My reaction to the horrible treatment Weiner gave to Megyn Kelly when she pointed out reasons why Thomas rightly doesn't need to recuse himself on the ObamaCare case.
That is very much appreciated. This post needed some aesthetic balance. :-)

Too bad Megyn didn't counter with the example of Ninth District Circus Court Judge Stephen Reinhardt. For years his wife Ramona Ripston was highly paid to head the Southern California ACLU organization. Both Ripston and Reinhardt are off-the-charts Lefties and Reinhardt's decisions are ultra-liberal. Fortunately, many are reversed by higher courts -- but not enough.

Yep...because he believes in Natural Law Theory and God’s Law is the source of all Just Law....just as all our Founders thought (and Cicero, Locke, Aquinas, etc.)
All law that is not based on natural law which is the source of logic and common sense (cause and effect) can never be just.
All other law (Positivism) is unjust because it is based on man’s whim and on legal force to place power over others which leads to unequal under the law. Our legal system since Holmes, has been all unconstitutional from many standpoints...particularly from the view of the Constitution which is the only one that is supposed to matter.
We have a ton of law that is outright unconstitutional and Thomas knows it. Scalia doesn’t seem to bother with the basic concept that underlines our legal system—Natural Law Theory and unalienable rights. He thinks that majority can vote those “unalienable” rights of babies away for some odd reason. I don’t know what he doesn’t understand about the word “unalienable”.
Life must be very confusing for a secular Jew cohabiting with a wife who's a Muslim Hamas supporter. [Or maybe it's Hezbullah or CAIR or the Muslim Brotherhood or some other Muslim “outreach” program. It's very confusing when dealing with Muslim terrorists.]
