The California Supreme Court declared that law enforcement officers cannot detain individuals because they attempt to avoid police contact. This unanimous decision has stirred a significant response from police unions, who argue that it will hamper their ability to maintain public safety effectively.
The court, in a 7-0 decision, stated that actions such as appearing to conceal oneself or acting nervously do not alone provide a sufficient basis for officers to detain individuals.
This was elaborated in an opinion by Justice Carol Corrigan, emphasizing that while such behaviors could be considered within a broader context, they do not meet the threshold of “reasonable suspicion of criminal activity” necessary to legally detain someone.

Something odd is definitely going on. When I was a young man, all my interactions with the police were fine. Sometimes I got a ticket. Sometimes I just got chewed out. But the cops were never rude or abusive.
Now I’m an old guy. I say “hello” to a cop while standing in a fast food line with him. I get no response. Just a look like I’m the dumbest person on Earth.

I got pulled over by a sheriff’s deputy. He started calling me names and trying to egg me on. I just sat there and took the abuse. I wasn’t going to give him the satisfaction.
So if you’re walking down the street and you see a cop, so you turn around and walk away, and the cop yelled for you to stop. You’re okay with that.

Back to your point, our politicians are screwing over the cops. So they feel like they are American troops in Afghanistan.

No problems with Wyoming law enforcement since we moved to Wyoming. That’s been fifteen years now.

Yes. But the key phrase there is “breaking the law”. If you broke the law, you must show ID. If you have been lawfully arrested, you must show ID. I don’t think a single person here would disagree with that.
But just acting “suspicious” is not breaking the law. It is not grounds for detaining someone, or demanding ID. That’s why the 4A is so important. It keeps us from devolving into a “Papers, please.” police state.

I enjoy my legal rights. They are NOT “selective” as many would like to think.
This is a good step BACK to the presumption of innocence as it should be. In no way should citizens be presumed guilty until they prove their innocence. This is fascist ideology right there.
I think that tonight in Compton, Watts, and other less than savory parts of Cali, they’re probably having parties to celebrate that when they commit a crime, they’ll now NEVER be caught.
Evading is one thing. Eluding, or attempting to, is a felony in many, if not all, jurisdictions, and felony stops can get ugly.
I have been stopped on the street and told to put my cigarette out because she didn’t like cigarettes or smokers. Then she proceeded to ask for ID and “run me” with no probable cause of a criminal act at all.
You think this is perfectly acceptable? First it is a cigarette, soon it will be plastic cups... Enough is enough.
Here is the thing. As someone already mentioned. It is a deceptive headline. The content states “individuals because they attempt to avoid police contact.”...
Not “evading”. I’m sure it does not prevent officers from interacting if they have reasonable probable cause that a crime has been committed.
I was on a grand jury, long ago, and the cop being questioned had pulled a young girl over for a traffic infraction. She got pissy, and said she didn’t want to talk to the cop. She rolled up her window and drove home. He followed her...she drove slowly, and obeyed the laws of the road. When she got out in front of her house, he cuffed her, and read her her rights. It was pretty cut and dried...we issued a true bill for attempting to elude. It probably got tossed before it went to trial, but she probably learned something. Some of the cop shootings these days are from people turning near-nothing events into felonies.
