Florida governor says he doesn't have power from Constitution to intervene

Florida Gov. Jeb Bush, the man said to be the last hope for Terri Schiavo, says he's powerless to help the brain-injured woman who has been without nourishment for more than nine full days.

"I cannot violate a court order," Bush told CNN following Easter church services. "I don't have powers from the United States Constitution or – for that matter from the Florida Constitution – that would allow me to intervene after a decision has been made."

To Terri's parents, Bush said, "I can't. I'd love to, but I can't."

Speaking to the media for the first time in three days, the governor added, "I'm sad that she's in the situation that she's in. I feel bad for her family. My heart goes out to the Schindlers and, for that matter, to [her husband] Michael," Bush said. "This has not been an easy thing for any, any member of the family. But most particularly for Terri Schiavo."

Meanwhile, protests have continued outside the hospice where Terri is being cared for. With security having been doubled, five people were taken into custody as pastors tried to bring Schiavo Easter communion.

A handful of people in wheelchairs got out of them and shouted, "We're not dead yet!" as they lay in the driveway.

Larry Klayman, founder of the legal watchdog group Judicial Watch, said Bush has the power to grant her clemency, just as he would in a death-row case.

"We're asking the governor for a stay of execution on Easter Sunday, a day of mercy,'' Klayman said. "For Jeb Bush not to act would be a dereliction of his duty to the people of the state of Florida.''

Terri has been the subject of worldwide attention since Florida Judge George Greer ordered her feeding tube removed March 18, and courts have upheld his decision not to have the tube reinserted.

An attorney for Terri's parents, Bob and Mary Schindler, painted a grim picture of the situation on CBS' "Face the Nation."

"Terri is declining rapidly," Schindler attorney David Gibbs said. "We believe at this point she has passed where physically she would be able to recover."

But Randall Terry, a pro-life activist speaking for Terri's parents, called Gibbs' description "absolutely untrue."

George Felos, the attorney for Michael Schiavo says Terri's breathing has been regular, and her death does not appear imminent. He told reporters her remains would be cremated and buried in a family plot in Pennsylvania.

It would be a basis for a dissolution of marriage (a Fla. term for what evryone else knows as divorce) if one of the parties to the litigation chooses to assert it a basis for the allegation that the marriage is irretreivably broken. But adultery itself is not a bais for the state to undertake unilateral action to become a party to a divorce that neither party to the marriage has brought. The arguments raised here have become ever increasingly bizarre and outlandish.

Even a casual review of our respective posts will demonstrate that you came into this thread copping an attitude and lamely attempting to throw your weight around. I don't care for pissing contests any more than the next guy, but I'm not going to just sit around and let you piss all over me, and you'll get as good (or better) as you give. You have no defenders in this thread, and more than one poster has called you on your abusive behavior. Take the hint bucko, you're probably closer to getting suspended than you realize. If you've got something to say about the whole Jeb Bush/Schiavo debacle, do so. If all you have is insults, GTF on down the road.

I'm taking no hints from you, disruptor. I have already stated my 'say' about the debacle, and then simply returned insults. One thing I've found in my years FReeping, disruptors need and rely upon the stupid ones for defense.

He doesn't need any defenders, nor does you ganging up on him mean that the people lurking support your side. All he's doing is telling you the ugly truth. Just be less sensitive about it, and you'll get by fine.

Mad Mammoth has posted many times on many threads. I have never seen him act as a disruptor. I doubt the mods will see it differently. If you disagree with him, so be it. Inferring that I am a coward is laughable. Thank you for your service to our country.

I pay little attention to whom I am responding. One issue I'll be a odds with one someone and on another issue I'll be in agreement. This issue has become one of emotion, and thats the rule of the mob.

Disruptor's have fascinated me for all my time FReeping. The greatest harm disruptors do is discrediting us as a group. They use intolerance and hyperbole and they rely upon people to take their side, as if they were as genuine as they pretend to be. They often whine to the mods, after all, if they can eliminate other (possibly reasonable) opinions, all the better. I don't know if MM is a disruptor, or a retread, but I do know he seeks to divide, but insult seems to be his only tool.

I have to admit, this is the hottest of hot potatoes we have had here in years. I am no expert on constitutional law, but it is at least ostensible that judges are out of control; not just in this case but many others, some involving the right to keep and bear arms. Furthermore, I find it impossible to believe that nothing could be done to stop this, if only to allow a few days for a small group of independent surgeons to render an opinion.

Your comment about disruptors is fair.
I am not seeking to disrupt and divide.

Rather, I am lamenting the decisions that the leadership of the Republican party have taken - specifically concerning Terri Schiavo and backing away from the nuclear option - which I believe are certain to divide us.

I brought up the Bush 41 flop on taxes, because although YOU voted for him anyway, despite being mad, enough fiscal conservatives did NOT vote for him - either stayed home or voted for Perot - that Clinton won. On the surface, that seems like a defeat. But longer-term, the Republicans got the message, and never again have even dreamt of reversing a low-tax pledge. They learned the lesson, the hard way, that betraying a key constituency on its key issue loses elections in the near term.

Now, I wonder. Knowing what we know now, if Bush 41 could turn back the clock and stand where he did, to make the decision on taxes again, would he have approved a tax hike all over again? I seriously doubt it. The lesson WAS learned.

Here we stand again at the Rubicon, but this time it's the pro-lifers whose guts have been ripped out by various levels of government during Holy Week. Republicans in the Judiciary join the press for Terri's death. The Executives pledge support, then back away. The Legislature issues subpoenas, but then not only does not press them or hold hearings, but starts to waffle on the nuclear option itself. This is another "Read my lips" moment. The pro-lifers have been emotional. They started to get emotional back when Specter was rammed through. But now it's crunch time and they feel utterly betrayed, beaten down by events. It's a complete catastrophe to them.

The difference, though, is that there is still time to pull back from the brink and change course before the disaster is complete. Terri Schiavo is still alive. The nuclear option has not yet been defeated.

It is my personal hope that the Republican weather testers will look out there into the base, and realize that it is coming apart before their eyes. The low-tax guys walked when Bush 41 hiked taxes. The pro-lifers' level of discouragement and defeat is the lowest since Roe v. Wade. This is the perfect storm issue of life and death, punctuated by it being Easter.

I am still praying that God will either soften the stiff necks or strengthen the limp spines of the Republican men who still have the power to act and save both Terri Schiavo's life and the conservative judiciary slate. In the process they will save the Republican coalition. I am sick because I don't see any recognition on the part of the Republicans who are not committed pro-lifers that this is a "Read my lips" moment for the pro-life movement.

There is still a little bit of time to turn the ship before it hits the ice dead ahead.

Thanks for the info. As I've replied umpteen times to the divorce bit, stating that I'm pretty sure Terry Schiavo's parents did request a divorce (as Terry is unable), I'll just say this in response to your statement about "bizarre and outlandish" arguments: If your child (who was innocent of any wrongdoing) was going to be killed with the sanction of the state, you'd probably get that way as well.

I have no problem extrapolating other people's circumstances to my possible future circumstances, or possibly my young daughters'. What's "bizarre and outlandish" is the fact the the State of Florida is killing an innocent woman, whose so called POS "husband" possibly put her in the "brain dead" condition to begin with. This same POS "husband" whose shacked up with some whore and now has 2 kids by her, but still has his "wife's" best interest in mind. Yeah, right. What's "bizarre and outlandish" is people's non-reaction to this event.

While I'm not in disagreement I do think its too late. I wouldn't have minded a more thorough evaluation. I would have prefer MS not have custodianship. I would rather the Schindler's were able to care for their baby as long as they wanted to, as long as she lived if that be their choice. That doesn't appear to be the reality of it, though. Basic facts, Florida recognizes the hubby, and the hubby gets his way. Maybe he is a slimy creep and maybe she did tell him she didn't want to be kept alive. All I know is the courts have found and every legal opportunity has been given the Schindlers. I agree with your impression that this is the hottest potato we've had, and I hate the way its riping at us. This is why I resent any of these folks trying to blame the Bushes, or congress. They tried. This is why I feel so dang intolerant toward the hostility of the far religious right. This is why I encourage them to the mountaintop whenever they threaten to leave. I would much prefer working together for a common good.
