BREAKING - Judge rules in Bailey's favor; Illinois State Rep. Files Lawsuit Against Gov Pritzker Stay at Home orders
More details to come ...
Illinois State Rep. Darren Bailey (R-Xenia) filed a lawsuit Thursday against Governor J.B. Pritzker for a violation of civil rights.
My lawsuit asks the court to find that Gov. Pritzker overextended his power by issuing additional stay at home orders after his original disaster proclamation, which expired on April 9th, 2020, said Rep. Bailey.
"While special emergency powers were granted to the governor through the Emergency Management Act in the late 1980s by the Illinois General assembly, the unprecedented power and authority he wields under the current crisis calls for an immediate review and reconsideration of legislative intent," Bailey said.

He asked, Does the Governor have the right to shred the Constitution for longer than 30 days?
Judge took offense that Pritzker laughed off a question about downstate.

Irresponsible, reckless, ignores the law, science and medical experts so that one grandstanding legislator can get a few press hits. An absolute disgrace. The state will appeal immediately and work to protect the many, many lives we are entrusted with.
That can't be real, can it?
No doubt the Ill SC is a bunch of rats so not much hope for a good outcome there.
Won’t last. The State will not be denied
“The state will appeal immediately and work to protect the many, many lives we are entrusted with.”
This was not in the article.
Whose lives are entrusted to you?
As of this morning Maryland had a total of 31 deaths in 14 (~2/3) of its counties yet the governor will not do anything different about the outer counties than he does for the far more heavily populated central counties from Baltimore to DC.
It was added from another blog.
Seven member Illinois Supreme Court has a 4-3 Democratic majority.
I haven’t yet heard anyone make the argument that these orders constitute an unconstitutional taking. If I own a legally operated business and these governors force me to close, isn’t that a governmental taking for which I must be compensated under the Constitution?
Time to cram some state and low-fed level potentates back under the rocks from which they slithered
IMHO, of course
Yes! I posted earlier that these challenges should become national and that legislatures should be demanding to strip governors of these sole and individual powers to shut down their state (sometimes even declaring themselves medical experts!). Everything should have to be approved by the state legislature first, it should not extend beyond two weeks, and it should not be renewable without another application.
Well there you go. Rat judges never betray the cause, never.

A priceless reaction from the Czar and Supreme Autocrat of Illinois, the Honorable J. B. Pritzker:
People are in danger as a result of this ruling of the judges ruling of the suit that was brought by (plaintiff) Darren Bailey. We certainly are going to act in a swift fashion to try to have this ruling overturned, certainly put a stay in place.
I mean its frankly, its insulting, its dangerous. And peoples safety and health has now been put at risk. There may be people who contract Corona virus as a result of what Darren Bailey has done now.
BUT GOD!
There are several legislators in Southern Illinois who are AWESOME!
Darren Bailey— Chris Miller—Brad Halbrook
They remind me of Shadrach— Meshach and Abednego and they all have Strong Christian Values to boot!
Much Appreciated.
>>>I havent yet heard anyone make the argument that these orders constitute an unconstitutional taking. If I own a legally operated business and these governors force me to close, isnt that a governmental taking for which I must be compensated under the Constitution?<<<
Lucas v. South Carolina Coastal Council from about 25 years ago said that when the state forbid construction on beachfront land the owner was due compensation. However that was a 5-4 US Supreme court decision that overrode the State of SC Supreme court. Who knows how today’s court would rule.
Yeah, everybody is going to get it eventually. Apparently democrats are so stupid they think that lockdown will magically make the virus disappear, if we just wait long enough.
I have no doubt he believes it.
