California’s Ban of Gas-Powered Vehicles Likely Illegal, Unrealistic

California plans to ban the sale of gas-powered cars by 2035. In 2021, California required 12 percent of total new vehicle sales to be powered by batteries or hydrogen. By 2026, their goal is to reach 35 percent. By 2030, 68 percent. And in 2035, 100 percent powered by batteries or hydrogen.

President and CEO of the Allicance for Automative Innovation, John Bozzella, said:

“Whether or not these requirements are realistic or achievable is directly linked to external factors like inflation, charging and fuel infrastructure, supply chains, labor, critical mineral availability and pricing, and the ongoing semiconductor shortage … These are complex, intertwined and global issues.”

The Alliance for Automotive Innovation represents major automakers, so Bozzella’s statement should be taken seriously, as he notes that the ban on gas-powered vehicles and mandating people to drive electric vehicles would be “extremely challenging” for the automakers to meet the demands.

According to the Independent Women’s Forum, banning gas-powered cars is likely unconstitutional. Mandy Gunasekara states:

“First, it could violate the Commerce Clause as it creates unreasonable burdens on interstate commerce, i.e. the manufacture and sale of vehicles. The Supreme Court has long held that the Commerce Clause has been a “self-executing limitation” on the power of States to enact laws which restrict interstate commerce. Second, under the Clean Air Act, California is required to receive a waiver from the U.S. Environmental Protection Agency in order to set its own, more stringent, emissions standards.”

Gunasekara also mentioned that the ban is unrealistic. She said:

“California has pushed electric vehicles for decades through a variety of tax breaks and subsidies, only 12.5% of drivers own an electric vehicle. This is a higher percentage of drivers compared to other states, but 78% of EV owners also own a second gas-powered vehicle to supplement their needs. Even with major advancements in EV technology, the reality that recharging batteries takes hours, while filling up gas tanks takes minutes, is a leading reason consumers continue to prefer gas-powered cars. EVs are also very expensive with an average cost of $54,000, most Americans cannot afford to pay luxury-level prices. This is especially the case with growing inflation.”

Not everybody wants to drive an electric vehicle; even if they could afford one, they might prefer gas-powered or hybrid. That should the individual’s choice to make.

Gunasekara explained in detail that the ban would do little for the environment, saying:

“While marketed as ‘zero emissions,’ electric vehicles have a series of environmental tradeoffs. They require 10 times the amount of minerals in their batteries compared to gas-powered engines and the majority of these minerals come from Chinese controlled mines in Africa that disregard environmental protections and regularly use child and forced labor. Further, more expensive cars mean Americans drive older vehicles longer. This trend can undercut the reach and effectiveness of safety and efficiency improvements that come with newer models.”

“Finally, this push towards electric vehicles will require more energy on the grids. California has already struggled to meet current demand and a ban on gas-powered vehicles will only make their grid problems worse.”

Not to mention Californians being able to drive to a neighboring state such as Nevada, buy the car of their choosing, and drive back to California. This ban on gas-powered vehicles is flawed, unrealistic, and likely unconstitutional.

This should go without saying, but the local, state, and federal governments should not tell the American people what they can and can’t drive. Instead of forcing their wants on Californians, they should negotiate with China, the world’s biggest carbon polluter.

What the hell are they planning on doing with the bad batteries how are they going to dispose of them!!

So, let me get this straight. A state that has trouble supplying water, food and electricity wants all vehicles to be electric. The perfect storm.

Why do we think they’re “insane”? I don’t see any insanity in this. The government simply DOES NOT want people driving their own cars, or living in their own homes.

What they are doing is PERFECTLY RATIONAL to achieve those objectives.

The only ‘insane’ people I see in this are the people on our side thinking that Democrats share the same values as Americans.

I could be called a terrible person but I hope California goes ahead with this ban on gas powered cars, I want to see the utter chaos and disaster it creates and for California continue to turn into the hell hole it already is

If California and now Washington and Massachusetts successfully ban the sale of gas cars they will effectively nationalize the bans because the autocos will follow the California ban nationwide. It will render the green grid inoperative and crash the economy due to the newly erratic grid and to the inability to afford EVs as a huge percentage of employees will no longer be able to get to work.

The legal theory that this is unconstitutional is retarded.

Expanding the “Commerce Clause” to make reducing economies of scale unconstitutional is retarded.

If this is the case then there are no States Rights. None.

Southern States can’t have Dry Counties because it reduces the economies of scale of California wine. Increasing the cost to everyone else.

Banning Abortion reduces the Economies of Scale of the Abortion industry. Increasing the cost to everyone else.

Californians will be able to buy 2035 Model Year Gas cars out of State. They just won’t be able to register them in California.

15% of all cars sold in California in the first half of 2022 were fully electric.

35% in 2026. And 80% in 2035 is not unrealistic. Adoption of new technology is not linear. It is exponential.

In 2035 20% of an automakers sales will be allowed to be plug in hybrids. That get at least 50 miles of all electric range.

This carveout is for pickus/Suvs to be able to do long distance heavy towing without stopping to charge every ~100 miles. But it may be that battery tech improves enough this is not necessary.

I am sick to death of folks who don’t like what their state government is doing just talk of moving to a different state or just packing up and moving. That does not help your state. Why aren’t people standing up and fighting with everything they have whether Repub or Dem, to stop their legislature from pulling this crap? There’s people across the country who are fighting their local schoolboards or running to replace members of the schoolboards and they are winning!

The interesting thing, unless I’ve missed something, is the silence from automakers. It suggests that either a.) they don’t care, because they are on board (for what reason, who can say), or b.) know it will never be implemented.

I’d love to see CA just GIVE AWAY EVs... In a state where they currently have rolling blackouts every summer... Where their electrical grid is holding on by a thread... Where they take every opportunity to shut down sources of power... Where the state will need to subsidize thousands of high capacity charging stations for the people who don’t have garages...

As usual, blue-state pols who don’t think about the ramifications of their idiotic fantasies they foist on the public.

Yup—you can’t have a true third world country without a third world electric grid.

That means that the politicians and the rich zip codes get power while the peons live in slums with intermittent electricity at best.

The electric cars will only be able to charge in the wealthy districts so owning vehicles will not make sense for the peons.

For average folks it will be bicycles, horses and donkeys.

Hydrogen fueled cars will push the EV to the wayside China is already the leading manufacture of it for a reason many auto companies already have some on the road.

Jets and trains are converting over to it also time to get in the market.$$$$$$
