The Constitution requires that for you to be eligible to be president, both of your parents must be naturally born citizens. You do not meet that qualification, if I am wrong please straiten me out. If you get the nomination I promise you the democrats will do what the republicans are too scared to do.
Dear Ted I think you are awesome but we all need to know the answer to this.
There are two parts that must be fulfilled for a child born on foreign soil to be a US Citizen.
One parent must be a US Citizen and that parent has to have resided in the US for (I’m not sure of how many) some years after the age of 18.
Obama’s mother was only 18 years old when he was born. Had he been born on foreign soil, she’d have been too young to convey citizenship.
Not the case with Ted Cruz.
http://en.wikipedia.org/wiki/Ted_Cruz
“Since Cruz was born in Canada, commentators for the Austin American-Statesman and the Los Angeles Times, have speculated about Cruz’s legal status as a natural-born citizen. Because he was a U.S. citizen at birth (since his mother was a U.S. citizen who lived in the U.S. for more than 10 years as required by the Nationality Act of 1940), most commentators believe Cruz is eligible to serve as President of the United States.”
Cruz was a Citizen at birth. If the consensus here is that the term “natural born Citizen” is equal to the term “Citizen at birth”...I would disagree.
Why are they equal?
Very good knowledge base. You did better than I did.
Personally, I do believe that he was born in Hawaii. I also believe that he lied about being a foreigner to get money for college and any other perk that he could get his hands on.
I believe that this is why he had his school records sealed. He’s covering up the fact that he’s a liar and a fraud.
Has anyone actually clicked on the CATO Institute link provided by Timber Rattler-—originally provided by JimRob?
Post #22. The issue should be settled for you.
That you, Lizzie? Go back to Bah-stan.
So if your great great grandfather immigrated from Ireland and became a naturalized citizen then neither you nor any of your descendants would be natural born citizens?
I’m not sure you realize how much your definition shrinks the potential presidential pool.
Cruz was a citizen at birth by law. This is not significantly different than the 1790 Naturalization Act, the very first law about birth citizenship after the Constitution was written. That law was not vetoed by George Washington who presided over the writing of the Constitution. He agreed that the child of at least one US citizen was a citizen at birth.
“What is the title to my post? a question?”
That’s laugh out loud funny.
You can’t even get your own title correct.
It’s an open request.
A request is not the same as a question.
The Constitution requires that for you to be eligible to be president, both of your parents must be naturally born citizens.Oh, if only that were so, but it's not. Perhaps that is your opinion and I surely wish your opinion was the official definition. However, in spite of your sincerest and noblest intentions, opinions vary.
Until the courts, or congress or an amendment codifies the definition, then so long as one parent is a US citizen, then the child is a US citizen regardless of birth location. To bolster that position, we only have to look to Obama as the precedent President. Heck, you can even present a fabricated/questionable birth certificate to prove it!
You should see my previous comments on the meaning of “MY Opinion”.
Websters dictionary in 1828 listed one the definitions of “Natural” as a Noun. It said:
2. A native; an original inhabitant.
..... what if the father was not known and the mother is natural born.
James Madison: “The father of the Constitution:”
In a speech before the House of Representatives in May of 1789
It is an established maxim, that birth is a criterion of allegiance. Birth, however, derives its force sometimes from place, and sometimes from parentage; but, in general place is the most certain criterion; it is what applies in the United States. It will therefore be unnecessary to investigate any other.”—Abridgment of the Debates of Congress, from 1789 to 1856 From Gales and Seatons Annals of Congress; from Their Register of Debates; and from the Official Reported Debates, by John C. Rives By United States. Congress, Thomas Hart Benton
IMO it would have been inconceivable for the constitutional congress to intend that a person born of a British father could be president.
John,
Re that pamphlet:
Was it something along the lines of ‘per statute XYZ your son is a citizen at birth. He is not eligible to be president’ ?
The constitution also says the candidate needs to be 35 years old or more.
Cruz has a valid birth cert to prove this.
0 doesn’t; his is a forgery.....
and it wouldn’t pass muster for proof of age for little league, drivers license, drinking, military service, social security, etc.
Cruz’ mom was old enough to pass u.s. citizenship to him.
0’s mom was too young to confer u.s. citizenship to 0.
Cruz or lose!
John,
Another question about that pamphlet:
Did it say your son was naturalized?
Did the amount of time you were away from the u.s. come into play here?
I think you are on the wrong site - we tend to make fun of the folks you cater to.
Because the Constitution identifies only two forms of citizenship; natural born and naturalized. If you are not one then you are the other, and Cruz was not naturalized.
Further clarification as to why Sen Cruz is a natural born citizen and Obama is not:
That single-parent requirement has been amended several times, but under the law in effect between 1952 and 1986 Cruz was born in 1970 someone must have a citizen parent who resided in the United States for at least 10 years, including five after the age of 14, in order to be considered a natural-born citizen. Cruzs mother, Eleanor Darragh, was born in Delaware, lived most of her life in the United States, and gave birth to little Rafael Edward Cruz in her 30s. Q.E.D.
So why all the brouhaha about where Obama was born, given that theres no dispute that his mother, Ann Dunham, was a citizen? Because his mother was 18 when she gave birth to the future president in 1961 and so couldnt have met the 5-year-post-age-14 residency requirement. Had Obama been born a year later, it wouldnt have mattered whether that birth took place in Hawaii, Kenya, Indonesia, or anywhere else. (For those born since 1986, by the way, the single citizen parent must have only resided here for five years, at least two of which must be after the age of 14.)
