Report: Democrat Back-Up Plan Might Still Bar Trump From Running Again If Impeachment Fails

Congressional Democrats are reportedly considering a back-up plan – a censure resolution against Donald Trump should this week’s impeachment trial result in acquittal for the former President.

The resolution, according to McClatchy, would bar Trump “from holding future office over his role in the U.S. Capitol riot.”

...

The Democrat attempt to censure Donald Trump – who is now a private citizen – would invoke Section 3 of the 14th Amendment.

It is a rarely cited Civil War-era provision that bars people from holding office if they “have engaged in insurrection or rebellion” or “given aid or comfort to the enemies thereof.”

All this chatter...forces people to re-engage on the Civil War, and the decade after it ended. It’s something refreshing and we ought to welcome the discussion. But it’ll screw up the Democratic ‘theme’, because the folks who got punished after 1865...were all Democrats.

It’s still a bill of attainder: only a court, not the Congress, can make such a determination.

Please elaborate.

This wasn’t used against J. Kerry when he ran for President. Kerry met with the actual communist enemies in Paris as an Officer in the military.

Democrats reportedly have a major backup plan if their effort to impeach Trump fails.

Why didn't they just do that in the first place? This whole thing is a sham.

Stacey Abrams has been squaking about voter suppression since she lost the race for governor. The democrats cry voter suppression whenever they lose. What they are planning to do when they lose the impeachment trial is true voter suppression of the first order. They plan to try to use the 14th Amendment of the Constitution to keep the American people from voting for Donald J. Trump in 2024 without the cheating because they know he would win big. If they do, I will never ever again vote for any democrat!

Well if were to believe this is a legitimate proceeding (we dont-they do) and the outcome is acquittal then there is no insurrection...so no grounds for the the backup plan.

If that fails, they will think of something else.

It is ludicrous to claim that he "incited" an insurrection. But he did not go to the Capitol in person. How can he be held to have engaged in an insurrection or rebellion?

I guess a local jury could be found in DC that might vote to convict.

Exactly. If he is not convicted in the sham impeachment trial, then he is obviously not guilty of “have engaged in insurrection or rebellion”. They prove once again that they have zero concept of what our Constitution says, means of stands for.

I agree with your comments...IMO, President Trump is wisely waiting for the current impeachment fiasco to end before announcing any definitive plans. I will support him whatever he decides to do. But I hope he will turn most of his attention to backing primary candidates, in his mold, to oppose Rinos. And, IMO, leading election reform efforts, especially in Pennsylvania, Georgia, Michigan, Wisconsin, Nevada and Arizona, is also a crucial role for him.

If he could manage it, I would like to see him treat Rat leadership with disdain; but not waste too much of his his time with verbal responses to their treachery and ignorance. A cryogenic plate full of revenge in the form of younger, Trump style primary candidates is just what the likes of Liz Cheney, Kinzinger etc. need crammed down their throats.

They are miserable they can’t destroy Trump and they are running out of options and now out of an all-consuming venom they are reaching for straws. They are eaten alive by their insane, irrational passion. I’ve never seen so much vicious hatred and bile. I’m hoping it destroys them.

It won’t. The Dems never get bit by anything. They dominate the government, they own the media, they own the courts, and the Repukes are afraid of them.

Agreed! The Rules apply to Thee, but not for me.

If he actually just lost to the worst candidates in the history of the country... why are they worrying about whether he will run again? To me it seems like they know that they all just sucker punched him from behind and they fully expect him to come back stronger than ever and give them a beating like thay have never experienced before.
