The UIPA at 92F-3 explicitly defines government records as follows:
Government record means information maintained by an agency in written, auditory, visual, electronic, or other physical form.
When a state agency in Hawaii is faced with a request for government records, the Office of Information Practices Administrative Rules govern all responses to such a request. State agencies may not issue a response which doesnt conform to the OIP Administrative Rules.
Agencies must answer every request for government records within the four following types of response:
1. the agency has the record and will provide it to you
2. the agency does not maintain/possess the record
3. the agency has the record but you are denied access to it
4. the agency needs more information from you to understand your request
These are examples of the four basic responses available to a state agency. For example, an agency may not tell a person that the agency refuses to say whether they possess a certain record.
This very issue was discussed in OIP Opinion Letter 97-08, wherein a staff attorney for the Corporation Counsel was faced with a UIPA request concerning a legal memo. The staff attorney refused to acknowledge whether the legal memo existed by citing attorney client privilege.

I think people are getting bogged down in chasing Obama’s birth certificate. The real issue (IMO) is how the constitution requirements for presidential candidates are implemented and who is responsible for ensuring the requirements are met (we know that several red states had a presidential candidate that clearly did not meet the requirements) and how compliance is documented. If this process can’t be followed from beginning to end it is not adequate and must be remedied by the Congress and/or the courts.
We can even address election fraud while we are at it.
I think that is what Leo is getting at. THe DNC used a whole bunch of confusing tactics to confuse the issue of Obama’s eligibility. One thing they could NOT do was to on a universal scale say that he was ineligible, they KNOW he isn’t so they had to set up plausible deniability with a bunch of inconsistent forms and crap.
The reality is: Obama was born of a British Father. That makes him ineligible right there. No need to go any forther in the least at all. The man should be in prison along with those who aided and abeited the largest fraud ever pulled off on the American People. Just think of all those suckers who DONATED that 900 million and worked their asses off for him. He is a criminal. THEY ought to be pissed as hell at him, it might be we should just throw him to them and let them tear him apart!

Not only has Obama waived privacy interests, the state waived them as well. More important is the fact that state law governs that no privacy interest exception applies when the information requested is required to be released under the UIPA at 92F-12.
The only question is whether Hawaii will obey its own laws.

It's possible the adoption (assuming there was an adoption, which hasn't been proven BTW) took place in Indonesia. In that case, it's doubtful there are any amendments to the record Hawaii, as the Indonesian courts would not likely have bothered to notify the Hawaiian DOH.
The adoption likely happened in Hawaii. In his book (for what ever that’s worth) said it happened before he went to Indonesia. Besides, if his Mom ran the Adoption through any official channels it would have had to involve his birth certificate.
We don’t know for sure, but it will all come to light with Leo’s success!

I haven't read either of his books, but that's the first I've heard that he says he was adopted. In which book did you find that passage, and what is the page number?
I can’t give those to you. I don’t have the pages that were posted on the internet now. I am only going on anecdote information now. The webpage I was referring to no longer exists.
Well, then you will forgive my skepticism, because my experience is that information passed around by birthers through word of mouth tends to be unreliable.
Can you at the very least tell me in which book he talks about this adoption? I could probably find someone in the marketing or OB department (they tend to be lefties) with a copy and I might be able to skim through and find it.
You don't even need to leave your computer desk. You can do text searches of both books at Amazon.
Though I can tell you right now that he doesn't say anything about being adopted in "Dreams From My Father." Because I already checked.

FYI, Danae, I just did a text search on "adopt*" in both of Bambi's books, and there is nothing in either of them about him being adopted by Soetero.
As far as I can tell, the only evidence that he was adopted is the mention of "two children" in the divorce papers of his Mom and step-dad. However, a lawyer friend of mine tells me that that such evidence is not conclusive, since divorce proceedings sometimes will list children of the household even if one of the divorcing parties is not their legal guardian. It depends on the family law of the state, and unfortunately he does not know what was in effect in Hawaii at the time of the divorce.
IMHO, it is most likely the case that he was adopted in Indonesia, as that would explain the Catholic school registration document, the divorce papers, and the fact that his birth record was never amended.
