Put this in the KOOKY category. This leak is a full fledged leftist commie using the nuc option. You can bet on it. Investigations are normally conducted without broadcasting what they are doing.

Some how you know what Extremely Extreme Extremist was thinking?

The article in question: talked about a number of different issues releated to Lin Wood belief. One was China taking over the 2020 election. CGI used for 9/11. What trump was talking about regarding in his words "The Storm." (Wood) helps Liz Cheney.

For the record. I believe Lin Wood was right that the election of 2020 was stolen by foreign operators.

At first, I thought it might be Breyer, who is leaving the court at the end of this month and wouldn’t have to deal with the other justices in weekly conferences.

However, as time has gone on, I feel strongly that it was Roberts, who doesn’t want to see Roe v Wade overturned on his watch. That would hurt him in his social circle, which includes partners in the Hogan Lovells law firm (the biggest in DC) and other various liberals.

It doesn’t make sense.

If this was in fact the source, the fact of Roberts (or someone from his office) being the leaker would quickly become a bigger story than the leak itself, and one that the libs could capitalize on even more because they would then rush to impeach him for leaking and the GOP would have the Hobbsian choice of defending Roberts or allowing Biden to seat another Supreme Court justice. Roberts would know not just what he was doing but how it would be perceived, and that it would end his career in one of the most shameful ways possible. Why in Heaven’s name would Roberts endorse his own removal from office in disgrace?

Further to this, the journalist who initially brought the story has documented links to at least one current SCOTUS clerk, possibly two, who would make much better candidates to be the leaker. Even if those two aren’t the real leaker, the ideology of those two clerks is hard left, meaning the journalist is hard left himself in ideology and not the type of guy a centrist/right leaning justice would be regularly relying upon for confidentiality.

A question I can't answer is if it wasn't Roberts, then why did Roberts rush to verify the alleged draft as "real"?

I can see no purpose to verify the leak other than to add weight to the story.

The votes of the justices at conference are not final. The draft opinions are not final. The entire process is much more amorphous than what goes on in a Senate or House cloakroom.

At conference, the judges vote on the case. The senior justice in the majority assigns the opinion. That Justice gets a first shot at creating a draft.

That draft is circulated amongst the other Justices. What the author of the opinion wants, is a written note back that says the other Justices who have read the opinion join it. In many cases, that isn’t always immediately forthcoming. They may respond with something like “I will wait on the dissents and concurrences” they may respond with “Change this, this and this and I can join.”

The opinions are written, rewritten and rewritten again as the Justices negotiate amongst themselves. Sometimes, during the process, a Justice switches their vote, and what was going to be a majority becomes a dissent or a concurrence.

The opinions (and votes) are not final until the opinion is released for publication. Then and only then is it posted on the Court’s webpage and recorded in the Reporter. That only happens when the majority opinion AND all dissents and concurrences are finished.

There is a final deadline (the last opinion day), but everything is pretty much open until then. What is most likely going on right now is waiting for a dissent (or multiple dissents) to be finished.

The majority author will often address the dissenting Justices in the majority opinion. Notice that this is missing from the Dobbs draft.

I can GUARANTEE you that it will probably have changed from what Politico posted. How much remains to be seen.

In all of this, the Chief ... Justice ... Does ... NOT ... CONTROL ... WHEN ... OPINIONS ... ARE ... RELEASED.

Certainly not beyond the realm of possibility, but I think it was the staffer that has spent their academic and work career focused on abortion.
There was a very persuasive twitter thread laying out the case.

As bad as Roberts is, he knows that the reputation of the court is directly tied to his stewardship. This leak severely damages the court, and he would never do it. However, it is very likely that he will do everything he can to bury the story of the leak in order to minimize the damage. He’s probably hoping it will be long forgotten once the decision becomes public..

The Chief Justice has more control over what happens at the court than any other justice. It sounds like this will be a 5-4 decision, with Roberts concurring in part, but mostly dissenting at how sweeping the majority's opinion is. He is certainly doing all that he can to drag this out.
