, an attorney who chairs the Legal Redress Committee for the state National Association for the Advancement of Colored People, said he generally respects the defense attorneys in the case as colleagues. But they are violating the State Bar's rules of professional conduct that discourage comments outside court that are likely to prejudice a case, he said.

The NAACP will try to intervene in the case to file a "quiet zone/let's let justice work" motion. That is otherwise known as a gag order, he acknowledged, although he said he doesn't like that term.

McSurely's comments came amid the first-ever Durham Conference on the Moral Challenges of our Culture at First Presbyterian Church downtown. The session gave the approximately 150 people who attended a chance to hear a series of talks and discuss among themselves sexual and domestic violence, racism, class distinctions and the media.

I think, if we are lucky, other corruption in the Durham Power hierarchy will be uncovered during this trail too.

AAAaaannnnddd... suddenly the NAACP demands a "gag order" on the case.... Some of the major players in Durham are also members of the NAACP.

Exactly and they asked for a Gag order right on time, when they knew that Nifong would get blasted in motion if he had the audacity to request a gag order.

Nifong's agent was unavailable for comment.

Mysterious "cross burnings". Mysterious "3 arsons in one night recently". Mysterious goings on, and relationships and interrelationships between players, companies, larger politicians -- all going on in Durham. Lots of "unsolved crimes". Lots. IM own opinion, the problem lies at root with the unofficial "unelected" people running Durham. Too many "coincidental" connections to money, power, and racial politics.

Reading the North Carolina News and Observer story that Maggie posted, they are really something at the N&O.

The Title is "Accuser seemed OK early on, driver says"

Think about that.

The title could have been any of the following:

Dancer's driver discovered
How the dancer got to the Duke Party revealed
Dancer's Driver tells story
Dancer arrived around Midnight supporting Defense timeline
(but, they don't list the time of arrival because it must be
bad news for Durham Power)
Dancer whereabouts before party uncovered

But, the N&O FOCUSES entirely on how she wasn't intoxicated.
Even though, if you read closely, the driver DID NOT SAY whether they consumed any alcohol. I'm sure he did not say whether they did drugs or if they had anal sex either.

Only the N&O can think the news from this article is that her driver didn't say she was intoxicated earlier on.
This article is positive for the Defense, yet they cling onto one small hopeful nugget. It looks like Mike Nifong himself edited and titled this article.

Question: Who are they protecting by claiming they both don't know how the AV got to the driver's house?

Brian Taylor, who met the accuser at a Super Bowl party two years ago, said he spent an hour and a half with her before driving her to the party where she was hired to dance.

"She had called me a few hours earlier, asking me if she could use my place to get ready," Taylor said Friday.

Taylor said he did not know how the woman, a 27-year-old N.C. Central University student with two children, got to his home March 13. But he said that when she arrived about 9 p.m., he noticed nothing unusual about her demeanor. He did not say whether they consumed any alcohol.

Taylor had known for a while that his guest was a dancer. He and a male friend had watched her perform at clubs in Smithfield and Hillsborough.

As he sat in front of his PlayStation console March 13, the accuser showered behind a closed door and modeled at least two negligees for her host, he said.

"She asked my opinion," he said. "The first one was this black outfit, and I said, 'No.' When she came out in the red one I said, 'That's better.' "

It was 10:45 p.m., Taylor estimated, when they left for 610 N. Buchanan Blvd.

Where accuser went

On March 24, in her only interview with a reporter, the accuser said she was notified about 8:30 p.m. the night of the party that she was supposed to appear at the Buchanan Boulevard house about 11 p.m.

In an interview earlier this week, her father said he saw his daughter a few times March 13. That afternoon, he said, she picked up her two children from elementary school. About 9:30 p.m., he said, she brought the children to their grandparents' house for the evening.

"She was fine," he said.

After their arrival, he and his daughter took a short car ride about 10 p.m. to a neighborhood convenience store at Cornwallis Road and South Roxboro Street. He bought a pack of cigarettes but said he did not recall what his daughter purchased.

When the two returned to his house, the woman said she had to go out and wouldn't return until 1:30 a.m. He said he does not know whether she left in her own car or someone picked her up. He said she did call him to say she safely reached her destination -- about 11:30 p.m., about the start of a late-night talk show he was watching.

Baker said the sergeant, John Shelton, was talking with his superiors while police were trying to figure out exactly what they were dealing with. Patrol officers initially believed the woman was intoxicated.

So one of the two "drivers" finally speaks. What a great guy, he drops her off and is suppose to pick her back up in a couple of hours. After a few hours he doesn't hear from her but can't be bothered to check up on her. He doesn't hear from her till 7am the next morning. At this time she tells him to pick up her kids. But he doesn't do it because he doesn't know her that well. Which begs another question of why a woman would send a man to pick up her kids that she doesn't know that well.
