Could Trump Plug the Anchor Baby Loophole?

If Donald Trump is elected in November (not a foregone conclusion) would he attempt to plug the anchor baby loophole?

That’s the insane policy by which babies born to illegal alien mothers on U.S. soil receive automatic birthright citizenship.

Thus, American nationality policy is taken from U.S. lawmakers and turned over to foreign lawbreakers.

To the jurisdiction of what government is that child subject? What does it mean to be subject to the jurisdiction of a government?

An illegal alien, or a child born within the borders of these United States to illegal aliens, who commits a crime within the borders of these United States will theoretically face trial for that crime in a United States or State court. The trial will be conducted according to United States and State law. Does that make the illegal alien or child thereof subject to the jurisdiction of these United States?

Precisely. Since when was it the intent of either the Founders or Jacob Howard that illegal aliens decide who the citizenry will be? We fought a civil war over “who’s a citizen”.

Territorially, yes.

Nationality, no. Foreign nationals are routinely brought up on charges and tried. Their nationality becomes an element of the laws applied and the disposition of their trial.

The authors of the 14th amendment make it clear that they meant subject to the total and complete jurisdiction of the USA. John Bingham even said what I have been using as my tagline since 2011.

No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

The actual text, in relevant part, of the 14th Amendment. Any law or policy must be consistent with it.

I agree that the authors did not intend to give citizenship to the offspring of illegal aliens. However, their explanatory writings were not adopted as part of the Constitution.

Yes, a footnote in the Plyler v. Doe case. That’s rather slim. What we need is an out and out decision on the specific topic.

Get Trump elected with majorities in both houses to pass federal legislation on the matter. An EO won’t work. He’ll need to address this with serious thought and negotiation to get it passed the courts.

Yes, unfortunately they didn’t include the explanatory writings in the 14th Amendment. I wish they would have. But to be fair they didn’t foresee how imprudent and suicidal their posterity would be.

That would be preferable of course, let’s see how this election turns out. But if he doesn’t have that, an EO issued in January of 2025 could get the ball rolling. It’s important to realize that no matter what is done it’s going to be a knock-down-drag-out fight to get it done.

Not so fast. Mexico intervenes on behalf of it’s citizens because Mexico has jurisdiction.
A child inherits the citizenship of parents. Child born on US soil to Mexican citizens has Mexican citizenship even if we give it US citizenship by statute as well.

Really? Mexico can petition the US Government to treat its citizens in a particular way, just as the US Government can petition foreign governments to treat US Citizens in a particular way. Ask Britney Griner how that works ... She's free ONLY because we had something the Russians wanted, and they were willing to trade. When you go to a foreign country, you're subject to ITS laws; IT will punish you if you break them.

What does jurisdiction mean? What jurisdiction does Mexico have in USA? What jurisdiction does USA have in Mexico? How is someone physically present in the USA NOT subject to the jurisdiction thereof?

The offspring of illegal aliens born in this country were not born ‘within the jurisdiction.’ They should not be issued a U.S. birth certificate.
