Here’s is Chief Justice Roberts’ problem: he is now part of the minority. His 1-to-4-to-4 decision salvaging Obamacare will be next. Roberts will go down in history as a particularly ineffective Chief Justice.
Consider Chief Justice Earl Warren. He too was a liberal Republican, but he strove to get a 9-to-0 vote in Brown v. Topeka Board of Education. By seeking consensus in ending segregation, Warren played a key role in the civil rights movement.
Roberts is no Earl Warren. Roberts could have bargained with the conservatives to fashion a decision with softer language in return for his vote. But, it appears that he choose, instead, to make the decision overturning Roe into a 5-4 decision.
Having said these things, we are only dealing with a leaked draft of a majority decision, and - there being no precedent to the leaking of such things - we don’t know what may transpire before the actual decision is released.
Cases like this leads me to believe that the so-called moderate judges pre-determine the ruling that they want and trade off being the deciding vote. This allows them to distribute the criticism.
