My disappointment in Hugh Hewitt (he criticized calls for Jeb to stand up to Greer and save Terri)

Hugh's been strong in defense of Terri -- till yesterday, when he devoted a lot of time denouncing those (like Dr. James Kennedy) who have called for Jeb to step forward - despite Judge Greer's injunctions - and take action to save Terri Schiavo from a judicially-decreed death.
Hugh was going on about the "rule of law" and quoting the old chestnut from "Man for All Seasons," about how if we tear down the laws to get at the devil, we have nothing to defend ourselves when he turns on us.
But Hugh doesn't get it: IT's the ACTIVIST JUDGES who've ALREADY TORN DOWN THE LAWS. For some politician to stand up to a lawless judiciary would be a stand FOR the "rule of law," not against it.
We have a crisis of governance in this country, with judges taking seizing tyrannical power. Tthey're able to act as tyrants only because elected officials won't stand up to them. IF THERE WAS EVER AN OCCASION THAT WOULD PROVIDE AN OPPORTUNITY TO TURN THE TIDE - FOR AN ELECTED OFFICIAL TO SAY "NUTS" TO A DICTATORIAL JUDICIARY - IT IS NOW, WHEN THE TINPOINT JUDGE GREER, A HICK COUNTY JUDGE SWOLLEN WITH ARROGANCE HAS ORDERED AN INNOCENT WOMAN KILLED SIMPLY BECAUSE SHE'S dISABLED.
There are constitutional and statutory provisions enough for Jeb to rely on, as chief executive authority of Florida, to act to save this woman.
Hugh Hewitt, with all his civics lecturing -- taking the issue away from the life or death realities of this crisis -- forgot to mention some important historical precedents: Lincoln refused to obey the Dredd Scott (pro slavery decision); Andrew JAckson scoffed at what he considered an illegal order of Chief Justice John Marshall; Thomas Jefferson affirmed that EACH BRANCH of government has an independent DUTY to interpret and UPHOLD the constitution;;; and DWIGHT EISENHOWER SENT TROOPS TO CLINTON'S ARKANSAS (clinton was a kidk, of course)., when local politicians AND LOCAL JUDGES WERE IMPOSING SEGREGATIONIST LAWS, DENYING BLACKS THEIR RIGHTS TO EQUAL PROTECTION - i.e TO GO TO UNIVERSITY.
The showdown with arrogant judiciary has to happen at some point: Destiny has asked Jeb to be the hero for free government, and to take a stand. Hugh Hewitt counsels passivity: Let's hope Jeb finds the counsels of conscience to be louder and more persuasive!
Terri is bleeding by the tongue. Jeb Bush, Hugh Hewitt and the rest of should say "NO MORE!" to Mr. Greer, the judicial mediocrity who has ordered that torture.

You may call me crazy but maybe we should have let the two LEO's shoot it out and once and for all establish who in charge.
People forget that it's not just about this Terri; it's about all the other Terris down the line, not to mention our constitution. If the state troopers in this case, fighting on the side of rigteousness, and in the course of their duties, took care of business it would be a glorious victory for both life and the Constitution.

FYI: I did a search on Judge Greer this morning and found that he was RE-ELECTED in 2004 by a 65% margin. He was opposed by a pro-life judge. Votes do matter.

Hew Nitwit is nothing more than a REPUBLICAN operative that is probably on the payroll....just as Armstrong Williams was.
The Bush Dynasty is in its 17th year...Yes Clinton and Bush are the same extension of the George HW Bush presidency.
If Bush and Clinton are not the same...then explain the love fest between the Bush's and the Clinton's. Nothing much has changed with Bush. Except he's out Clintoned Clinton.
Spending has exploded. NO child left behind is still on the books along with Public radio and TV. Yeah a little tax cut here and there...but nothing major has changed.
Gas is Higher....but that isn't Bush's fault.....but we need to have a national policy on energy...but where is it?
Where is the changes needed? Just more of the same.
All the while the Republicans saying Bush is the greatest president ever and the Demoncrats saying he's the worst.
Same thing during the Clinton administration.

We vote for the people who will get rid of those judges. Either through the Initiative process or Legislation which would make appointed Judges stand for election. Unless I am mistaken, Judge Greer is an elected judge, not appointed. The problem is us. If we don't exercise our rights, we get the government we deserve.

My point exactly...15 times reviewed and they still have not recognized judicial error. The "husband" has no standing...he is a bigamist, one statutory wife and one common law wife. Since we are a nation of laws, when exactly will the courts order his arrest???

We are in a point in our history that if we are ruled by judges and THEIR police forces then we are finished as a country.
I've been active in several community campaigns. We were all naively pushing our city councils and our board of educations to adopt policies that reflected the standards of our fairly conservative and church-going town. I kept wondering why our elected representatives kept looking over at their legal counsel. Silly me. I thought we were a representative government, that representative bodies had the supreme power among the branches of government.
The lawyer they were talking to at the end of the table speaks to the judge for a living, and--as you've written--the judge has police at his disposal.
We are fast becoming a police state, unless we wake enough patriots up.

I was particularly disappointed in the shot that Hugh took at Dr. James Kennedy, for calling on Bush to step in. Kennedy wasn't calling for lawlessness, but for Jeb Bush to act on his executive authority to uphold the Florida Constitution's protection of life.
James Kennedy is speaking with a prophetic voice in this matter. in criticizing him, Hugh Hewitt risks sounding more like a courtier.

The fact that I may not like him or his judgments is irrelevant. I am left to conclude that the problem must be with Florida law. I'm afraid it's too late to remedy that.

You guys are way off to imagine that JEB should take the law into his own hands. Folks we ARE a nation of laws, here. In That Hugh is right. But he is WRONG to say we cannot do anything.
Here is the last part of an op ed I just read....
Today, unfortunately, we are not faced with isolated Courts that are troublesome nor are we just faced with just a Supreme Court problem. We are faced with an entire court system all up and down the line that is acting contrary to both the majority will and the laws made by nearly every law maker from the States to the Federal governments.
I must say first, though, that I am not recommending civil disobedience to court rulings; that would be a step too far. As I said, the United States is a land ruled by laws and to outright ignore Court rulings would tend to destroy the rule of law rather than mend it. But we have at our disposal as citizens several weapons to use against the judiciary in many states.
The vote
Over the next several decades we need to vote every single sitting judge out of office to show them that they are not an imperial presence beyond all accountability. Yes we would loose some good judges, but even the good judges have backed up the ones who have gone off track. We need to bring a democratic check to this branch of government.
After all, the courts are a co-equal branch of government with the legislature, not a higher one. They must realize that they cannot just do what ever they feel like doing regardless of what the law actually states and what the people want.
The Rules
We also need to change lifetime appointments so that these people are not given a free reign with no accountability. A judge who knows he is unaccountable to every citizen he is supposedly tasked with protecting almost assures arrogance. We all know the saying that absolute power corrupts absolutely and we are seeing this maxim borne out with the Courts today.
Abolishing Circuits
Congress may not remove a judge except by impeachment and that has traditionally been one of the hardest things to achieve. The Constitution says that judges "shall hold their Offices during good Behaviour". However, "good Behaviour" , does not exclude bucking Congress or the will of the people.
So, while we cannot just fire a wayward judge we can eliminate the circuit over which they preside which would leave them without duties to execute and, therefore, out of a job. The Constitution says in part in Article III, Section 1: "The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish. "
Clearly, the Constitution states that since Congress has the power to create "such inferior" Courts, it also has the power to abolish them, as well. Jefferson took advantage of this power during his presidency, for instance, so there is precedent.
Pressure our Representatives
We simply must make this a focus issue when we interact with our elected representatives. We must, as a people, impress upon our leaders that we are just plain sick and tired of these wild judges. We should let them know that we will be voting them out of office, too, unless they begin to think a little harder about their judicial appointments.
Furthermore, we need to let our politicians know that it is they who are responsible for creating law, not the Courts. And they must take this role more seriously than they now do. They need to stop allowing the Courts to make all their decisions for them. As it stands now we do not have a democracy, we have a tyranny of the Judicial minority and our law makers must take back their turf.
We are a nation ruled by laws, and this cannot be abrogated. But, we can bring these out of control Courts back down to earth by utilizing the power we do have as Americans under that very law, without breaking it. Its about time we took up the power vested in us and did so.

I will accuse him of abusing authority by ruling that there was "clear and convincing" evidence that Terri wanted to be put down - based on some off-cuff, casual comments YEARS AGO, comments that didn't even go to specifics about feedings tubes, etc. Also, she had friends who claimed she'd said other things - PRO-life things. So the "evidence" was AMBIGUOUS - far short of "clear and convincing", to quote the lying judge. A Florida Internation U. law prof, in Miami Herald, wrote it was "shocking" that Greer had based a decision for death on such flimsy evidence, when the law requires "clear and convincing." The man is arrogant and a tyrant. Jeb Bush should step in.

He claimed he did not have to obey a federal subpoena and he told law eforcement agencies to intervene in an executive action of the state of Florida. He is not only making up law, he is making his OWN PERSONAL LAW.
The Freepers who defend this enemy of justice plain sicken me.
