A radical federal judge has moved to block former President Donald Trump’s efforts to secure America’s borders and protect its citizens.

On Saturday, Chief Judge James E. Boasberg, an Obama-appointed leftist, granted a temporary restraining order to stop the Trump administration from deporting thousands of Venezuelan nationals under the Alien Enemies Act—an action well within the executive’s constitutional authority.

This outrageous ruling comes after far-left groups, including the American Civil Liberties Union (ACLU) and Democracy Forward, rushed to court in a desperate bid to shield illegal immigrants from deportation.

Their lawsuit, J.G.G. v. Trump, seeks to upend Trump’s lawful enforcement of immigration laws, arguing that invoking the Alien Enemies Act—a wartime measure historically used to remove hostile foreign nationals—is somehow “unprecedented” and “unlawful” during peacetime.

Then he shoe is on the other foot and those complainants have to crowd to the USSC. If Roberts and Conway are determined to join the Leftist Revolution then let he "Constitutional Crises" proceed. The Constitution set up three equal branches of government. The judiciary branch does not rule over the other two. Judicial oligarchy is not specified in the Document.

I don’t understand the attempt to, as it were, establish legality for what he is doing. The Biden administration violated immigration law and brought them here illegally. So all Trump has to do is legally remove them.

Or, Trump’s lawyers should, as a third co-equal branch of government, inform the judge to establish where he gets his authority to rule on the case if he expects for anyone to abide by it. Trump is not some incidental defendant walking in off the streets.

A federal judge on Thursday dismissed indictments against 10 of 28 defendants in major drug cases because an FBI agent may have been involved in tampering with evidence including firearms and narcotics.

The FBI is investigating the alleged misconduct, according to court papers.

At a court hearing for four other defendants, a different federal judge said he will review the government’s plan to dismiss the cases without prejudice, which leaves the door open for the government to refile charges at a later date. In all, the government plans to dismiss 28 cases.

The U.S. Attorney’s Office for the District of Columbia says it is conducting a case-by-case review of matters in which the FBI agent played some role.

The government wants its cake and wants to “eat it too,’’ U.S. District Judge Richard Leon said of law enforcement officials trying to position themselves to refile charges. The judge said leaving the possibility of renewed charges leaves defendants with “a sword over their heads.’’ However, Leon also said the defendants are accused of “very serious charges.’’ For the time being, the defendants remain in custody. A hearing is set for Dec. 10 on the refiling issue.

U.S. District Judge James Boasberg dismissed indictments against 10 of the defendants.

According to court papers, the FBI notified the U.S. attorney’s office in Washington on Oct. 1 about possible misconduct by an agent in the execution of a search warrant on Nov. 20, 2013, at a residence and in a vehicle belonging to one of the co-defendants in Deale, Maryland.

In one case, 10 defendants were charged with conspiring to distribute more than 1 pound of heroin and more than 10 pounds of cocaine last year. In a separate case, eight defendants were indicted for allegedly conspiring to distribute more than 2 pounds of heroin in 2012.

The chief judge has sole discretion over sealed federal grand jury proceedings. That means Boasberg will immediately take over responsibility for handling certain issues that may arise in the special counsel investigations involving Trump, who in November announced he was seeking the 2024 Republican presidential nomination.

Boasberg also would assume the same responsibilities if a grand jury is formed in a separate special counsel investigation into President Joe Biden’s handling of classified documents after leaving the vice presidency. Biden, a Democrat, is expected to seek re-election in 2024.

As chief judge, Boasberg is poised to rule on certain legal arguments raised in the grand jury probes, including efforts to restrict witnesses from testifying. Grand jury proceedings are kept from public view.

In an interview, Boasberg declined to comment on his impending grand jury oversight duties. He praised his predecessor, saying the court was fortunate to have had Howell as its leader “in this very fraught period.”

“She’s led the court in a terrific way through COVID and dislocations, and she also has maintained a very cohesive court not driven by partisan divides,” Boasberg said.

Boasberg, an appointee of Democratic president Barack Obama, has served on the court since 2011. He previously was picked in 2002 by Republican president George W. Bush for the local DC Superior Court. Both times he was easily confirmed by the US Senate. . .

. . .Boasberg has faced tough assignments before. In 2020 and 2021, he presided over the US Foreign Intelligence Surveillance Court, which hears government requests for secret surveillance warrants. His tenure came after the Justice Department’s internal watchdog had highlighted failures in the department’s process for seeking the secret warrants.

Boasberg oversaw Special Counsel John Durham’s criminal case against former FBI lawyer Kevin Clinesmith, who pleaded guilty in 2020 to altering an email used to justify a government wiretap of former Trump campaign adviser Carter Page. Boasberg sentenced Clinesmith to a year of probation and 400 hours of community service.

After the 2020 election, Boasberg rejected a challenge by Republican state lawmakers and others who were contesting Trump’s defeat and had asked him to block congressional certification of Biden’s election win.

“Courts are not instruments through which parties engage in such gamesmanship or symbolic political gestures,” wrote Boasberg, who referred the lawyer behind the case, Erick Kaardal, to the court’s grievance committee for acting with “potential bad faith.”

As usual, more hack “journalism” from TGP.

Although I give them credit, as at least they posted a link to the complaint.

But hacks they are. Hoft openly writes that the Alien Enemies Act (AEA) is used during wartime.

Yet he hackily forgets to mention why a judge might issue a TRO.

And that’s because using the AEA in such a manner collides with the Immigration and Nationality Act (INA), which was passed in 1952.

And the INA gives limited due process rights to detainees for immigration matters like this (see Title 8 which deals in part, with deportation proceedings).

But Hoft didn’t want to write about that. Because it will upset the article he wrote under the guise of “news”.

Judge Boasberg set a TRO for 14 days so he can be briefed on this issue by both sides. Probably the most on-point case regarding the AEA is Ludecke v. Watkins, 335 U.S. 160 (1948) which held that the President did have the authority to deport a German national.

Please cure your ignorance and do some research. At the very least, stop looking to TGP for fair and balanced reporting. They do neither and are journalistic hacks just driving page views with ignorant, bombastic claims. Claims that the ignorant glom right onto.

Lastly, let’s not forget - immigration is a plenary power of Congress, not the President. Both the AEA and INA were passed by Congress and and signed by law by the President. But immigration law starts with Congress.
