The question isn't one of his preferences or beliefs, and if you make it one, he will use 'persecution' for those preferences or beliefs as a defense.
Instead, the questions are:
Why was the train going 106 mph there??
and
Why did it take so long for the engineer to hit the brakes?
Stick to the basic problem unless other factors contributed to it.

Just out of curiosity, why is an Amtrak locomotive capable of reaching speeds of 107 mph? And what is the highest train velocity legally allowed on Amtrak’s rails? Somehow, I’m thinking that locomotive has more performance than common sense would require...
