Riot and Blocking Definitions: HB 1 defines a “riot” as a public disturbance involving three or more people acting with common intent to use violence or threats that endanger public safety. It creates new offenses like “aggravated rioting” (a second-degree felony punishable by up to 15 years in prison) if 25 or more people are involved and actions include blocking roadways by force, causing bodily harm, or using deadly weapons. Protesters who block traffic without a permit can face a $15 civil infraction, but if declared a riot, penalties escalate significantly.
Protester Protections and Limits: Peaceful protests are still protected under the First Amendment, and local governments can issue permits for demonstrations that block traffic. Marching on sidewalks while obeying signals is allowed without a permit, but intentionally obstructing vehicles or passersby can lead to charges.
