U.S. CITIZENSHIP AND IMMIGRATION SERVICES HAS ANNOUNCED THAT ANY “INTENDING IMMIGRANT WHO IS A MEMBER OR AFFILIATE OF THE COMMUNIST PARTY OR ANY OTHER TOTALITARIAN PARTY (OR SUBDIVISION OR AFFILIATE), DOMESTIC OR FOREIGN, IS INADMISSIBLE TO THE UNITED STATES.”
The policy change, occurring October 2nd, would therefore apply to members of the Chinese Communist Party.
The Trump administration’s Citizenship and Immigration Services (USCIS) outlined the policy change, citing affiliation with a “Communist Party or any other totalitarian party” is “inconsistent and incompatible with the Naturalization Oath of Allegiance”:
“On Oct. 2, USCIS issued policy guidance in the USCIS Policy Manual to address inadmissibility based on membership in or affiliation with the Communist Party or any other totalitarian party. Membership in or affiliation with the Communist Party or any other totalitarian party is inconsistent and incompatible with the Naturalization Oath of Allegiance to the United States of America, which includes pledging to “support and defend the Constitution and laws of the United States.”
“In general, unless otherwise exempt, any intending immigrant who is a member or affiliate of the Communist Party or any other totalitarian party (or subdivision or affiliate), domestic or foreign, is inadmissible to the United States,” the press release continues.
Simply enforcing the laws enacted by Congress: “Any immigrant who is or has been a member of or affiliated with the Communist or any other totalitarian party (or subdivision or affiliate thereof), domestic or foreign, is inadmissible.” 8 U.S.C § (a)(3)(D).
Now, if they would just pass another law revoking the citizenship of any Communists already here.

Sounds to me like you rolled the dice and lost. You might look into annulment given the circumstances though, so you don’t have to argue over assets. (Not a lawyer)

I spent thousands to get her here and this is the outcome. I never seen this coming. All this came out the same day she got her green card while gaining the benefits of a spouse of a retired military person. BS.

Sorry to hear what you had to go through. If you truly don’t know what to do, it means you still love her and no doubt she had been counting on that when she tried to convince you to go along with her plan.
Now you must decide whether to face the harsh reality head-on that you had been used and take decisive action to end the deception once and for all, or allow her to continue to manipulate your emotions so you end up rewarding her behavior while she continues to take advantage of you. The choice cannot be clearer to an impartial observer.
I suggest you contact the office where you petitioned for her to come to the country, tell them what had happened, and ask that her green card be cancelled. They have the power to review any case and take away someone’s green card if they determine it was obtained through fraud or abuse of the system, which it clearly is in her case. And they will give you some idea of what you should do next.
