Why are Conservative Southern Protestants forbidden to be on SCOTUS?
I have not been able to find the name of the Last Conservative Southern Protestant nominated to SCOTUS. It has been at the least 100 years.
I predicted that an Alito type was going to replace Miers. Her Southern Texas drawl was not going to be tolerated during the hearings...
BTW, the reason diversity doesn't matter on the court is that judges simply apply the law. You do not need diverse representation because they are not representatives of anyone. They represent the law. That's it.
I wanted a Southerner but I am 100% in support of this fine man, Samuel Alito.

This isn't a slap at anybody, it's a good solid pick. I strongly predict there will be one more slot to fill before the end of Dubya's term.
Hugo Black was no more a strict constructionist or originalist than Earl Warren, David Souter, or Ruth Ginsburg.Well, I put that stuff in scare quotes for a reason. But Black did regard himself as a strict constructionist and an advocate of judicial restraint; in fact he was the lone holdout in Griswold, the well-known privacy-rights case. Whatever anyone thinks of his specific views about what strict construction commits us to, his judicial philosophy was "conservative" in this sense -- which, admittedly, may just go to show that the philosophical label doesn't tell you what's going to appear in the opinions.
Stephanopolis has already been on the air this AM pointing with alarm that there would be a Catholic majority on the SCOTUS if Alito is confirmed. This point will be made repeatedly in the leadup to the hearings.
He's Catholic, which makes him evil. Just ask gobucks.

In politics, we stand united for the same principles. I'm not offended in the least that he is Catholic. I am happy just as long as he is a conservative judge.

Yeah, this does give ammo to the left. But it is a lame point. They would be just fine if every member were an atheist. They always act like religion is a suspicious thing to be overcome by the nominees. The fact is, diveristy doesn't matter because judges are not representatives of groups of people. They represent the law.
BTW, the libs were all over the right for making religion an issue (in support) over Miers. So we get to play the hypocrisy card if they make it an issue over Alito.

I think I'm missing your point. I don't doubt that the lefties in the media will be all over this fact. They'll rip any conservative regardless of his religious affiliation, his Catholicism is just an excuse in their case.
Still, that doesn't explain gobucks' reaction to the nominee. It appears to me that gobucks is arguing that more-qualified, better potential nominees were scrapped because they are 'Conservative Southern Protestants.' As it has been pointed out over and over on this thread, there's no shortage of protestants in our government. I was trying to point out that his 100 years without such a justice theory is wrong, for Thomas was effectively a conservative, a southerner, and a Baptist at the time of his confirmation. His later conversion does not alter that fact.
I believe that this theory that Catholics are being favored because they're Catholic is baseless. Furthermore I believe the objections to him made on the basis of this theory come from a real anti-Catholic animus in certain people. This theory is going to be a tool of the left in this confirmation and should not be promoted by conservatives here on FR.

I'm a 'Conservative Southern Evangelical Protestant', and I think your statement is both ludicrous and childish. How incredibly myopic to think that the conservative or southern or Protestant interest in issues can only be advanced by a conservative southern Protestant.
