My disappointment in Hugh Hewitt (he criticized calls for Jeb to stand up to Greer and save Terri)

Hugh's been strong in defense of Terri -- till yesterday, when he devoted a lot of time denouncing those (like Dr. James Kennedy) who have called for Jeb to step forward - despite Judge Greer's injunctions - and take action to save Terri Schiavo from a judicially-decreed death.

Hugh was going on about the "rule of law" and quoting the old chestnut from "Man for All Seasons," about how if we tear down the laws to get at the devil, we have nothing to defend ourselves when he turns on us.

But Hugh doesn't get it: IT's the ACTIVIST JUDGES who've ALREADY TORN DOWN THE LAWS. For some politician to stand up to a lawless judiciary would be a stand FOR the "rule of law," not against it.

We have a crisis of governance in this country, with judges taking seizing tyrannical power. Tthey're able to act as tyrants only because elected officials won't stand up to them. IF THERE WAS EVER AN OCCASION THAT WOULD PROVIDE AN OPPORTUNITY TO TURN THE TIDE - FOR AN ELECTED OFFICIAL TO SAY "NUTS" TO A DICTATORIAL JUDICIARY - IT IS NOW, WHEN THE TINPOINT JUDGE GREER, A HICK COUNTY JUDGE SWOLLEN WITH ARROGANCE HAS ORDERED AN INNOCENT WOMAN KILLED SIMPLY BECAUSE SHE'S dISABLED.

There are constitutional and statutory provisions enough for Jeb to rely on, as chief executive authority of Florida, to act to save this woman.

Hugh Hewitt, with all his civics lecturing -- taking the issue away from the life or death realities of this crisis -- forgot to mention some important historical precedents: Lincoln refused to obey the Dredd Scott (pro slavery decision); Andrew JAckson scoffed at what he considered an illegal order of Chief Justice John Marshall; Thomas Jefferson affirmed that EACH BRANCH of government has an independent DUTY to interpret and UPHOLD the constitution;;; and DWIGHT EISENHOWER SENT TROOPS TO CLINTON'S ARKANSAS (clinton was a kidk, of course)., when local politicians AND LOCAL JUDGES WERE IMPOSING SEGREGATIONIST LAWS, DENYING BLACKS THEIR RIGHTS TO EQUAL PROTECTION - i.e TO GO TO UNIVERSITY.

The showdown with arrogant judiciary has to happen at some point: Destiny has asked Jeb to be the hero for free government, and to take a stand. Hugh Hewitt counsels passivity: Let's hope Jeb finds the counsels of conscience to be louder and more persuasive!

Terri is bleeding by the tongue. Jeb Bush, Hugh Hewitt and the rest of should say "NO MORE!" to Mr. Greer, the judicial mediocrity who has ordered that torture.

I'm asking him to stand up to an out-of-control judge and save a woman's life. That's what I'm asking him to do.

Adulterizing or adulterating, neither is a factor in Terri's guardianship.
The Schiavo family has had seven years worth of court cases but they never tried to terminate the marriage and they would not have been successful if they had. The only people who can end a marriage are the husband and/or wife. In the case of Terri's incapacity, the Guardian ad litems appointed to represent her never considered divorcing Michael on her behalf, in fact they found that his provision of care for her was exemplary. Those are just the facts in evidence, not my personal opinions.

This killing of Terri on the flimsy evidence from her conflicted husband that she would want to be killed, is INSANITY. Jeb Bush's passivity in the face of this outrage is dismaying, as is Hewitt's counsel that we "understand" why Jeb can't play the part of a real man.

If he's a practicing lawyer, I guess he can't publicly support defiance of judicial rulings (even illegal ones). But then, Lincoln was a practicing lawyer, and he defied the Dredd Scott decision. Oh well, different times, different outlooks, different kinds of people.

You couldn't be more wrong. What HH has said,repeatedly, is that we don't have the money or the political will to round up and expel the 15/20 million illegals that are in this country. He is adamant that we build a wall all along border of this country, and I paraphrase HH..It worked in San Diego, it's working in Isreal and we need to build a wall here with a super highway running parallel to it.

I live in San Diego, and have personally visited the so-called wall. Have you? The so-called wall is a joke. It actually helps alien smuggling, because it cloaks the mass movements of migrants from the view of the BP as they move to their jump-off points. The BP travels solo (one man per vehicle) in white SUVs that are visible miles away on their patrols along the fence. The BP vehicle moves over the hill, the word goes out, and the stampede is on. Anybody who believes that alien smuggling in San Diego County has been "solved" is delusional, and is accepting the government lie.

HH was pushed against his will toward this very grudging new position on his version of a wall. If you listened to HH a year ago, he was open borders all the way, benefits outweigh the costs etc. Only after being hammered repeatedly by angry listeners did he slowly trim his sails to this new mamby pamby position on a fantasy wall and super highway which he knows will never be built.

As far as "rounding up" illegals being an impossibility, that's another OBL straw man. We don't need to "round up" the illegals, we need to remove their lips from the Great American Mammary Gland. Cut off the illegal alien bennies and subsidies, punish the employers of illegals (ie: "enforce the law") and they will deport themselves.

When he calls Chomskeyite "law prof" Irwin Chemerinsky one of the "smart guys" on his weekly appearance, I want to throw up. This would be like giving Lenin a platform to spew his lies in 1915.

Open Letter to Gov. Jeb Bush, from Elizabeth Farah

Dear Gov. Bush: You are in a difficult position. There are few men who find themselves in a situation such as yours. Quite literally, you are the only hope, the only person in the world who can save the life of this defenseless woman facing an unjust death.

I want to give you courage. I understand that advisers may point to polls and public opinion that seem to show most people believe the government should never have become involved in this conflict. While it is true these polls are misleading because the questions misinform the respondent in telling them that Terri is brain-dead, etc., the fact that public opinion is really not against you is of little importance. Let me tell you why.

The Lord God is truly on your side. You know the Scripture, "If God be for me who can be against me?" The Lord is always searching for "mighty men of valor" to do His work. You must instinctively know that Americans yearn for men of courage, principle and perseverance. We see over and over our leaders making an initial effort to do what is right and then, when the going gets tougher and the odds seem insurmountable, they feint. That lack of perseverance, determination and resolve has led to a lack of faith in our leaders.

You know that God is present in every situation. He never advocates injustice or any other evil. Only God has the authority to give and take innocent life. But He most often works through godly men and women, and he expects all believers to do His will regardless of the perceived cost. God has allowed this task to come to you. All life is a test, and this is clearly a test of your faith in God.

God loves you and will never test you beyond what you are able to do. But he tells us to take His yoke. He will carry you through this challenge. Don't rely upon yourself. There is a point at which we all throw up our hands and say, "I have done all I can." The pressure and stress seem overwhelming. But God says, if you have faith in Me I will do the work for you – I will give you victory. He promises that he wants only good for you:

For I know the thoughts that I think toward you, saith the Lord, thoughts of peace, and not of evil, to give you an expected end. Jeremiah 29:11

But he expects you to trust in Him:

The LORD is my light and my salvation, whom shall I fear? The LORD is the strength of my life, of whom shall I be afraid?

This trust isn't a belief that God exists, but a faith that God will always sustain us when we do His will, that he is a rewarder of those who seek His will and do it.

Have not I commanded thee? Be strong and of a good courage, be not afraid, neither be dismayed: for the LORD your God is with you whithersoever you go. Joshua 1:9

But without faith it is impossible to please him: for he that cometh to God must believe that he is, and that he is a rewarder of them that diligently seek him. Hebrews 11:6

You are the chief executive of the state of Florida. You are not the servant of an un-elected judiciary. You have been given power by the people of Florida to protect their rights and lives. Don't fail them!

Speak for those who cannot speak for themselves in the cause of all such as are appointed to destruction. Proverbs 31:8

You've been given a gift of leadership. On one hand you probably think that the Schaivo case is a burden that you wish God had never given you. But think of this – God has entrusted you with the honor of responsibility. He expects you to do much because He has given you the opportunity and ability to do much.

For whom much is given, of him much shall be required. Luke 12:48

Moreover it is required in stewards that a man be found faithful. 1 Corinthians 4:2

I believe this culture of death that is now overtaking our country is fostered by a movement away from God.

In Proverbs God says, "All they that hate me love death." (Proverbs 8:36)

Gov. Bush, you have the right to exercise your authority to save this woman's life. You have the authority to reject a corrupt judge's corrupt decision. Remember when the pharoah issued the order that all Hebrew male infants should be killed? What did Moses' mother do? She broke the law of the civil authority. She saved the life of her son. This act of civil disobedience or lawbreaking gave her a place in the great chapter of the Bible known as the "Hall of Faith." Her courage was seen by God – not as lawlessness but as a supreme act of faith! (Hebrews 11:23)

Jesus says that yes, you will have many detractors – people who will revile you for doing the right thing, but you will be rewarded greatly by God.

Blessed are ye, when men shall revile you and persecute you, and shall say all manner of evil against you falsely for my sake. Rejoice, and be exceeding glad for great is your reward. Matthew 5:11, 12

… let us run with endurance the race that is set before us, fixing our eyes on Jesus … so that you may not grow weary and lose heart. Hebrews 12:1-3

Remember all the men and women of this country who are searching for leaders of courage. I have been profoundly affected by your obviously sincere concern for Terri Schiavo. I can see that you are deeply disturbed by her plight. I know I am right in believing you will always regret it if you don't do the right thing here. It will haunt you. I promise you, you will never regret fighting the good fight through to its end. People will follow that kind of a leader. People, even those who disagree with your politics, recognize the value of a man who will not compromise his principles.

We vote for the people who will get rid of those judges. Either through the Initiative process or Legislation which would make appointed Judges stand for election.

We can also pressure our executive branch to ignore judicial decsion ESPECIALLY when it has legislative support. The Florida courts ruled Terri's Law unconstitutional. If Jeb Bush said tough and acted would you have objected?

Or consider the 2000 Election. Suppose the SCOTUS ruled the recounts should continue under the broadest terms and the counters found more votes for Gore than Bush. The SCOFLA then ruled the Fla. legislature had to authorize the Gore electors and was upheld by SCOTUS, which then using foreign law ruled that Congress had to accept the result? Do you believe that to be an impossible occurrance? I don't.

At what point do you resort to civil disobedience against judges?

Unless I am mistaken, Judge Greer is an elected judge, not appointed.

He was and as a Republican. If we were to pursue the more moderate route that you advocate, the first step is to hold the judges publically accountable for bad decisions by condemning them and bringing into the public the concept of their replacement.

So this is the first step.

Yeah, Hewitt doesn't just have a differing opinion, he's "...a hand-wringing whiney country-club republican."

Congratulations on personally displaying the effectiveness of fanaticism and absolutism. And for allowing something that should unite conservatives, to show how infantile we can be.

Once again...it's Michael Schiavo who bears responsibility for this, no one else.

If you want to ride the slow train to the gulag or Auschwitz with Hewitt because it's "the only legal way," that your problem.

If it was up to "conservatives" like Hewitt and yourself, we would still be "law-abiding colonists" afraid to go beyond sending polite petitions off to King George the XXIV.

Never forget: the Nazi euthanasia orders were all written according to law, and were all signed by judges.

Jeb has done so much, and we really need to be grateful for what he has done. I would love it if he went to the limits, but I am not going to fault him for holding back at this point. He is in a very difficult position and he has really been outstanding overall. We must THANK him, not condemn him.

I agree completely.

I read today that Alan Keyes said Jeb hasn't done anything. Just FYI. (I can dig around and find it, if I have to.)

I do not disagree, but if he has not been legally correct in his decisions then why do we find ourselves in this position? (and, please do no give me that sad tired, pitiful rant about MSM, liberals in general, etc.

Hugh Hewitt is a passionate supporter of Terri and of the de novo review. Hugh also knows the law. He knows that if Jeb goes against the court ruling, Jeb will be violating the law. Jeb would be impeached and convicted by the Florida legislature if he violates the law.
