It’s a start but the cop was sloppy and nowhere near as effective as he could and should have been. Too much grabbing and grappling with the asshole.

The Florida law in question is House Bill 1 (HB 1), also known as the Combating Public Disorder Act, which was signed into law by Governor Ron DeSantis in 2021. This “anti-riot” legislation was enacted in response to widespread protests, such as those associated with Black Lives Matter, and includes provisions aimed at increasing penalties for riot-related activities while protecting certain individuals from civil liability.

Key Provisions Related to Drivers and CrowdsDriver Immunity Clause:
The law provides civil immunity (protection from lawsuits) to drivers who unintentionally cause injury or death to another person while fleeing for safety from a “mob” or during a riot, if the driver reasonably believes such action is necessary to escape imminent harm. This is outlined in amendments to Florida Statutes, particularly under sections related to self-defense (e.g., § 776.012 and § 776.032, the Stand Your Ground law) and riot definitions (§ 870.01). However, this immunity is not absolute:

1. It applies only if the driver’s actions are deemed justifiable self-defense and proportional to the threat (e.g., the crowd is surrounding the vehicle, blocking escape, or posing a danger via force or threats).

2. Using a vehicle in this way is considered deadly force, so it must be “reasonable” under the circumstances—drivers cannot intentionally target people or act recklessly without facing potential criminal charges like vehicular manslaughter (§ 782.071) or aggravated battery (§ 784.045).

3. The law does not grant blanket permission to “keep driving through a crowd” arbitrarily or to run over peaceful protesters; it specifically ties immunity to fleeing a riotous situation where the driver fears for their safety.

Riot and Blocking Definitions: HB 1 defines a “riot” as a public disturbance involving three or more people acting with common intent to use violence or threats that endanger public safety. It creates new offenses like “aggravated rioting” (a second-degree felony punishable by up to 15 years in prison) if 25 or more people are involved and actions include blocking roadways by force, causing bodily harm, or using deadly weapons. Protesters who block traffic without a permit can face a $15 civil infraction, but if declared a riot, penalties escalate significantly.

Protester Protections and Limits: Peaceful protests are still protected under the First Amendment, and local governments can issue permits for demonstrations that block traffic. Marching on sidewalks while obeying signals is allowed without a permit, but intentionally obstructing vehicles or passersby can lead to charges.
