Now we are finally getting somewhere. Just like Obama is ineligible technically because his fathers British Nationality 'governed' his birth status in 1961, Ted Cruz is ineligible too. Fox News has confirmed it and rightly so. Sean Hannity made a huge blunder the other day and declared Ted Cruz a natural born citizen because he was born to a American mother in Canada. He was so wrong. Cruz is a 14th Amendment U.S. 'statutory' (not natural born) citizen which is something completely different than a Article 2 Section 1 Constitutional natural born Citizen which is explicitly designed only for the presidency by the framers.
Fox is correct. Cruz is not eligible. He isn’t a natural born Citizen born to two U.S. citizen parents.
And that means Rubio is not a Constitutional Article 2 Section 1 natural born Citizen eligible for the presidency.
I reniged on that statement but my conviction here is strong.
Why beat up Cruz?

You know what this is going to come down to? Instead of focusing what Cruz is doing, all of the future Cruz threads will turn into this food fight. I am counting down the day until he is called a RINO over this issue alone just because the fights will get so heated.

Yes, he speaks well and yes, he seems to be knowledgeable - but then so did Obama to his followers.

Your baby would be a U.S. citizen because you are a citizen. You will have to register your baby’s birth with a consulate or embassy while overseas.
Three types of citizenship are recognized by our government: native born; naturalized; and citizen-by-statute (derived citizenship from parents). All have equal rights. All can serve in Congress, either as a Representative in the House, or as a Senator in the Senate.

The Minor v. Happersett ruling was based on an interpretation of the Privileges or Immunities Clause of the Fourteenth Amendment. The Supreme Court readily accepted that Minor was a citizen of the United States, but it held that the constitutionally protected privileges of citizenship did not include the right to vote.
SCOTUS rejected Minor’s argument that she was a citizen under the 14th Amendmnet of the U.S.Constitution, and examined her eligibility, concluding that she belonged to the class of citizens who, being born in the U.S. of citizen parents, was a natural born Citizen, and not covered by the 14th Amendment. This holding has been used in 25 consequent SCOTUS decisions since 1875.

The eligibility requirement of Natural Born Citizenship (jus solis + jus sanguinas: born in the U.S. of U.S. citizen parents) must be viewed as a means to prevent split allegiance for any President of the United States.

Can the Rubio/Cruz birthers point to any writings from the time of framing of the Constitution to justify their definition of natural born citizen?
Can they point to any case law?
Can they explain the other Presidents (ie NOT Obama) that didn’t meet their Natural Born Citizen criteria?
It’s strange that all these birthers are experts are the natural born citizen clause, but have nothing to support it in case law or from the writings of the Framers.
If the Framers wanted to ensure that you were born in the United States to two parents of American citizenship why wouldn’t they explicitly put that language in the Constitution.
I think the reason the dem Senate got into this declaration per McCain was to give “precedent” cover to nobama.
