White House Calls on Businesses to Ignore Supreme Court Decision on Vaccination and Force the Vaccine Mandate Regardless of Constitutional Merit

Not to be deterred by such pesky inconveniences as a Supreme Court decision, immediately after the high court ruled the vaccine mandate was unconstitutional federal overreach – the White House told employers to enforce the vaccine mandate anyway.

White House Spokesperson Jennifer Psaki said the Biden administration would “not be deterred” by the Supreme Court decision, and all employers should immediately continue to “initiate vaccination requirements.” WATCH:

Not really. The only thing before the court was whether OSHA could force businesses to mandate a vaccine.

OSHA can’t.

Private businesses are private actors. If they initiate their own vaccine mandates at the powerless urging of China’s puppet, it’s not an issue of Constitutional law.

States can pass their own laws to prohibit businesses from mandating (Montana has) but absent a State law (or a contract issue) to the contrary, private businesses still have the option of requiring their own mandates. I’m
Sure the most work companies are going to keep mandates in place.

We do need to be more informed as a group as to what is happening.

Just OSHA can’t do it without updated legislation.

I actually don’t have a problem with the ruling. This allows the lunacy to continue, without a bailout by judges.

But private companies can be sued by employees and those private companies could then sue the Fed Gov for coercion?

The funny thing is that if the mandate is found to be unconstitutional and illegal, which I strongly suspect, employees can now sue the employers for the illegal actions of the government because they have no qualified immunity.

No. It doesn’t work like that. The President can use the bully pulpit to urge all that he wants.

OSHA was the coercion (the proverbial gun) so to speak. Now it’s just words from the President.

Companies can say “no.” They can say “yes.” They can do what they want subject to law and contract.
