Fraud, Evidence, Proof, Power
American Greatness ^ | November 23, 2020 | Angelo Codevilla

...Now, black letter law....

The Trump campaign are plaintiffs. They have no obligation to prove anything. Nor do they have the power to subpoena things, documents, and persons, nor to compel testimony that might be dispositive regarding the sufficiency of fraud. Nor do they have the right to adjudicate disputes any more than the press has the right or power to do so.

The plaintiff’s only burden is to establish in the minds of persons who are empowered by law to subpoena evidence, compel, testimony, etc. what the semi-sacred words of American law call “probable cause” that fraud may have been committed. These persons are courts, principally federal, as well as state legislatures that possess investigative powers, as well as the U.S. Justice Department. These institutions (other than Justice) are also the only ones that have the right to decide what constitutes sufficient proof of what.

The Trump campaign has spoken in ways that suggest that it can prove fraud. It cannot. Not as a matter of law nor, given its lack of subpoena powers and compulsive power, can it do so as a matter of fact. Giving that impression, it has tended to discourage the persons who should be seized by their duty to follow “probable cause” of fraud—and there is plenty of that.

The courts, historically, have been as partisan and as corrupt parts of the establishment as any other. Like others, they tend to decide without giving reason or trying to convince. But there is a hierarchy in courts. And at the top, the Supreme Court is under the greatest pressure to rule in a manner that tries to convince Americans that justice is being done.

Usually the Supreme Court refuses to act as a trial court.....

Phill Kline, former Kansas AG, just outlined all kinds of mischief concerning changing votes since legal action began.
asked by Bannon why machines etc haven’t been seized. said some machines are in custody but he can’t say more for now.

I would think that the witnesses she has for her own fraud cases could also be called as witness for the cases that Trump’s attorneys are working.

A witness to fraud is a witness to fraud is a witness to fraud....

What good does it to have “probable cause” in this case when you can’t provide the proof.

You have to prove with facts that they’re enough significant illegal votes to overturn the election otherwise all you proven is there’s illegal votes... which happens every election.

I think that the lawyers have a better sense of what fraud is and how to prove it than bloggers and self appointed experts that have no background in law. The courts are in place to sort things and tell if there was fraud.

Bannon just asked Kline if the machines seized by law enforcement were for investigation or, I think, to prevent further tampering. (I wasn’t listening carefully).

Kline said he couldn’t say, but then said “for investigation”.

someone else may have the wording more accurate than I have.

That is said about fraud and every other issue of law. But then, the creme de la creme, the SC itself, "sorts it out" in accordance with each justice's obvious political, philosophical idiosyncrasies.

And undoubtedly reset the machines’ algorithms so there will be no evidence of tampering. It’s pretty obvious that the alphabet agencies have been bought. Soros should have taken out long ago.

So, The plaintive files a complaint and gives evidence to support that complaint.. (?)

The court examine the evidence (maybe) and decides if the complaint has grounds and if charges are warranted.. (?)

If the court indeed finds grounds for the complaint then the case is giving over to the "Prosecutor", (maybe) (?)

Considering the VAST numbers of liberal (commie) judges in the courts, and how many prosecutors did they say Soros bought.?? I think we stand about as much of a chance down at the courthouse as a paper shirt in hell... :(
