[Please review the following email exchange between TerriK and DoH Communications Director Janice Okubo. This exchange foreshadowed the UIPA requests.

I was going to work this into Part 3, but it deserves its own headline. Those making compilations of the TerriK Investigation Report should insert the following post directly before Part 1. I am still preparing Part 3 of the report.]

FORESHADOWING

The timing of Hawaii Department of Health Director Chiyome Fukino’s July 27, 2009 Press Release appears suspiciously related to TerriK’s initial questioning of DoH Communications Director Janice Okubo – commenced earlier that day at 7:20 AM EDT (1:20 AM in Hawaii) – many hours before the infamous press release by Fukino was made public.

TerriK was initially interested in the question of whether President Obama’s birth record might reflect that he possessed an amended birth certificate. She had taken notice that provisions of law in Hawaii enabled one to obtain an original “amended birth certificate” even if one was born in a foreign country.

TerriK had not yet been exposed to the the UIPA or the second press release which mentioned “vital records” (plural), and so she had not yet made the assumption – for the purpose of making a specific UIPA request – that Obama’s vital records had been amended.

The following email was simply intended to determine whether DoH officials could provide information as to any amendments that might have been recorded. Later, after analyzing Fukino’s second press release, TerriK assumed such records did exist. But the following email predates that assumption:

Dear Ms. Okubo,

Can the State of Hawaii verify that they have the Amended (Original) birth record for President Barack Obama on file in accordance with state policies, whether digital, paper or otherwise?

Thank you and I apologize for your trouble in asking–I can’t imagine how this issue must be overwhelming you. You have been extremely patient and professional from what I can discern. But, I feel the best thing for me, is just to ask you guys myself.

Thank you again…

Here was Okubo’s non-responsive reply:

The original Press Release from October 31, 2008 was attached. You can see from the time stamp above, this email was sent by Okubo at 5:45 PM EDT (11:45 AM in Hawaii).

The second Fukino press release – wherein she unequivocally stated that she had seen records on file with the DoH proving Obama was born in Hawaii and that he was a “natural-born American citizen” – wouldn’t be released until later that evening.

And nobody had a clue it was coming.

I don’t believe Fukino knew she would be making a second press release that day. Otherwise, Okubo’s initial response might have been delayed until they were ready to make it public.

It appears that something happened to force their hand.

At 9:00 PM EDT (3:00 PM in Hawaii), TerriK sent the following email to Okubo:

Aloha! Thank you so much for replying quickly. And, thank you for the ‘infamous’ press release–it is a document I refer to every so often and having my very own is much appreciated. I’ll consider this document my brush with fame AND infamy! Frankly, I wonder what you must think of the ‘Birther’ inquiries and would like to state upfront, that I completely respect Hawaii’s Privacy laws. I ask that you answer the following, if privacy laws allow:

“Is the Director of Health for the State of Hawai‘i, along with the Registrar of Vital Statistics who has statutory authority to oversee and maintain these type of vital records, able to state they have verified that the Hawai‘i State Department of Health has President Barack Obama’s AMENDED original birth certificate on record in accordance with state policies and procedures.”

I fear my carefully chosen wording appears like an effort to ‘pull a fast one’–however, I modeled it on the following statement you were able to make publicly on your press release last year :

“Therefore, I as Director of Health for the State of Hawai‘i, along with the Registrar of Vital Statistics who has statutory authority to oversee and maintain these type of vital records, have personally seen and verified that the Hawai‘i State Department of Health has Sen. Obama’s original birth certificate on record in accordance with state policies and procedures. “

I hope this is reasonable to ask. If not, can you point me to the applicable statute?

As incredible as it may appear now, TerriK received the following response from Okubo at 11:45 PM EDT (5:45 PM in Hawaii):

From: “Okubo, Janice S.” Date: July 27, 2009 11:45:54 PM EDT To: [TerriK - real name redacted] Subject: RE: Your help is appreciated.

Attached is the statement issued today by the Hawaii State Director of Health. The director has never used the term “AMMENDED” (sic) in any of her issued statements regarding this issue.

Attached to this email was the actual press release issued by DoH Director Fukino on July 27th.

TerriK was completely shocked at the incredible dual statements laid before her on official DoH letterhead:

“I, Dr. Chiyome Fukino, Director of the Hawai‛i State Department of Health, have seen the original vital records maintained on file by the Hawai‘i State Department of Health verifying Barack Hussein Obama was born in Hawai‘i and is a natural-born American citizen. I have nothing further to add to this statement or my original statement issued in October 2008 over eight months ago.”

She received it at 11:45PM EDT on July 27, 2009 and then stayed up all night posting her story in comments to the Texas Darlin blog. That blog is no longer active and no archive apparently remains.

The next day she hit the web hard telling people about the DoH emails and attachments. You can see examples of this frenzy at Free Republic (posted as Miss Tickly).

Unfortunately, even a week later people were trying to make her look bad and disputing the veracity of her claims. Specifically, Ron Polarik disputed that a digital copy of the press release was in TerriK’s possession or even that one existed. Here is a comment he left on August 4, 2009 at Free Republic: To:MissTickly…

There was NO PRESS RELEASE. It was a direct statement made to Dan Nagaso of the Honolulu Advertiser.

There was confusion on this issue because it took the Hawaii DoH a long time to post a copy of the July 27th press release online. A We The People USA blog post documents that at 1:46 PM on July 28th, no copy of the July 27th press release was available at the Hawaii DoH web site.

If you put the digital copy of the Press Release sent to TerriK by Okubo side by side with the Press Release that exists now on the DoH website, you will see one slight difference – the word “more” at the bottom of TerriK’s copy.

Looking back retrospectively, TerriK’s questions submitted to Okubo early in the morning on July 27th appear to have been the catalyst for the notorious press release later that evening.

Was this a knee jerk reaction to a line of questioning which – if explored in light of the UIPA – had the potential to force the release of President Obama’s vital records?

It certainly appears logical, but I can’t answer that question conclusively.

However, I do feel very confident that the laws in Hawaii – UIPA, Haw. Rev. Stat. 338-18(d), OIP opinion letters and case law – will force the release of vital records and all other information consulted for the public statements made by DoH Director Fukino.

Now that I understand UIPA, I realize that I asked about index data for a vital event.

One of my own theories is that some proof of an amendment was submitted and an index number was generated, recorded and the vital record was filed for reference with his ‘marked-up’ amended original birth certificate. Therefore, there are “vital records” on file in accordance with policy, etc...

I feel I got an affirmative answer hidden in a statement that was meant to distract us from that answer by including the NBC and ‘born in Hawaii’ stuff.

That statement, now that it’s public, is the key to leveraging the law in the public’s favor. They were sloppy. It was a knee jerk reaction as Leo point’s out.

The timing of Hawaii Department of Health Director Chiyome Fukino’s July 27, 2009 Press Release appears suspiciously related to TerriK’s initial questioning of DoH Communications Director Janice Okubo – commenced earlier that day at 7:20 AM EDT (1:20 AM in Hawaii) – many hours before the infamous press release by Fukino was made public.

My, oh, my – we may have modus operandi.

Looking at the dates of TerriK’s pre-release of Fukino's written statement (July 27) and the PUBLIC release of Fukino’s written statement (July 28) seems to indicate a COORDINATED effort by the Hawaii Department of Health and Hawaii Congressmen in an attempt to “shut down” further questions of Obama’s eligibility.

As you may recall, there was a non-binding Resolution with the passage of H.RES.593 (House timeline on July 27) and S.RES.225 (Senate timeline on July 28) recognizing Hawaii’s 50th Anniversary as a US state. Also in the Resolution, among other things, was a clause that stated “the 44th President of the United States, Barack Obama, was born in Hawaii on August 4, 1961.” (House version text).

The Resolution was introduced in the Senate by Hawaii Sen. Daniel Inouye, and was originated in the House by long-time Obama friend Hawaii Rep. Neil Abercrombie, about a month earlier.

Several months earlier, on Jan. 24, Abercrombie also read a letter from newly-inaugurated Obama congratulating Kapi’olani Medical Center on their 100th anniversary, and pinning the hospital as the place of Obama’s birth.

It certainly seems that Hawaii Department of Health Director Fukino – with premeditation – wrote her draft News Release before the final passage of the Resolution, so that her “natural born citizen” proclamation would coincide with Congress’ non-binding Resolution proclaiming that “Barack Obama, was born in Hawaii on August 4, 1961.”

Further, it would seem that to answer TerriK's UIPA request, Fukino sent a draft of her planned News Release to TerriK on July 27, before the Senate passed the Resolution on July 28 that would give Fukino the political cover to formally place her final draft of the same News Release on Hawaii's state website on July 28. Oops!

We’ll have to see what else Leo Donofrio and TerriK have to share, but it sure seems that Obama is getting a lot of special help from Hawaii Department of Health officials who should be neutral in such political matters.

See, I can't see how a director of a state Dept of Health office could possibly know of an obscure non-binding Resolution in Washington DC that has no bearing on a health issue. Someone who intimately knew the Resolution was coordinating with her on this, and/or vice versa.

When the Resolution was introduced JUNE 26 in the House, it said, “Whereas the 44th President of the United States, Barack Obama, was born in Hawaii”

When the final draft of the same Resolution was brought up for vote on July 27, it said, “Whereas the 44th President of the United States, Barack Obama, was born in Hawaii on August 4, 1961”

That language was specifically modified for a purpose by it's Hawaiian authors.

Furthermore, as TerryK’s copy of the news release shows, the document was created on 7-27-09 at 5:21:27 pm HST on janice.okubo’s computer using Microsoft Word. The House portion of the Resolution was not passed until 7/27/2009 6:55 pm EST; the Senate (and final) Resolution passed sometime the next morning - with Fukino’s final statement modified on 7-28-09 8:19:21 am HST.

Fukino for the first time specifically uses the phrase “natural born American citizen,” paraphrasing - in her mind at least - the same language that's in the non-binding Resolution.

I think Fukino wanted something to quell the ever-tenacious TerriK, so she hastily emailed the statement she had been preparing to release to coincide with the final passage of the Resolution out of the Senate.

TerriK’s persistence forced Fukino to show her cards early to offer what Fukino felt was a “legitimate” denial of TerriK’s UIPA’s request.

From my understanding of the Hawaiian statutes, it would likely be as a result of a name change from an adoption or divorce than a change of citizenship status (unless citizenship was re-established later via the Hawaii Family Court).

In the above situations, those records - including the original BC - might be sealed with the Hawaii Family Court.

Could’ve gotten spooked for sure. And putting
ourselves in their place, maybe it had been in
the planning for awhile that it would be acknowledged
publicly by 0, as he was likely asked. And, of
course, they’re very familiar with all the hospitals.

Because there was going to be publicity of it
in Congress, maybe at DOH there was some
red alert, because they knew this was going to
occur and there would be press coverage, putting
HI in the spotlight and they wanted to keep their
department as low key and as out of the spotlight
and uncontroversial as possible and not detract
from his glorious WH letter stating the alleged
place of his birth, or incur his wrath.

Of course, there’s always the possibility that
the heat’s just getting too hot, and they’re
being really pushed.... from all sides.
