Special Counsel Jack Smith on Monday asked the US Supreme Court to weigh in on Trump’s immunity claims.
In September Trump was hit with 4 counts in Jack Smith’s January 6 case up in DC: Conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights.
Jack Smith is fighting to keep the March 4 trial date (one day before Super Tuesday) in his January 6 case against Trump in DC.
Trump’s lawyers argued that Trump is immune from federal prosecution for alleged ‘crimes’ committed while he served as US President.
On Monday, Jack Smith skipped over the appellate court and went straight to the US Supreme Court on Trump’s immunity claims:
QUESTION PRESENTED
Whether a former President is absolutely immune from federal prosecution for crimes committed while in office or is constitutionally protected from federal prosecution when he has been impeached but not convicted before the criminal proceedings begin.
“This case presents a fundamental question at the heart of our democracy: whether a former President is absolutely immune from federal prosecution for crimes committed while in office,” Smith wrote in the Monday filing.
Jack Smith is circumventing the appellate court and going straight to the US Supreme Court for one reason: To seek a conviction before the election.
Via constitutional expert Jonathan Turley:
“Special Counsel Jack Smith is now seeking to leapfrog the appellate court and ask for a ruling from the Supreme Court on Trump’s immunity claims. The only reason for this petition is to seek to guarantee a trial of Trump (and possible conviction) before the election,” Turley said.

The plan is to railroad Trump by jailing him and handing Nikki Haley the nomination. This is why the media has been showing her beating Biden by 17 points but Trump only beating him by 4 points. It’s a planned set-up.

The whole case is an outrage, as is the documents case, while they bring no charges against Biden and Pence.
They agreed. Reply by Trump before Aug. 21.
Jack aught quit it. He’s got many years ahead of him to comingle with the deplorable masses. That is unless he goes back to Belgium where he came from to hide out in perpetuity. Some World Court assignment being paid for by the American taxpayer.
All this accomplishes is to make Trump stronger.

Of course a sitting POTUS is immune.
Otherwise all living ex presidents could be prosecuted for violating US war crimes and torture statues.
Mad Jack has a deadline of December 15 to explain to the House Oversight Committee why he thought he had the right to bring these charges (he submarined it on to the NARA documents case).
That may lead to him being cut off financially or worse. It’s all an obvious abuse of power and in fact an arrogation of power he didn’t have.
So he’s gotta speed up the process if he can.
But the arrogance of demanding a hearing from the SCOTUS bypassing normal procedure is off the charts for this guy. He’s something unseen in American history.
If the Supreme Court says, yes, then Pedo Joe is in Supreme trouble.
He’s been committing crimes while we post.

Not a valid opinion. Nikki is not eligible, according to the constitution.
It would be hilarious if the SC decided he had immunity lol. Then what?
If Smith is asking for the Supreme Court to decide, it absolutely MUST be that he knows that the ‘fix is in’ and the S.C. will decide against Trump.
He wouldn’t risk it otherwise.
I think Smith is shooting himself in the foot here. If he let this play out, his handpicked judges would probably deny the immunity claim, and he’d get his convictions, and then maybe they would be reversed on appeal.
If the SC agrees to make a determination, and they side with Trump, which seems to be the most likely outcome, then Smith’s whole case is demolished and he’ll never get a conviction.
