In an October 29th speech to a small gathering, Publius Huldah discussed her perceptions of the dangers posed by an Article V Convention of the States to propose Constitutional amendments. After viewing the entire talk, I understand why the leading figures of the Convention of States movement (COS) havent responded in depth to her various accusations. Her conclusions are often at the fringes of reason and she carries a deep and personal animosity to the leaders of the COS. Since the COS leadership choose not to address most of her accusations, please allow me, your humble blogger, to take up the mission.
On the bright side, I am better acquainted with the usual talking points of COS opponents which Ive read in endless repetition at conservative websites. If her arguments are swallowed whole, without knowledge of certain points in our history and tradition, the hostility of her adherents is perfectly logical. Publius Huldahs impact is significant for those who rely on her views and nothing else. Do not underestimate her influence. Ms. Huldah admonishes her followers to:
View COS supporters as conspiratorial enemies.
Just obey the Constitution as written.
Restore morality.
Support state nullification of federal laws, regulations, and scotus decisions.
Mix her talking points, let them ferment, and Ms. Huldah presents a powerful and heady brew against an Article V convention of the states. The foundation of her argument is a conspiracy in which nefarious groups, foreign and domestic, work toward our demise. The means to their ends is the Article V state amendments convention. Since COS supports an Article V convention, its leaders must be part of the scheme, and the many thousands of COS volunteers are simply ignorant dupes.

To redress the balance of powers between the federal government and the States, the following amendment is proposed:

Upon a majority vote in three-fifths of state legislatures, specific federal statutes, federal court decisions and executive directives of any form shall be repealed and made void in any state, territory, or possession of the United States.
Section 2.
State legislatures in agreement with results derived from Section 1 of this amendment shall sign a state quash authority directive delineating the specific federal statutes, federal court decisions or federal executive directives affected, said directive addressed and delivered to the Congress of the United States becoming immediately effective as of the date of delivery.

IMPORTANT NOTE: These illustrations are written in a manner that THE STATES ARE GIVEN RESPONSIBILITY AND AUTHORITY. Amendments should be written so that it is clear that the federal government has no mandate regarding the interpretation or selective enforcement or non-enforcement of these types of amendments.
For example, the flawed 10th Amendment leaves all powers not enumerated in the US Constitution to the States or to the People. However, there is no mechanism left to the states to check the federal government with the 10th Amendment save for the appointment of US Senators by state legislatures which was abolished under the 17th Amendment. As it is, the 10th Amendment jurisdiction is left to the federal judiciary without any voice or role for the States. The result of these compounded errors has yielded a highly centralized federal government whereby power is attained by an enormous federal government and funded by the Federal Reserve.

Enforcement of federal tax liabilities shall cease as of January 1, 2025 with exceptions granted to active judicial proceedings initiated before January 1, 2025.

By ‘Age Of Awareness’ means technologies of connectivity. These technologies did not exist in the 19th century nor st the time of the 1913 installation of the 16th Amendment. Had such suitable technology existed, the 16th Amendment would never have been installed. The 16th Amendment is in fact, a poorly designed instrument proffered by persons of poor judgment, lacking requisite information or awareness of purposes behind the original federal design. It is completely unsuitable in our Age of Awareness.
The 16th, 17th and 18th Amendments are all of the year 1913 and were all done in the era of Woodrow Wilson who either advocated for such amendments or failed to thwart their passage. The 18th was repealed but the 16th and 17th evolved slowly.
The 16th was particularly insidious as its original code was only 14 pages long and imposed a ‘Flat Tax’ rate of 7% on the wealthiest 2% of Americans and a rate of only 1% on the rest of Americans.
The ‘1%’ rate is still used to this day in attempts to impose a state income tax in states where no state income tax exists. The ‘1%’ rate appears innocent, non-threatening, innocuous. It is a backdoor quiet entry to grab power and control. Once inside the system it grows and creeps until it resembles what exists today. Therefore note, any INCOME TAX is a cancer because it is impossible to contain over time. It gives legislators a tool by which they can grab and solidify their own power (legislative angiogenesis).
There is a vastly superior alternative to the income tax. A consumption tax with impact floor is embodied in H.R. 25. Its superiority to any income tax scheme cannot be overstated.
Fearing an Article V convention of states is inappropriate. It amounts to not trusting, as they were called by the founding fathers, the “people”. Jefferson would be horrified!
We have lost the single most important working principle behind the document and its philosophy of governance, the actual representation of the people. Returning to the constitution as written must mean one representative for every 30,000 persons!

The 30-state quash amendment discussion is from The Liberty Amendments. But it was not born there. It provides a further check by state legislatures on federal government abuse of authority.
Had something like it been in play in the 1960s and 1970s, the Great Society, Roe V. Wade and so much more would never have seen the light of day.
30 state legislatures means 60 state legislative chambers (or 59 if Nebraska is in it). Such a high bar is hardly susceptible to abuse. It simply means that if people are frustrated with federal government abuse and their US Senators are not paying attention, then they have recourse via state legislative action.

I like this. I have only in the last month become familiar with the Article V Convention of States. I’ve registered online with Convention of States website and been notified of a gathering next month that I plan to attend. Can you tell me if this is the proposed language or is this your own? I am very much in favor of your wording.

Also, you might contact the Trump Campaign and ask for a LIAISON to communicate back and forth on Trump’s call for a Constitutional Amendment for Term Limits. Because everyone knows the Washington swamp will never pass term limits.

I found CoS thru these Article V posts here on FR. Have been spending a good part of my spare time reading all articles under the Convention of States tag here but still catching up. Thank you again for the links.
We k now the politicians aren’t going to do what’s necessary, so what do COS opponents propose to correct the system?
I don't think there is anyone here who would disagree with that. But given the political Establishment's long record of just ignoring it and de facto overriding it, how do you propose that we get our leaders to obey it??
At least Article V gives us a method, and one provided for within the Constitution.

For those who think the Article V process is too risky, I ask, "What other options do you see?"
To summarize from a previous post by GraceG:
1. Elect More Republicans - Failed due to RINO/Uni-party confluence.
2. Article V Convention of States to propose Amendments - Needed to try to take power from the federal government back to the states and reel in the federal leviathan.
3. State Nullification - Last ditch effort to try to take power back from the federal monster, though by this point it may be too late.
4. State Secession - Could either end up peaceably like the breakup of the Czechoslovakia in 1993 or a brutal:
5. Civil War II like the first one.... The longer we wait on #2, the more likely #3, then #4 and finally #5. .
So, do we do nothing and just wait for # 5?
Quick review: We need 34 states to pass an application, then Congress shall, by law, call a Convention of States as soon as it receives applications from 2/3 of the State Legislatures. That's 34 states. (So far both legislative chambers of 6 States, {Alabama, Alaska, Florida, Georgia, Indiana and Tennessee}, have completely passed their resolutions and 36 state legislative chambers or bodies have filed or passed resolutions.) Amendments are proposed and voted on at the convention. Each Amendment must be ratified by 3/4 of the states in order to become part of the US Constitution. That's 38 states.
There are multiple arguments against a COS. Do not be dissuaded. In reality, there are so many checks and balances against a runaway convention that the risk is near zero. As nathanbefored said, It requires only 13 statehouse legislatures from 13 different states out of 99 legislatures in 50 states to block an amendment. The problem is not a runaway convention, the problem is getting any amendment through."
