9th Circuit Court Would Likely Keep Cruz Off Ballot

Those who think Sen. Ted Cruz can be elected to a job he isn’t eligible for are ignoring the 9th Circuit Court of Appeals in San Francisco. If Republicans make the mistake of nominating Cruz for President of the United States, Democrats in California and other states will challenge his eligibility. There’s at least a 90% probability the 9th Circuit Court in San Francisco would rule him ineligible because he is a naturalized citizen rather than a “natural born citizen” as required by the Constitution.

He didn’t start it! He just said Cruz’s “condition” was precarious, and that Cruz should get it settled. Completely reasonable.

This isn’t about Donald trump. it’s about Ted Cruz. This issue will never go away for him. You have been manipulated by Ted Cruz. He’s a manipulating genius. There’s no doubt about that. I’m sure he convinced you to send him money and, in so doing, he bound you.

Did the child renounce his us citizenship? No- the only way to lose NBC is to renounce your citizenship and declare allegiance to another country - that child is always a US citizen until they themselves decide they no longer wish to be-

Cruz is a natural born citizen. Period. End of story.

You don’t know that Ted Cruz is NOT naturalized?

He is not naturalized.

When he was born, under the law he was a citizen due to his mother being an American citizen.

If you are an American citizen at birth, you are not later on to be naturalized.

Only non-citizens have to be naturalized.

they would have to go through an act, a process- to renounce their citizenship- that is the only way they can lose their NBC status- Courts can not take that NBC away from them- just as a non citizen would have to go through an act, a process to gain citizenship- that is what separates NBC from non NBC- when a process/act takes place- Since Ted and McCain, and George Romney didn’t have to go through a naturalization process- they are considered NBC and always will be until they renounce their citizenship

This whole crop of top tier candidates are a sorry bunch. Too many problems, too little character, experience and control. Gilmore’s a veteran, a former prosecutor and worked in counterintelligence. He’s more qualified than any of them and maybe all of them put together.

Ah, but that leads to a very interesting question. Can a person be a natural born citizen to two countries at the same time? Can you be both a NBC of Canada and a NBC of the US?

I say no. But I suspect I'd be overruled by folks in black robes who went to law school while I was working in a steel mill.

There is a unique case where their is ‘reciprocal citizenship’ or soemthign like that, but it has to be with just certain countries I believe and meet certain requirements- it’s a special case- but it still has to meet the requirements for citizenship here first, and as US sovereigns, US law rules-

I’m not sure what the law would be for a person who has dual citizenship for running for president- but that’s not the case with Ted- Ted’s mother was a US citizen, His father had met the residency requirements I n the US before Ted’s birth, and as such Ted is a US citizen NBC

I remember back in the 1990s (or thereabouts) some guy on death row was to be executed. The 9th Circuit Court (under orders from the ACLU, as I recall) stopped the execution. They were overturned (in more-or-less real time) by the Supremes. The 9th Circuit Court then overturned the Supreme Court and halted the execution again. The two courts reversed each other at least a couple of times until finally the Supreme Court came down on the 9th with some sort of legalistic hammer big enough to strip them of any authority to continue ruling on the case.

You are simply wrong.

American law defines an American citizen at birth.

Canada can break off and fall into the ocean for all they have to say about the definition of an American citizen at birth.

There is no such thing as a quid pro quo. There is a chasm between their law and us once our law has spoken. It does NOT work the other way. If you don’t understand that, I can’t help you.

Any country in the world can claim anything against American law. If our legal system has set the standard then it is our standard we recognize here and not another country’s standard.

All of this is silly, anyway.

Canada is not trying to claim that their laws whatever they might be are controlling over our laws concerning our definition of natural born Americans.

Go ahead and TRY to make them equal in our eyes. Try to make our legal system get all hung up over what Canada or any other country in the world claims - if they even do, which in this case they really don’t care. Do you see Canada going to court in America, or demanding that Americans go to court in Canada, or going to some kind of international court, and trying to enforce Canadian law over American law in the case of someone’s citizenship.

No, you do not see that.

It doesn’t happen and isn’t happening and won’t happen.

don ‘t quote me on that- I just skimmed the headliens and could be mistaken- it was on FR a day or so ago- might have been just the caucus panel that declared him eligible but for some reason I’m recalling it was a court- but I could be wrong on that

That would be a humane, and very reasonable, thing to do. My only concern, as I have mentioned before, is that of first loyalty. If by some quirk a person were a NBC of two different countries, would that affect his world-view? Would he show favoritism to his second home?

Quite possibly.

All of this is rather moot when it comes to Cruz. No one thinks he'd betray the US to Canada. Yet the NB clause was put in place specifically to prevent any such possibility.

Garbage basis, but the 9h Circuit is a liberal court that might do anything. That is reason to vote FOR Cruz, not against Him.
